The facts supporting this belief are as follows: Victims D.D. (driver), B.B., A.H. and J.N. were driving southbound on Highway 55 near 3200 block of South Broadway. They saw defendant driving a Dodge Dynasty and he was weaving and swerving. They attempted to pass defendant and defendant pointed a.38 Special revolver at them. The victims slowed their vehicle, however, defendant also slowed his vehicle. Defendant pointed the.38 Special revolver at them and squeezed the trigger twice. All four victims heard two clicks. Victim D.D. then stopped his car and defendant also stopped his car. At that time, D.D. fearing for his life, made a u-turn on Highway 55 and drove northbound in the southbound lanes. Defendant continued south on Highway 55 to the Loughborough exit. Defendant then drove south on highway 55 to the Germania exit. Defendant stopped his car on a median. Victim K.M. was driving on Germania and stopped his car to offer defendant assistance. Defendant then pointed his.38 Special revolver at K.M. and said I m gonna fucking kill somebody tonight. K.M. drove away. Defendant was arrested in St. Louis County with the.38 Special in his vehicle. I interviewed defendant. I observed that defendant s eyes were bloodshot and glassy and were slow to react to light. He had an odor of alcoholic beverage on his breath. Defendant had an uncertain gait and swayed while standing. 530372 4/4/12
