Regular City Council Meeting Minutes November 28, 2017 MINUTES OF THE CITY COUNCIL OF THE CITY OF FONTANA REGULAR CITY COUNCIL MEETING November 28, 2017 WORKSHOP: A. 5:30 P.M. Workshop A City Council Workshop was held on November 28, 2017, in the City Hall Executive Conference Room at 8353 Sierra Avenue, Fontana, California. Mayor Warren called the Workshop to order at 5:31 p.m., with Mayor Pro Tem Sandoval, Council Members Roberts, Tahan, and Armendarez present. The City Council Regular Meeting Agenda was reviewed and City Manager comments were heard. Community Services staff gave updates on the upcoming holiday events. Police Chief Ramsey gave an update on No Shave November. Public Works Director Chuck Hays gave an update on the Amphitheater project. Engineering Manager Castillo gave an update on the Sierra Avenue and Juniper Avenue sidewalk project. Assistant to the City Manager Amy Colbrunn gave an update on grants the City has received. Discussion ensued about parking issues at the Metrolink station and the possibility of a parking structure in the downtown area. The City Council Workshop adjourned at 6:02 p.m. CLOSED SESSION: A. 6:00 P.M. Call the Meeting to Order The Regular Meeting of the Fontana City Council was held on Tuesday, November 28, 2017, in the Grover W. Taylor Council Chambers at 8353 Sierra Avenue, Fontana, California. Mayor Warren called the meeting to order at 7:02 p.m. ROLL CALL: Present: Mayor Warren, Mayor Pro Tem Sandoval, Council Members Roberts, Tahan and Armendarez. Absent: None. INNVOCATION/PLEDGE OF ALLEGIANCE: Following the Invocation by Council Member Roberts, the Pledge of Allegiance was led by Council Member Armendarez. CLOSED SESSION ANNOUNCEMENT: City Attorney Jeff Ballinger reported that there was no reportable action on the Closed Session Items. SPECIAL PRESENTATIONS: A. Police Department September 2017 Employees of the Month Mayor Warren and City Council recognized the Bike Unit and the Fugitive Apprehension Team as the Police Department's September 2017 Employees of the Month. Chief Ramsey highlighted their accomplishments. All members of the Bike Unit were present to accept. PUBLIC COMMUNICATIONS: A. Public Communications Christopher Apollon spoke on the Red Cross Blood Drive to be held on December 15, City Council Meeting Minutes November 28, 2017 Page 2 of 6

2017, at the United States Army Recruiting Center at 16761 Valley Blvd., Fontana, California. Joanna Valenzuela announced that Assembly Member Freddie Rodriguez is hosting a Holiday Open House and Toy Drive, on Saturday, December 2, 2017, at 13160 Second Street, Chino, California. Leon Ford requested donations for travel expenses for the Fontana Pop Warner team that is going to the Super Bowl. Rich Guerrero invited the community to a barbeque fundraiser for the fight against pancreatic cancer on Thursday, November 30, 2017, at the Fontana Police Department. Bishop Emory James announced the Martin Luther King Jr. 2018 Celebration will be held on January 18, 2018, at Mountain View Church. Joseph Ferrell spoke on behalf of the Ronald McDonald House Inland Empire and asked for the City s support to hold the Ronald McDonald House Walk in Fontana. Priscilla Rocha spoke on the services provided to her family by the Ronald McDonald House Inland Empire. CONSENT CALENDAR: ACTION: Motion was made by Council Member Tahan, seconded by Council Member Sandoval, and passed unanimously by a vote of 5-0 to approve Consent Calendar Items "A-E" with the exception of Item "C", that was pulled and will be brought back at a later Council Meeting. (AYES: Warren, Sandoval, Roberts, Tahan, and Armendarez: NOES: None) as follows: A. Approval of Minutes Approve the Minutes of the November 14, 2017 Regular City Council Meeting. B. Approve a Cooperative Agreement with the City of Rialto for Construction of the Pacific Electric Bike Trail at Maple Avenue Pedestrian Signal Project 1. Approve and authorize the City Manager to execute a Cooperative Agreement for construction of Project No. 3340 - Pacific Electric Trail at Maple Pedestrian Signal and authorize the City Manager to take all actions necessary to implement the agreement. 2. Accept outside Agency contribution of $117,500.00 for Project No. 3340 Pacific Electric Trail at Maple Pedestrian Signal. C. Award Bid for Enterprise Resource Planning (ERP) System SP-01-IT-18 Award bid (SP-01-IT-18) and authorize the City Manager to enter into a five-year contract with Tyler Technologies Inc. to provide the City with Enterprise Resource Planning (ERP) System Software and Support at a cost of $1,832,852.00, plus contingency of $192,000.00 and five years of Support and Maintenance costs at $701,138 annually renewable at the City's discretion thereafter for a not to exceed contract total of $5,530,542.00. D. Award of Contract for Fuel Station and Garage Parts, Maintenance and Repair Services SB-09-PW-18 Award Bid and authorize the City Manager to enter into a contract with Fuel Equipment Services Inc. DBA FUEL SERV for Fuel Station and Garage Parts, Maintenance and Repair Services for a period of two (2) years, renewable for three (3) one (1) year increments at the City's sole discretion. E. Co-Sponsorships for Fiscal Year 2017/18 Review and approve the five (5) Co-Sponsorships recommended for Fiscal Year July 1, 2017 June 30, 2018 for an additional funding amount of $15,741 as recommended by the Parks and Community Services Commission. PUBLIC HEARINGS: A. Appeal No. 17-001 - Citrus Shopping Center Located at the Northeast Corner of Baseline Avenue and Citrus Avenue Mayor Warren opened Public Hearing Item PH-A. Associate Planner Brett Hamilton provided the staff report. No one spoke in favor or opposition. The Public Hearing was closed. ACTION: Motion was made by Council Member Armendarez, seconded by Council Member Tahan, and passed unanimously by a vote of 5-0 to approve Consent Calendar Item "PH-A. (AYES: Warren, Sandoval, Roberts, Tahan, and Armendarez: NOES: None) as follows: Deny Appeal No. 17-001, upholding the Planning Commission s decision on September 19, 2017, determining the project is exempt pursuant to Section 15332 Class 32 (Infill Development) of the California Environmental Quality Act (CEQA) and approving Tentative Parcel Map No. 19805 (TPM No. 16-013) Conditional Use Permit No. 16-031, Conditional Use Permit No. 16-032 and Administrative Site Plan No. 16-052 for a new shopping center and gas station to be located at the northeast corner of Baseline Avenue and Citrus Avenue. ELECTED OFFICIALS COMMUNICATIONS/REPORTS: A. Elected Officials Communications/Reports City Treasurer Koehler-Brooks congratulated the police officers that were honored tonight. City Treasurer Koehler-Brooks spoke on the Above the Limits program great events they always have. and the City Council Meeting Minutes November 28, 2017 Page 4 of 6

City Clerk Lewis commended and congratulated the Fontana Police Department for always doing a great job. Council Member Tahan commended the Fontana Police Department for all their hard work and the sacrifices they give by being away from their families while working during the holidays. Council Member Tahan invited everyone to the Tree Lighting Ceremony at City Hall. Council Member Armendarez commended the Fontana Police Department for their hard work and dedication. Council Member Armendarez announced he attended the National League of Cities Conference in Charlotte, North Carolina. Mayor Pro Tem Sandoval thanked the Fire Department, Police Department, Public Works and Community Services for all their hard work. Council Member Roberts complimented the Fontana Police Department on the great work they do, especially for their concern for our veterans in the community. Council Member Roberts asked staff to contact Danny Marquez regarding the Military Banners as some of the banners are in disrepair. Council Member Roberts congratulated Mayor Warren for being selected as one of Inland Empire Magazine s 16 Most Valuable People of the Year in the Inland Empire. Mayor Warren thanked everyone for their generosity in providing Thanksgiving dinner to families in need. Mayor Warren spoke on the Fontana Rotary Club managing the Magic Lights event at the Speedway. Mayor Warren spoke on Center Stage Theater s holiday performances. Mayor Warren announced that Fontana resident and "The Voice" TV show contestant, Anthony Alexander, will be the Grand Marshall for the Annual Christmas Parade to be held on Saturday, December 9, 2017. Mayor Warren announced she attended the National League of Cities Conference in Charlotte, North Carolina. CITY MANAGER COMMUNICATIONS: A. City Manager Communications City Manager Ken Hunt spoke on adjourning tonight s meeting to a Joint City Council Meeting with the Planning Commission on Monday, December 4, 2017, at 5:00 to review the General Plan. Described below are the terms and conditions for providing to you such notices and disclosures electronically through your DocuSign, Inc. (DocuSign) Express user account. Please read the information below carefully and thoroughly, and if you can access this information electronically to your satisfaction and agree to these terms and conditions, please confirm your agreement by clicking the 'I agree' button at the bottom of this document. Getting paper copies At any time, you may request from us a paper copy of any record provided or made available electronically to you by us. For such copies, as long as you are an authorized user of the DocuSign system you will have the ability to download and print any documents we send to you through your DocuSign user account for a limited period of time (usually 30 days) after such documents are first sent to you. After such time, if you wish for us to send you paper copies of any such documents from our office to you, you will be charged a $0.00 per-page fee. You may request delivery of such paper copies from us by following the procedure described below. Withdrawing your consent If you decide to receive notices and disclosures from us electronically, you may at any time change your mind and tell us that thereafter you want to receive required notices and disclosures only in paper format. How you must inform us of your decision to receive future notices and disclosure in paper format and withdraw your consent to receive notices and disclosures electronically is described below. Consequences of changing your mind If you elect to receive required notices and disclosures only in paper format, it will slow the speed at which we can complete certain steps in transactions with you and delivering services to you because we will need first to send the required notices or disclosures to you in paper format, and then wait until we receive back from you your acknowledgment of your receipt of such paper notices or disclosures. To indicate to us that you are changing your mind, you must withdraw your consent using the DocuSign 'Withdraw Consent' form on the signing page of your DocuSign account. This will indicate to us that you have withdrawn your consent to receive required notices and disclosures electronically from us and you will no longer be able to use your DocuSign Express user account to receive required notices and consents electronically from us or to sign electronically documents from us. All notices and disclosures will be sent to you electronically Unless you tell us otherwise in accordance with the procedures described herein, we will provide electronically to you through your DocuSign user account all required notices, disclosures, authorizations, acknowledgements, and other documents that are required to be provided or made available to you during the course of our relationship with you. To reduce the chance of you inadvertently not receiving any notice or disclosure, we prefer to provide all of the required notices and disclosures to you by the same method and to the same address that you have given us. Thus, you can receive all the disclosures and notices electronically or in paper format through the paper mail delivery system. If you do not agree with this process, please let us know as described below. Please also see the paragraph immediately above that describes the consequences of your electing not to receive delivery of the notices and disclosures electronically from us.

How to contact City of Fontana: You may contact us to let us know of your changes as to how we may contact you electronically, to request paper copies of certain information from us, and to withdraw your prior consent to receive notices and disclosures electronically as follows: To contact us by email send messages to: ctejeda@fontana.org To advise City of Fontana of your new e-mail address To let us know of a change in your e-mail address where we should send notices and disclosures electronically to you, you must send an email message to us at ctejeda@fontana.org and in the body of such request you must state: your previous e-mail address, your new e-mail address. We do not require any other information from you to change your email address.. In addition, you must notify DocuSign, Inc to arrange for your new email address to be reflected in your DocuSign account by following the process for changing e-mail in DocuSign. To request paper copies from City of Fontana To request delivery from us of paper copies of the notices and disclosures previously provided by us to you electronically, you must send us an e-mail to ctejeda@fontana.org and in the body of such request you must state your e-mail address, full name, US Postal address, and telephone number. We will bill you for any fees at that time, if any. To withdraw your consent with City of Fontana To inform us that you no longer want to receive future notices and disclosures in electronic format you may: i. decline to sign a document from within your DocuSign account, and on the subsequent page, select the check-box indicating you wish to withdraw your consent, or you may; ii. send us an e-mail to ctejeda@fontana.org and in the body of such request you must state your e-mail, full name, IS Postal Address, telephone number, and account number. We do not need any other information from you to withdraw consent.. The consequences of your withdrawing consent for online documents will be that transactions may take a longer time to process.. If these requirements change, we will provide you with an email message at the email address we have on file for you at that time providing you with the revised hardware and software requirements, at which time you will have the right to withdraw your consent.

Acknowledging your access and consent to receive materials electronically To confirm to us that you can access this information electronically, which will be similar to other electronic notices and disclosures that we will provide to you, please verify that you were able to read this electronic disclosure and that you also were able to print on paper or electronically save this page for your future reference and access or that you were able to e-mail this disclosure and consent to an address where you will be able to print on paper or save it for your future reference and access.
