2 THE REGIONAL HEALTH AUTHORITIES (AMENDMENT) BILL, 1999 Explanatory Note (These notes form no part of the Bill but are intended only to indicate its general purport) The purpose of the Bill is to amend the Regional Health Authorities Act in order to ensure that (a) Governrnent s existing policy on the payment of preserved superannuation benefits be maintained, so that a Pension Plan operated by a Regional Health Authority (RHA) would provide a level of pension which, when taken together with the preserved Government benefits would realise a total pension based on pensionable public service before and service after transfer to the RHA and on final salary earned in an RHA at retirement; (b) where a forrner public officer dies or retires in a nonpensionable RHA position before the establishment of a Pension Plan operated by a RHA and where such forrner public officer was in receipt of a higher salary than that at the time of his transfer, his superannuation benefits would be based on the higher salary and the difference in superannuation benefits due would be met by the RHA.

3 BILL A N A CT for the incorporation of the Trinidad and Tobago Association of Professional Psychologists and for related matters. [, 1999] WHEREAS there has been established in Trinidad and Tobago an Association known as the Trinidad and Tobago Association of Professional Psychologists: Preamble

4 And whereas it is expedient that the Trinidad and Tobago Association of Professional Psychologists be incorporated for the purposes hereinafter set forth: Enactment Short title Incorporation Aims and objectives ENACTED by the Parliament of Trinidad and Tobago as follows: 1. This Act may be cited as the Trinidad and Tobago Association of Professional Psychologists (Incorporation) Act, 1999. 2. The Trinidad and Tobago Association of Professional Psychologists (in this Act referred to as The Association ) is hereby created a body corporate. 3. The aims and objectives of the Association are: (a) to promote the concept of total wellness as it pertains to the psychological well being of all persons; (b) to promote and maintain the honour and interests of the profession of psychology; (c) to promote and protect the interests and welfare of psychologists; (d) to maintain and improve the standards of conduct and proficiency of the profession of psychology; (e) to represent the interests of psychologists of Trinidad and Tobago in local and international bodies; (f) to promote good relations within the profession, between the profession and other professional bodies and the public generally; (g) to promote good relations between the profession and professional bodies in other countries and to participate in the

activities of any international body or association of psychologists and to become a member thereof; (h) to promote continuing education and research in the field of psychology; (i) to engage in publications, seminars, workshops and other activities for the purpose of disseminating information and knowledge of psychology ; and (j) to do all such other lawful things as are incidental or conducive to the achievement of the foregoing aims and objectives. 4. The Association shall have power to: 5 (a) acquire by purchase, transfer, donation, exchange, devise, bequest, grant, gift, conveyance or howsoever otherwise any real or personal property or any estate or interest therein; (b) accept surrenders or reconveyances and to enter into contracts; (c) sell, exchange, demise, mortgage or otherwise dispose of and deal with all property which may for the time being be vested in it subject to any restraint, reservation or condition contained in the document under which it has acquired title; (d) borrow money with or without security on any of the property of the Association and to grant or direct to be granted mortgage, debentures or other charges over the property of the Association for securing the same; (e) employ such servants, employees, consultants, contractors, professionals and other persons as may be found necessary for the due conduct of the affairs of the Association; Powers of the Association

Transfer and vesting of property Mode of execution of documents Service of documents 6 (f) carry out such disciplinary measures amongst the members of the Association as it may deem necessary for the maintenance and carrying out of the objects of the Association; (g) delegate all or any of its powers to any committee etablished for such purpose; (h) take any gift or money or other property whether from local, or overseas donor and whether subject to any special trust or not for any one or more of the purposes of the Association; and (i) generally to do all things necessary or expedient for the due conduct of the affairs of the Association not herein provided for. 5. All real and personal property of whatever nature now held by or vested in any person for the use and benefit of the Association is hereby transferred to and vested in the Association. 6. All document requiring the Seal of the Association shall be sealed with the Common Seal of the Association in the presence of the President and Secretary for the time being in office or, in the event of incapacity, in the presence of some other person or persons authorised for that purpose by the Association, who shall both sign every such document and such signing shall be prima facie evidence that the said Seal was duly affixed and that the same is the lawful Seal of the Association. 7. (1) The Association shall at all times have a fixed address in Trinidad and Tobago for the service of documents on the Association and that address and any change thereof shall be registered with the Register General within twenty-eight days of the date of incorporation or the change of address, as the case may be. (2) Every document to be served on the Association may be served by leaving the same at, or by sending the same by registered post to the registered address of the Association.

7 (3) Failure to register the address and any change thereof is a summary offence and renders the Association liable to a fine of one hundred and twenty dollars and to a further fine of ten dollars for each day during which the offence continues after conviction thereof. 8. The Association may from time to time make rules for the proper conduct of its proceedings and discharge of its duties, powers and functions and such rules may be amended from time to time. 9. Nothing in this Act shall affect or be deemed to affect the rights of the State, or of any bodies politic or corporate or of any persons, except such as are mentioned or referred to in this Act and those claiming by, through, from or under them.
