Persons who wish to speak on matters on the agenda will be heard for up to three minutes when the Chair calls for comments. After persons have spoken on an agendized item, the public comment period will be closed by the Chair and the matter is subject to discussion and/or action by the MAC. Persons wishing to speak must fill out a speaker card. 1. CALL TO ORDER - PLEDGE OF ALLEGIANCE - ROLL CALL The meeting was called to order at 6:00 P.M. by Chair Rock. Alamo Municipal Advisory Council members present: Chair, Susan Rock, Vice-chair, Aron DeFerarri, David Barclay, Steve Mick, Sanjiv Bhandari, Clark Johnson, Anne Struthers, Jennifer Carter and Kate Salisbury. 2. STAFF/AGENCY REPORTS A. District II Staff Update - The next Alamo Liaison meeting is scheduled for February 26th, beginning at 8:30 a.m. at Supervisor Andersen s office located at 309 Diablo Road, Danville. Sunday, March 25 th Dose of Awareness Walk hosted by MEDS Coalition and the National Coalition Against Prescription Drug Abuse 5k walk at Heather Farms Park in Walnut Creek from 1:00pm to 3:30pm. The Friends of San Ramon Creek along with the County Flood Control District, D.V.C., and the Walnut Creek Watershed Council are performing an aerial drone survey for invasive plants along the creek at Hap Magee park. The team is expecting to do this on Saturday morning, 2/10 at 10am. The work is being done by two DVC professors. Planning Commission hearing to review the Alamo Summit project will be held, Wednesday, February 14 th at 7:00 P.M. at 30 Muir Road in Martinez. It s requested that a member of the MAC attend to reiterate the comments formally recommended by the MAC, however, staff is prepared should no one be able to attend. B. San Ramon Valley Fire Protection District Deputy Chief, Derek Krause noted that the station has ordered five new ambulances. The old Station 32 site is not up for sale at this point in time and is being held as reserve property by the Fire District for the time being. The Fire District, by vote of the Board of Supervisors, has one year to verify their 201 rights as authorized by LEMSA, the Citywide agency that services emergency vehicles. 3. PUBLIC COMMENT (3 minutes/speaker) Pursuant to the Brown Act, this time is provided for members of the public and community groups to address the committee on matters within the committee s jurisdiction and not on the agenda. An opportunity will be provided as part of each agenda item for public comment on the item. Time allowed for each individual is three minutes. The Chair will recognize only those speakers who have filled out and turned in a speaker card. 4. PRESENTATIONS 5. NEW BUSINESS A. Review and consider possible regulations to cannabis in unincorporated Contra Costa County, as presented by Ruben Hernandez, Principal Planner to DCD. Public Comment:

Mike Gibson, AIA Patty Hoyt, ADAPT Lupe Schoenberger The Alamo MAC made a series of motions based on the proposed Cannabis Framework provided by County DCD Staff. Please note those motions below as they relate to cannabis in the unincorporated areas of the County. 1.Buffer Zones: Member Struthers moved to recommend the cannabis maps show 600-foot buffers from residential zoning districts along with 1000 foot buffers from schools, community parks/playgrounds, and all other areas as proposed in the principals framework. Seconded by Member DeFerrari. 2. Potential Cap on Number of Permits: Member Deferrari moved to recommend and/or restrict the number of permits issued related to the establishment of safe, orderly and accessible cannabis businesses. Seconded by Member Struthers. 3. Outdoor Personal Use Cultivation: Member Rock moved to recommend not to allow outdoor grows in the unincorporated areas of Alamo. Seconded by Member Mick. Yays: Rock, Mick Nays: Barclay, Struthers, DeFerrari, Johnson, Bhandari Abstentions: Carter MOTION DID NOT PASS 4. Cultivation: Member DeFerrari moved to recommend that regulations on the establishment of indoor or outdoor personal cultivation be limited to three (3) plants whether indoor or outdoor with a suggested 20 setback from all property line(s) and that no plants are visible from either public right-of-way or neighboring adjacent parcel. Absolutely no front yard grows are to be established anywhere on the property. Seconded by Member Struthers. 5. Specific Safeguards to be Considered: Member Barclay moved to recommend the following safeguards be considered for inclusion in the County s cannabis regulations: * Consider limiting the sale of edible cannabis products to those where dosing is a max. of 10mg THC/dose and packaged as a single dose. Consumers would be allowed to purchase up to the limit allowed in state law. * Prohibit sale of flavored leaf and bud. * Consistent with recent legislation in CO, consider prohibiting the sale of edible products that mimic the shape and appearance of animals, humans, or fruit, including gummy bears. * Prohibit the sale of flavored e-juices. * Prohibit all self-service vending of all cannabis and products which contain cannabis. Motion was seconded by Member Struthers. 6. Land Use Permit Process: Member Barclay moved to recommend adherence to a County Land Use Process that is discretionary and remain that way for all cannabis applications within the unincorporated areas of the County. Seconded by Member Rock.

7. Public Health Safeguards: Member DeFerrari motioned to recommend No Smoking of cannabis in all public venues and to restrict the use of cannabis and smoking of cannabis in multi-unit housing. Currently, the County has a second-hand smoke ordinance that bans the smoking of cannabis products in the unincorporated areas of the County in all of the same places as tobacco. This is to be strictly enforced. Seconded by Member Struthers. 8. Delivery of Nonmedical Cannabis and Cannabis Products in Alamo: Member Rock recommended that all delivery of nonmedical cannabis and cannabis products in Alamo be prohibited. Motion received a second by Member Mick. ** Lastly, the Alamo MAC did request that the DRAFT Ordinance Regulating Cannabis in the Unincorporated Area of Contra Costa County be recirculated back before them prior to a decision being made by the Board of Supervisors if at all possible. B. Development plan application #DP17-3004. The applicant requests a Development Plan modification to modify County File #DP16-3052, to install an illuminated sign for a multi-family apartment complex on an existing wall. Site address is 2 Appletree Ct. in Alamo. Public Comment: Mike Gibson, AIA Motion to recommend APPROVAL by Member DeFerrari with a second from Member Barclay. Ayes: Rock, DeFerrari, Barclay, Struthers, Bhandari, and Johnson. Nays: Mick MOTION PASSES 6. OLD BUSINESS Downtown Alamo Roundabout Update The field surveys are completed and the 35% drawings will be ready for review at month end. Staff will coordinate a subcommittee meeting at that time. PW design staff also met with members of Bike East Bay to get their thoughts on downtown design and how to best integrate bicyclists concerns and integrate their concepts. 7. CONSENT CALENDAR All matters listed under CONSENT CALENDAR are considered by the Alamo MAC to be routine and will be enacted by one motion. There will be no separate discussion of these items unless requested by a member of the Alamo MAC or a member of the public prior to the time the Alamo MAC votes on the motion to adopt. A. Approve January 2nd, 2018 Record of Actions. The MAC recommended approval of the January 2 nd ROA s with a motion by Member Struthers and a second by Member DeFerrari. Ayes: Rock, Mick, DeFerrari, Barclay, Struthers, Bhandari, and Johnson. Nays: None MOTION PASSES SUBCOMMITTEE REPORTS - *Updates provided when available* Alamo AOB Subcommittee for Schools: Mick & Rock - Member Rock commented on the schools and their Kindness Matters initiative this week. Construction at Stone Valley Middle School is also going well. Alamo AOB Subcommittee for Downtown: Rock & Barclay - Staff to schedule subcommittee meeting with PW at end of February to review 35% drawings. Alamo Police Services Advisory Committee: Johnson - P2 will continue to support crossing guard at Rancho Romero for one more year. P2 is also looking the possible increase of the downtown P2 tax to assist with increase of police services and coverage. Land Use Planning Subcommittee: Barclay, DeFerrari & Bhandari - None. Parks and Recreation subcommittee: Barclay, Mick & Rock - Movies have been selected for the 2018 summer movie series; Coco and Despicable Me 3 will be show at Livorna Park. Hap Magee Dog Park Subcommittee: Johnson - None.
