Notice inviting tender for rate contract for supply of electrical items PHL invites sealed quotations from established, reputed and experienced firms to supply of electrical items at PHL Campus, S.V road vile Parle west Mumbai -400056. Details of the electrical items to be supplied are enclosed in the Annexure I. SCOPE OF WORK: The selected Agency/Firm shall be responsible to supply of electrical items in the office, premises locations of PHL MUMBAI-56. Validity of the contract: The contract for providing electrical items will be valid for a period of one year. The contract can be extended further with the mutual consent of both the parties on the same rates, terms and condition. PHL, however, reserves the right to terminate the contract by giving 15 days notice and without assigning any reason thereof. 1. The offers should be submitted in two bid systems with one sealed envelope containing complete detail, qualification, experience and other parameter of the bidder excluding the financial aspect and the other sealed envelope should contain only the quotation for the rates. These envelopes should be submitted with words Technical Bid and Financial bid separately. Both the envelope should be contained in a large envelope subscribed Electrical items on receipt of the offers, initially the technical bid of all the supplier will be examined and short listed. 2. Financial bid of only those suppliers will be open who meet the requirement specified under the technical bid. 3. The rate quoted shall be applicable for one year from the tender approval date and no escalation shall be given on any item. The supplier is bound to supply the material on the rates quoted in the financial bid for one year from the date of conclusion of rate contract. However in case of major fluctuation in the rates of the quoted items,the party can submit the request for the same, but the decision of the GM(WR) shall be final in this case and shall be acceptable to the party. The PHL can award best tender to the supplier who has quoted lowest figure for that particular item. 4. Envelope No.1(Technical bid) License of registration of firm issue by concern authority. Envelope No.2 (Financial bid) Price quoted by the tender shall be including of all levies, taxes or charges as may be applicable. No escalation in price would be permitted on any ground. No Commercial or technical condition or qualification of any sort shall be indicated in is envelope otherwise the offers shall be summarily rejected. 6. Earnest money deposit of Rs15,000/-(Fifteen thousand only)must accompany the bid (Envelope No.1)through demand draft in favor of Pawan hans ltd Payable at Mumbai otherwise it shall be rejected. It will be returned within one month to unsuccessful terderes.emd of tendering firms who submit the sealed quotations but withdraw the same before expiry of the tender validity date may be forfeited at the discretion of PHL. 7. PHL reserve the right to accept or reject any or all offers without assigning any reason thereof for which no claim shall be entertained.
8. The PHL resumes the right to conclude more than one rate contract for the same items. 9. Rate contract will be approved as per lowest price of each line. 10. Performance Security: (a) The successful bidder shall be required to deposit an amount equal to 10% of the contract value within 30 days of issue of letter of intent, as Performance Security. (b) Performance security shall be submitted in the form of DD drawn in favor of Pawan hans ltd and shall be valid for a period of 18 months. (c) Performance Security will be discharged after completion of contractor s performance obligations including warranty obligations under the contract. (d) If the contractor fails or neglects any of his obligations under the contract, PHL reserve the right to forfeit either whole or any part of Performance security furnished by the bidder as penalty for such failure. 11. Payment: Payment to the selected agency shall be released on monthly basis. 12. TDS and any other Government levies applicable shall be deducted on bill amount as per Government of India instructions issued from time to time. 13. PHL reserves the right to accept or reject any or all the Tenders. 14. PHL reserves the right to cancel the Contract any time without assigning any reason. 15. Liquidated Damages -Time and date of delivery of the Items shall be the essence of the Contract. Should the contractor fail to deliver the items within the stipulated period for such delivery or dispatch the purchaser shall be entitled to withhold payment until the whole off the items have been supplied. After expiry of delivery date, LD will be recovered @ 0.5% (half percent) of the price of any item which the contractor has failed to deliver or dispatch aforesaid for each and every week or part of a week subject to maximum 10% of the contract value. 16. SSI Registered with NSIC shall be exempted from, payment of earnest money/security deposit Tender Fee. Tenderers seeking exemption should enclose a photocopy of valid registration certificate with NSIC 17 ARBITRATION. In case of any dispute arising out of interpretation of specifications or any terms and conditions including special conditions of contract or arising during the execution of the work/contract, shall be referred to a sole arbitrator for adjudication through arbitration. The arbitration shall be conducted in accordance with the provisions of Arbitration & Conciliation Act, 1996 or any statutory modification or re-enactment thereof and the rules made there under and for the time being in force shall apply to the arbitration proceedings. The Chairman cum Managing Director, Pawan Hans Ltd. shall preferably nominate the arbitrator.
