ORDER: In note 3 (b) and (c) under rule 3 of the Andhra Pradesh Panchayat Raj and Rural Development Service Rules, 2001 issued in the reference 1st read above, the percentage of promotion quota of the feeder categories were fixed basing on the cadre strength for appointment to the post of Mandal Parishad Development Officers. The Commissioner, Panchayat Raj and Rural Employment in the reference 3rd read above had furnished the proposals for re-allotment of quota for the feeder categories consequent to increase of cadre strength of superintendent posts from 254 to 1344 in view of the orders issued in GO Ms. No. 498. PR&RD (E V) Department dt 12-10-1999, upgrading the post of Senior Assistant in Manda! Parishads to that of Superintendents. 2. after careful examination of the matter have decided to reallot the quota of the feeder categories to the post of Mandal Parishad Development Officer by amending the Andhra Pradesh Panchayat Raj and Rural Development Service Rules, 2001. 3. Accordingly, the following notification will be published in the Andhra Pradesh Gazette:-

Spl/ adhoc rules relating to various State and Subordinate Services a provision was made to the effect that a member of a service should ordinarily put in a period of five years of service, in the lower category, from which promotion is to be made, to the next higher category in the same service or appointment by transfer from any other service. The with a view to avoid administrative difficulties, issued an adhoc rule in G.O. 1st cited, read with G.O. 2nd cited, reducing the period of ordinarily five years service in the iovver category to three years and it has also been ' equested therein that all the Departments of Secretariat shall!;-ke action to amend the Spl.adhoc rules with whch they are Concerned to bring them in confirmity with this adhoc rule. In this connection certain Departments have finalised their Special Rules according to the recommendations of O.M.C. making a provision as per the adhoc rule issued in the above referred G.Os. and certain Departments are yet to finalise the Special Rules as per the recommendations of O.M.C. The Departments of Secretariat in which the SpecialRules are under finalisation are requested to take immediateaction to make the provision as provided in G.O.Ms.No. 627,Genl. Admn. (Ser.A) Dept. dated 21-12-83 read with^g.o.ms.no. 422, Genl. Admn. (Ser.A) Dept. dated 24-07-89Jfri the Special Rules/Adhoc Rules with which they are concerned to bring them in confirmity with the ad-hoc ruleissued in the G.O. referred above, otherwise it will not beclear as to the continuance of the existing such provisionsor otherwise. In the G.O. 1 st read above, the state have ordered for implementation of the rule of reservation in promotion to ensure adequate representation of scheduled castes and scheduled tribes to the extent of 15% and 6% respectively in all categories of posts in all departments, with effect from 14.2.2003 In the G.O. 2 nd read above necessary guidelines hav e been issued and In the G.O. 3 rd read above,, the Andhra Pradesh State and Sub-ordinate service rules have been amended to give effect to the policy of rule of reservation in respect of scheduled castes and scheduled tribes. The received representations asking for clalrifications on certain issues pertaining to the policy of reservation in promotion s to the scheduled castes and scheduled tribes the have considered the representations and accordingly issue the following comprehensive orders. Reservations in promotions shall be implemented in favour of scheduled castes and scheduled tribes, in all categories of posts in all State Departments, if they are not adequately represented to the extent of 15% and 6% respectively. The crucial date for implement ting the rule of reservations in promotions shall be 14-2-2003, i.e. date of issue of G.O. 1 st read above. Computation of adequacy of representation ; for the purpose of computing adequacy of representation of scheduled castes (15%) and scheduled Tribes (6%) in various categories, the following procedure shall be followed, (A)The persons belonging to scheduled castes and scheduled Tribes who have been promoted on the basis of seniority cum merit i.e. with out applying the rule of reservation should also be counted for judging the adequacy or otherwise of scheduled castes / scheduled tribes representation. (b) The adequacy or other wise representation should be counted in respect of each category of posts but not for the department as a whole. (c) If in respect of any category if adequate representation already exits as on 14.2.2003 or is attained at a later date, the rule of reservation in promotion in favour scheduled castes/ scheuled tribes shall not be applied forther.

(d) For the purpose of computing the adequacy In respect of scheuled castes (i.e.15%), ABCD categorization will not be observed and the adequacy will be with reference to total number of employees irrespective of their ABCD categorization. 5. crucial date for determing the dequacy : 1 st September shall be reckoned as crucial date to determine the adequacy representation in each category of posts for scheduled castes & scheduled tribes. while arriving at the number of vacancies to be filled baced on rule of reservation in promotions in respect of scheduled castes and Scheduled Tribes categories, to achieve adequacy of representation, the fraction shall be ignored. 6. Reservation in promotion in favour of Scheduled Castes and Scheduled Tribes, shall be implementated in promotions to all the categories of posts, in all services whose total Cadre Strength in more than five. 7. Roster Points: The reservation in promotions in respect of Scheduled Castes and Scheduled Tribes shall also include the gender based reservation. In respect of Scheduled Castes the reservation shall be sub-category based. The existing 100 point roster already prescribed in Rule 22 of Andhra Pradesh State and Sub-ordinate Service Rules for direct recruitment shall be followed for implementing the Rule of Reservation for promotion for Scheduled Castes and Scheduled Tribes. However in sofar as providing reservation for Scheduled Castes based on sub-categorisation, the roster followed for direct recruitment shall be followed. The roster for promotion is at annexure. NOTE:Once the adequacy is achieved to the required percentage of 15% in respect of Scheuled Castes and 6% in respect of Scheduled Tribes, in a category, the application of the rule of reservation in promotions shall be stopped and the promotions shall be effected based on merit cum seniority. The candidates so promoted shall be fitted into the same roster, without earmarking the reserved toster points. If on 1 st September of any panel year, the representation of Scheduled Castes/ Scheduled Tribes is inadequate, the reservation in promotions shall be resumed. The roster point shall start from next point of the candidate figuring in the previous panel prepared year, there are 20 posts in a particular category and there are 2 SC candidates in position. Thereore as on 1 st Septembesr of a panel year, the adequacy of SC representation is short by one candidates. The vacancies for the panel year are estimated as 10. If the roster points starts from 1, then the 2 nd roster point has to be filled up the SC-A candidate or with any other SC candidates as per the procedure stipulataed.after inclusion of the said candidate there shall be adequacy of representation and there is not need to follow the SC roster. The other candidates shall have to be promoted, including the SC candidates if they are figuring in the general seniority list, based on the merit cum general seniority. They shall be shown at the condinuous roster points. The 7 th roster point of SC shall be filled up with the candidates based on merit cum seniority. The roster points from 1 to 10 shall have to be fille dup in such manner. In the next panel year, if it is found that there is adequacy of SC representation, then the promotions shall be effected based on general seniority and merit. If there is inadequacy of representation, SC candidates shall be promoted based on roster. The roster point for that panel year shall start from 11 and the next SC roster point is available at 16 and the same shall be filled up with SC candidatae. 8 Eligibility of Candidates:Reservation in promotion infavour of Scheduled Castes and Scheduled Tribes shallbe applicable to those candidates who are fully qualified and eligible to hold the posts as per the existing Rules and guidelines.if no qualified and eligible candidate available the vacancy shall be carried forward. 9 Zone of consideration: The Zone of consideration as laid down in Rule 6 of A.P.State and Sub-ordinate Service Rules, in respect of Scheduled Castes and Scheduled Tribes categories shall not be applicable to fill up the roster points meant for SC and ST categories.

10 The panels for the year 2002-2003, which were prepared prior to 14.2.2003 and operated totally or partially, shall continue without any changes and they shall not be reopened. The panels for the year 2002-2003, which were prepared and are not operated as on 14.2.2003 shall have to be reviewed to implement the rule of reservation in promotion to Scheduled Caste and Scheduled Tribe categories. 11. Non-vailability of eligible candidates:- If eligible candidates for promotion are not available for promotion as per the roster point specified, it shall be filled in by including the next candidates belonging to the next group of Scheduled Caste. Note: If an eligible candidate for promotion is not available from Scheduled Caste-A, the roster point may be filled up by a candidate of Scheduled Caste-B and so on and so forth. In case of women candidates also, the same process shall be followed viz., if an eligible Scheduled Caste-A(Women) is notavailable, the roster point may be filled up by Scheduled Cate-B(Women) candidate and so on and so forth. 12. Conversion of roster point of Women:- In case there are no qualified women candidates available, the following procedure shall be followed (a) If no eligible woman candidates is available to fill up the roster point earmarked for scheduled caste (woman) the vacancy shall be filled up with male candidate how ever while filling the said vcancy the roster point shall be filled up with the same group of scheduled caste (woman) to which it was originally earmarked if no male candidate is available then the same shall be filled up with other scheduled castes candidates following in the same order. Note:in the cast of roster points for scheduled caste (woman ),if Scheduled Caste-A(Woman) is not available, the vacancy may be filled up by a Scheduled Cate-B(Woman) and so on. If Scheduled Caste (A,B,C,D)`Woman candidate is not available, the vacancy may be filled up by Scheduled Caste(A,B,C,D) Male candidate in that order. If the roster point is earmarked for Scheduled Caste-B woman candidate and no Scheduled Caste Woman candidate is available, the roster point shall be filled up with male candidates belonging to Scheduled Caste-B category. If no Scheduled Caste-B male candidate is available, the roster point shall be filled up with Scheduled Caste-C male candidate and so on and so forth. (b) In respect of Schedule Tribes, if Scheduled Tribe (Woman) candidates is not available, for promotion to fill in the roster point earmarked for Scheduled Tribe(Woman), the vacancy shall be filled up by a Scheduled Tribe Male candidate. 13. Carry forward vacancies:-regarding carry fowrad of vacancies, if no qualified candidates are available, the following procedure shall be fillowed. In case qualified Scheduled Caste/Scheduled Tribe candidates are not available for a particular panel year the vacancy shall be carried forward to the subsequent year. In the second year if Schedule Caste/Scheduled Tribe candidates are not available, the vacancies or points meant for Scheduled Caste/Scheduled Tribe candidates may be filled up by candidates from the feeder category based on merit and seniority. The employee appointment by promotion/by transfer shall commence probation from the date of joining and his/her services shall be regularised after sixty days of duty. According the Rule33(a) of Andhra Pradesh State and Subordinate Servicce Rules the seniority of a person in service, class, category or grade shall unless he has been reduced to a lower rank as a punishment, be determined by the date of his first appointment to such service, class, category or grade. 2. The State and Subordinate Service Rules clearly stipulates the procedure for placement on probation, declaration or probation,declaration of probation and fixing the seniority in the category. Several instructions are issued from time to time on preparation of panels for appointment by promotion/transfer, for adhoc promotions and for preparatuion or seniority list. The time schedule is also fixed to communicate the Seniority list. In most of the Departments while dealing with service matters, these instructions are not followed thereby there is an unending litigation in a court of Law for promotions and to fix the seniority. Several representations are filed for national promotions. In some cases, the representations filed are for revision of seniority relating to the initial category post in which the employee was appointmented which is 20 to 30 years ago. 3. According to Rule 23 of Andhra Pradesh State and Subordinate service Rules an Appeal/Revision/Review against the order of appointment to a higher posts shall be filed within a period of three months from the date of such order. The Rule 26 relates to the appeal against seniority and other conditions of seniority. The aggrieved person shall file the appeal petition within a period of 90 days from the date on which the junior was promoted. The appellate Authority shall dispose that appeal peririon within a period of 90 days from the date on which the junior was promoted. The Appellate Authority shall dispose the appeal Petition within a maximum period of one year. (Cont..2 nd Page).

While the rule position is as stated above, in several cases, the appeal petition is filed after completion of severalk years after the junior was promoted to the next higher category, with a request to revise the seniority. In this context, the judicial pronouncement, the Supreme Court of India rulingf on seniority in service matters, pulished in the Hindu dated 11.07.1998 has been reported in (1998) 2 SSC 523 is extrated below. During the entire period of more than a decade they were all along treated as junior to the other aforesaid perosons and the rights interest had crystallied which ought not to have been reopened after the ;apse of such long period. At every stage others were promoted before B.S. Bajwa and B.D. Gupta right from the beginning as found by the Division Beach itself. It is well settled that in service matters the question of seniority should not be reopened in such situation after the lapse of a reasonable period because that results in disturbing the settled position which is not justifiable. There was inordinate delay in the present case for making such a grievance. This alone was sufficient to decline interference under Article 226 and to reject the writ oetition. 5. direct that in dealing with the cases for fixing the seniority the procedure and the rules prescribed in Andhra Pradesh State and Subordinate Service Rules or in Special Rules governing the post shall be followed. No request for revision of seniority for a period which is more than 3 years old shall be considered. The seniority list in each category shall be communicated, as and when the employee completes the prescribed period of probation in the respective category. 6. In any of the cycle in the above notes, if suitable and qualified persons are not available in respect of any feeder category, the vacancy meant for that category shall lapse and the person in the category next in the order in the cycle shall be considered. 4. Reservation of Appointment a) Expect in so far as it relates to physically handicapped persons, the rule of Special Representation (General rule 22) shall apply to the appointment by direct recruitment. b) In the matter of direct recruitment of women candidates, Rules22-A of the Andhra Pradesh State and Subordinate Rules shall apply to the appointment by direct recruitment. 5. Qualificaions No person shall be eligible for appointment to categories specifiedin column (1) of The Annexure to these rules by the method specified in column (2) unless he posses the qualify -cation specified in the corresponding entry in column (3) there of:

Minimum Service Unless, otherwise specified, no person shall be eligible for paaointment by transfer or promotion unless he has put in 3 years of service in the category from which promotion or transfer is made and if no such candidates are available, service of two years shall be considered as adequate. It shall be one year in respect of Deputy Commissioner for promotion to the category of Additional Commissioner of Panchayat Raj and Rural Employment. 7. Probation a) Every person appointed by direct recruitment to the various posts in the service shall, from the date on which he commences probation, be on probation for a total of two years on duty, within a continuous period of three years. b) Every person appointed to any of the posts either by promotion or by transfer shall, from the date on which he commences probation, be on probation for a total of one year on duty within a continuous period of two years. 8. Training a) Every person appointed either by transfer or by direct recruitment to the posts of District Panchayat Officer including Gazetted Instructor (Panchayats) in Village Development Officers Training Centres, Mandal Parishad Development Officers Rural Development (formerly APARD) and Gazetted Instructor (Mandals) in Village Development Officers Training Centres, Accounts Officers and DivisionalAccounts Officers (Works) Panchayat Raj shall, immediately after appointment or thereafter undergo a course of training for such period and as per such period and as per such programme and syllabus as may be prescribed by the Commissioner, Panchayat Raj and Rural Employment or the. b) Every person appointed by direct recruitment shall before the commencement of training an agreement bond that he/she shall serve the department for a period of three years after the completion of training referred to in sub-rule (a). He/she shall able to refund to the the pay and allowances and any other remuneration received by him/her in addition to the amount spent by the on his/her training. i) If he/she fails to serve the department for a period of three years after the completion of his/her training for any reason; or ii) iii) If he/she discontinues the training or is discharged from training course for misconduct or any other reason; or If he/she secures any other employment elsewhere other than the State c) The period of training shall count for purpose of probation,increment,leave and pension etc. d) A direct recruitee shall be eligible during the period of training for the initial pay of the post with usual allowances admissible at the place of training.

9. Provided that the post of Gazetted Indturctor (Mandals) in the Village Development Officers Training Center shall be filled by the Mandal Parishad Development Officer of the Zone Unit in which the relevant Village Development Officers Training Center is located. Madhava Reddy Academy of Rural Development (formerly APARD) shall be filled by the Mandal Parishad Development Officer from all the Zonal Units in proportion to the basic cadre strength of the Mandal Parishad Officers in various Zonal Units, in rotation starting from the highest cadre strength Zone. Provided also that the post of Gazetted Instructor (Panchayats) in the Village Development Officers Training Center shall be filled by the District Panchayat Officer of the Multi Zone Unit in which the relevant Village Development Officers Training Center is located. 10. Transfers and Postings The appointing authority as specified in column (3) in the Table in rule 3 thereof, shall be competent to effect the transfer and posting of persons in the respective categories. Provided that notwithstanding the power of transfers and postings vested in the appointing authority, the Chief Executive Officers shall be competent to effect the transfer of Mandal Parishad Development Officers with in their District subject to the unit of appointment as specified in the Table in rule 9 of these rules.

11. Tests The persons appointed by direct recruitment shall pass the tests prescribed in column (3) in the Annexure to these rules during the period of their probation.
