OkAPP Presentation July 24, 2012 The last session of the 53 rd legislature saw 2,005 new bills introduced and another 1,822 bills still alive from the previous session, virtually on any topic you can imagine. The primary topic the last session was the budget had to be completed for fiscal year 2013. Some of the other topics were the reduction or foreseeable elimination of personal income taxes, funding for education, funding for state retirement and pension programs, and further consolidation efforts of state agencies. * HB2197 Effective Date: 08/23/2012; Governor Action - Signed; An Act relating to state government; creates the Cost Reduction and Saving Act. The bill provides: ~ the State Purchasing Director may form an advisory committee consisting of representatives from entities exempted from the provisions of the Oklahoma Central Purchasing Act to allow committee members to provide input into the development of shared state purchasing contracts, collaboratively participate in the integration of their purchasing platforms or electronic purchasing catalogs, analyze solutions that may be used by state government to meet the purchasing needs of the entities, explore joint purchases of general use items that result in mutual procurement of quality goods and services at the lowest reasonable cost and explore flexibility, administrative relief and transformation changes through utilization of procurement technology. The bill also permits the State Purchasing Director to invite representatives of local government and local common education entities to participate as members of the advisory committee. ~ The bill removes language permitting the state travel office to divide the state into high travel areas and low travel areas. ~ The bill provides it is the policy of each state agency to prepay airline fares and lodging expenses using a purchase card issued to the agency where employees of the agency are traveling on behalf of state government whenever possible. ~ The bill also directs the chief information officer to require that agency purchasing software consider whether proprietary or open-source software provides the most cost-effective solution for the agency. *HB2288 Effective Date: 11/01/2012; Governor Action - Signed by Rep. Emily Virgin, D-Norman and Sen. *HB2563, Effective Date: 08/23/2012; Governor Action - Signed; Rep. Paul Wesselhoft, R-Moore and Sen. Josh Brecheen, R-Coalgate, modified the qualifications for the position of Native American liaison which was created by the legislature in House Bill 2564 of the 2 nd Session of the 53 rd Oklahoma legislature when the Indian Affairs Commission was abolished. *HB2646 Effective Date: 8/23/2012; Governor Action - Signed; Rep. David Ralph Brumbaugh, R- Broken Arrow and Sen. David Fuller Holt, R-Oklahoma City, ~ increases the number of members on the State Use Committee from five to seven and designates those members be the director of the Department of Human Services, or a designee, and a certified procurement officer of any state agency appointed by the state purchasing director who will represent the customer agencies of the state of Oklahoma. ~ The bill permits the state use contracting officer to grant a temporary exception for the purchase of a product on the open market until a new fair market value can be set by the committee when an established approved fair market price of a product or service is discovered to be legitimately higher than current market prices. *HB2647 Effective Date: 11/01/2012; Governor Action - Signed; An Act relating to relating to state vehicles. ~ A state agency that owns or leases vehicles shall affix the words "State of Oklahoma" and the name of the department or institution that owns or leases the vehicle in conspicuous letters. Vehicles utilized by ClEET-certified officers or state employees primarily employed in investigative activities Fleet Manager. may be exempt from the provisions of this section subject to the approval of the State ~ State employees may be exempt from the reimbursement requirements of the Trip Optimizer system, provided the state employees utilize a personally owned vehicle and seek reimbursement according to the schedule referenced in subsection F of this section. The Office of State Finance may publish a schedule of reimbursement rates for state employee travel. The schedule may apply to exemptions claimed under subsection E of this section. The schedule may categorize reimbursement rates by type of vehicle and shall not exceed standard mileage reimbursement rates as established by the Internal Revenue Service. In providing a calculation of rates, the Trip Optimizer system shall account for the distance that an employee must travel to pick up a rental or state fleet vehicle. Rick Brinkley, R-Owasso clarifies the duties of a state agency to keep, maintain and open to any person all records of the agency in compliance with the Oklahoma Open Records Act even if the records have been transmitted to or stored by the Information Services Division of the Office of State Finance or to the chief information officer. *HB3053 Effective Date: 11/01/2012; Governor Action - Signed; An Act relating to state government; creating the State Government Administrative Process Consolidation and Reorganization Reform Act of 2012; amending 62 O.S. 2011, Sections 34.3 and 34.3.1, which relate to the Oklahoma State Finance Act; creating the Office of Management and Enterprise Services; consolidating certain agencies into the Office of Management and Enterprise Services. It changes the name of the Office of State Finance to the Office of Management and Enterprise Services. It consolidates the Office of Personnel Management Division into the Office of Management and Enterprise Services. It states that when the term "Office of Personnel Management" is used within the Oklahoma statutes, it shall mean the Office of Management and Enterprise Services. It requires the director of the Office of State Finance or designee to oversee the development and implementation of the program, including selection of a vendor using a request for proposal to contract to develop and implement an organizational behavior-based and performance-based energy conservation program.
