(Punjab Act No. 33 of 2011) AN ACT \ to provide f the Constitution of a Commission f Non-resident ndians with a view to protecting and safeguarding the interests of the Non-resident ndians in the State of Punjab, and to recommend remedial measures f their welfare and f the matters connected therewith incidental thereto. BE it enacted by the Legislature of the State of Punjab in the Sixtysecond Year of the Republic ofndia, as follows :- 1. (1) This Act may be called the Punjab State Commission f Non-resident ndians Act,2011. (2) t shall come into fce on and with effect from the date of its publication in the Official Gazette. - 2. n this Act, unless the context otherwise requires,- Sht title and commencement. Definitions. (a) "Chairperson" means the Chairperson of the Commission; (b) "Commission" means the Punjab State Commission f Nonresident ndians constituted under section 3 ; (c) "complaint" means all petitions communications received in the Commission from a Non-resident ndian from any other person Onhis behalf, in person by post by telegram by fax cr by any other means whatsoever, alleging, disputes violations abetment thereof negligence in the prevention of such dispute violation, by a public servant a private person providing material on the basis of which the Commission takes suo-motu cognizance; ~,,_.~_.r_-~b~2~---------------------------------- ~ ~==~~==~

(d) "Government" means the Governmentofthe State of Punjab in the Department ofn.on-resident ndians Affairs; (e) (f) "Member" means a member of the Commission and includes the Chairperson and the Secretary ; "Non-resident ndians" means a person ofndian igin, who is either permanently temparily settled outside ndia, in either case- (i) f on taking up employment outside ndia; (ii) f carrying on a business vocation outside ndia; (iii) f any other purpose, in such circumstances, as would indicate his intention to stay outside ndia f an uncertain period; and (g) "prescribed" means prescribed by rules made under this Act. Constitution of the 3. (1) The Government shall, by notification, constitute a body to be known as the Punjab State Commission f Non-resident ndians to exercise the powers conferred upon and perfm the functions assigned to it under this Act. (2) The Commission shall consist of- (a) a Chairperson, who shall be a retired judge of the High Court ; (b) one Member who is, has been an AS Officer, not below the rank of Principal Secretary Financial Commissioner to be appointed by the Government; (c), one Member who is, has been an PS Officer, not belowthe rank of Additional Direct General of Police to be appointed by the Government; (d) two members shall be nominated by the Government from amongst the persons having knowledge of, practical experience in matters and issues relating to Non-resident ndians; and (e) there shall be a Secretary (ex-cadre from PCS Executive), who shall be the Chief Executive Officer of the Commission and shall exercise such powers and discharge such functions of the Commission as it may delegate to him. f--

The Chairperson and Members shall hold 'office f a term of jhree years from, the date on which they enter upon their office until they "attain the age of seventy years, whichever is earlier:. (1) The Chairperson Member may, by way of notice in writing under his hand addressed to the Government, resign his office. (2) Notwithstanding anything contained in sub-sectionv/), the Government may by der remove from the office of the Chairperson any other Member, as the case may be, if he- Resignation and removal of Chairperson Member. (a) is adjudged an insolvent; (b) engages during his term of office in any paid employment outside the duties of his office; (c) is unfit to continue in office by reason of infirmity of mind body; (d) is of unsound court; mind and stands so declared by a competent (e) is convicted and sentenced to imprisonment f an offence which in the opinion of the Government, involves mal turpitude. 8; (1) n the event of the occurrence of any vacancy in the office of the Chairperson by reason of his death, resignation otherwise, the Government may, by notification, authize one ofthe Members to act as the Chairperson until the appointmentof a new Chairperson. (EXTRA.), NOY. 29, 2011 (AGHN 8, 1933 SAKA) (2) When the Chairperson is unable to discharge his functions owing to absence leave otherwise, such one-of-the Members as the Government may, by notification, authize in this behalf, shan discharge the functions of the Chairperson until the date on which the Chairperson resumes his duties. Terms and conditions of service of Chairperson and Members. Officers and other staff of 9. (1) The-Commission shall, while investigating any matter under this Act, have all the powers of a civil court trying a suit and, in particular, in respect of the following matters, namely:- (a) summoning and enfcing the attendance of any person and examining him on oath; (b) requiring the discovery and production of any documents; (c) receiving evidence on affidavits;

(2) The.Commission shall perfm its functions by holding "sittings" and "meetings" at any place within the State of Punjab. (3) The Members of the Commission including the Chiarperson shall function in accdance with the niles framed under this Act. 13. The Government shall consult the Commission on all maj policy matters affecting Non-resident ndians... 14. The Commission may conduct inquiry investigation into the matters falling within its authity :- (a) either directly; (b) through an investigating team constituted by the Commission; (c) through the Deputy Commissionerofthe district concerned; Government to consult the Power of the Commission to utilize the services of certain officers and investigating agencies f conducting investigation. (d) through the Government.. 15. No statement made by a person in the course of giving evidence befe the Commission, shall be used against him in any civil criminal proceedings, except f prosecuting him f giving false evidence: Provided that the statement,- Statement made by persons to the (a) is made in reply to.a question, which is required by the Commission to answer, (b) is relevant to the subject matter of the inquiry. 16. No suit, prosecution other legal proceedings shall lie against any Member any officer othe;~ffiployee of the Commission any person acting under the direction either of the Government of the Commission, in respect of anything, which is in 'good faith done intended to be done in pursuance of this Act, any rule der made there under. (1) The State Government shall, after due appropriation made by the State Legislature by law in this behalf, pay to the Commission by way of '- - grants from the Consolidated Fund of the State; such sums of money, as the State Government-may consider appropriate f being utilized f the purposes of this Act.. (2) The Commission may utilize such sums of money as it considers appropriate f perfming the functions under this Act and such sums of money shall be treated as expenditure payable out ofthe grants referred to in sub-section (1). Accounts and. Audit. 18. (1) The Commission shall maintain proper accounts and other relevant recd and prepare annual statement of accounts in such fm, as may be prescribed. (2) The accounts of the Commission shall be audited by the Local Funds Exam iner, Punjab, within three months after the close of each-financial year and any expenditure in connection with such audit, shall be payable by the. Commission to the Local Funds Examiner, Punjab. Animal Rept. Annual Rept and Audit rept to be laid befe the State Legislature. Chairperson, Members and staff of the Commission "toby public servants. Penalty. (3) The accounts of the Commission, as certified by the Local Fund Examiner, Punjab, togetherwith the audit rept thereon, shall be fwarded annually to the Government by the 19. The Commission shall prepare, in such fm and at such time, f each financial year, as may be prescribed, its annual rept, giving a full account of its activities during the previous financial year and fward a copy thereof to the Government. 20. The Government shall cause the annual rept togetherwith a memandum of action taken on the recommendations contained therein, in so. far as they relate to the Government and the reasons f the non-acceptance, if any, of any of such recommendations, and the audit rept, to be laid, as soon as may be, after the repts; are received, befe the State Legislature. 21. The Chairperson, Members, officers and 'other employees of the Commission shall be deemed to be public servants within the meaning of section 21 of the ndian Penal Code. 22. Whoever being legally bound to obey any der of the Commission under section 12 the der of an officer investigating agency referred to in section 14, intentionally omits to do so furnishes false infmation, shall, on conviction, be punished under sections 174, 175, 176, 177, 178, 179 and 180 of the ndian Penal Code, as the case may be.

Commission to the Local Funds Examiner, Punjab. (3) The accounts ofthe Commission, as certified by the Local Fund Examiner, Punjab, togetherwith the audit rept thereon, shall be fwarded annually to the Government by the 19.
