SUMMARY OF ISSUES: Whether formal pleading, proof, and court findings requirements like those for sentencing adult habitual criminals are necessary when sentencing a juvenile as a mandatory sentence offender pursuant to 19-2-516(1), 6 C.R.S. (1999), especially where the juvenile did not contest that he was subject to sentencing as a mandatory sentence offender or seek live testimony on that issue. Assuming that such procedures are necessary, whether documentary proof presented pursuant to 19-1-107(2), 6 C.R.S. (1999), meets the formal proof requirement. Assuming that such procedures are necessary, whether double jeopardy prevents resentencing a juvenile as a mandatory sentence offender. JUSTICE SCOTT would grant as to the following issue: Whether the trial court erred in foreclosing the juvenile s opportunity to demand a jury trial pursuant to 19-2-501, 8B C.R.S (1996 Supp.).
