126th Meeting of State Level Expert Appraisal Committee -1 held on 29th & 30th April, 2016 g) There will be a public hearing and the views of all stake holders shall be taken and documented in the EIA Report. The Committee after detailed discussion decided to approve ToR subject to the above observations (a-g). Item no. 9 M/s. Challa Chlorides Private Limited Proposed Bulk Drugs & Intermediates & Chemicals Mfg.Unit,Plot No.F-2,MIDC, Chincholi, Solapur Previous consideration: The 99th Meeting held on 8th & 9th April, 2015 Decision: The Committee observed that the project is situated at the distance of 1.46 km from the nearest village in the Great Indian Bustard Sanctuary, Akolakati. The Committee also observed that the Ecological Sensitive Zone (ESZ) of GIB has not yet been identified by the MoEF. In the absence of a clear cut definition of ESZ, the Supreme Court's directions have to be observed. The Supreme Court in its order dated 4.2.2006 has directed that the distance of 10 kms. From the boundary of the protected area should be considered as ESZ in the absence of any concrete clear notification for the buffer zone. In the light of these directions the Committee decided to delist the proposal, which now falls in the Category A to be considered by Central EAC, MoEF for grant of EC. Previous consideration: The 125th Meeting held on 12th & 13th April, 2016 Decision: In the 99th meeting the Committee was informed that the project was situated at the distance of 1.46 km from the nearest village in the Great Indian Bustard Sanctuary, Akolakati. On the basis of this information the Committee had directed the PP to approach Central EAC since the project was required to be considered as Category A by virtue of OM S. 0. 1599 (E) of MoEF dated 25`h June, 2014 and accordingly the PP approached the Central EAC which approved the ToR vide letter dated 29th Sept. 2014. The said approved letter in para '4' mentioned as follows: -You are requested to kindly submit the final EIA/EMP prepared as per ToRs and incorporating all the issues raised during Public Hearing/ Public Consultation to the Maharashtra Pollution Control Board for consideration by SEIAA, Maharashtra since the project falls under Category 'B' in context of Ministry's Notification S.0 1599 (E) dated 25th June, 2014, regarding distance of 5km of the project from wildlife/eco-sensitive zone, critically polluted area etc. for consideration the proposal for environmental clearance within 2 years as per the MoEF O.M. No. J-11013/41/2006-IA.II (I) dated 22'wl March, 2010. The ToR is valid for a period of 2 years from the date of issue." In the light of the above aversions of MoEF&CC, the Committee decided to consider the case under Category 'B' and take up the appraisal of EIA report. However, as a matter of abundant precaution, the MPCB should verify the location of the project with reference to the boundary of Great Indian Bustard Sanctuary before granting Consent to Operate. The PP submitted a letter saying that the consultant who has prepared the EIA report M/s. Equinox Environments Pvt. Ltd. has been replaced by M/s. Green Circle. Further he submitted that the M/s. Green Circle are competent to present the EIA Report by High Court Gujarat Order dated 5.4.2016. Notwithstanding the above aversions the PP himself proceeded to make the presentation before the Committee. Page 24 of 35 Member Secretary Chat an
126th Meeting of State Level Expert Appraisal Committee - 1 held on 29th & 30th April, 2016 The PP gave a detailed presentation of their project of manufacturing of Bulk Drugs and Intermediates to the extent of 130.9 MT/M. The PP gave a detailed presentation for EIA report. After detailed discussion the Committee made the following observations: 1. The PP envisages manufacturing of 130.9 MT/M of Bulk drugs and Intermediates. Detailed analysis of all the processes, bulk drugs generated, effluent management, hazardous waste management and treatability studies shall be done by competent authority. Hazardous waste management studies shall be done in particular with regard to disposal of Chromium found in the effluent, which shall be disposed in safe manner so as to ensure that Cr' molecules present, if any, are completely neutralized. The disposal of by-products Sodium Sulphate, Chromic Sulphate and Aluminium Hydroxide shall be done in such manner that contamination with outside environment is avoided. The Risk Assessment should be carried out afresh to address all the possible risks while handling hazardous waste. 2. One more gate shall be provided on Southern side for easy evacuation. 1920 sq.m should be made available for parking. 3. Coal fired boiler of capacity 2TPH is proposed to be used. The emissions from the boiler shall be subjected to bag filters and stack of height 30m to achieve a TPM of less than 100 mg/nm3. 4. Rain water harvesting shall be effected by storing 1277.43 m3 of water. 5. Minimum 95% solvent recovery shall be achieved. 6. STP of 3.5 CMD shall be constructed for the treatment of domestic waste water. Baseline studies were presented which shows that the impact due to project shall be within limits. For the compliance of issues raised in point no. 1, the item is deferred. The Committee again considered the proposal in the 126th meeting. The Committee noted that the Deputy Conservator vide his letter dated 27.4.2016 addressed to the Member Secretary, SEAC 1 [copy enclosed as Annexure 9.1] had clarified that plot no. F-2 MIDC Chincholi was located within 5km of the Great Indian Bustard Wild life Sanctuary. Therefore the project has to be considered as Category 'A' for grant of EC vide Notification of MoEF dated 25.6.2014. This may be informed to Central EAC in the context of its letter dated 29' Sept. 2014 and seek clarification thereon.
