HOUSE BILL organizing, supervising, financing, or managing a criminal gang; establishing penalties; requiring a certain sentence to be separate from and consecutive to a certain other sentence; providing that a certain provision of law may not be construed inconsistently with certain other provisions of law; making clarifying changes; and generally relating to criminal gangs. BY repealing and reenacting, with amendments, Article Criminal Law Section 0 and 0 Annotated Code of Maryland (00 Volume and 00 Supplement) BY adding to Article Criminal Law Section 0 and 0 Annotated Code of Maryland (00 Volume and 00 Supplement) SECTION. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, That the Laws of Maryland read as follows: Article Criminal Law 0. 0 (a) In this subtitle the following words have the meanings indicated. 0 (b) Coerce means to compel or attempt to compel another by threat of harm or other adverse consequences. (c) Criminal gang means a group or [ongoing] association of three or more persons whose members: () individually or collectively [engage in a pattern of criminal gang activity] COMMIT, ATTEMPT TO COMMIT, CONSPIRE TO COMMIT, OR SOLICIT TWO OR MORE UNDERLYING CRIMES, OR ACTS BY A JUVENILE THAT WOULD BE AN UNDERLYING CRIME IF COMMITTED BY AN ADULT, PROVIDED THE CRIMES OR ACTS WERE NOT PART OF THE SAME INCIDENT; () have as one of their primary objectives or activities the commission of one or more underlying crimes, including acts by juveniles that would be underlying crimes if committed by adults; and () have in common: (I) an identifying sign, symbol, name, leader, or purpose;

HOUSE BILL STRUCTURE; (II) AN OVERT OR COVERT ORGANIZATIONAL OR COMMAND (III) A DE FACTO CLAIM OF TERRITORY OR JURISDICTION; (IV) AN INITIATION RITUAL; OR (V) A METHOD OF OPERATION OR CRIMINAL ENTERPRISE. 0 [(d) Pattern of criminal gang activity means the commission of, attempted commission of, conspiracy to commit, or solicitation of two or more underlying crimes or acts by a juvenile that would be an underlying crime if committed by an adult, provided the crimes or acts were not part of the same incident.] (D) CRIMINAL GANG MEMBER MEANS A PERSON WHOSE CRIMINAL GANG MEMBERSHIP IS PROVEN BY AT LEAST TWO OF THE FOLLOWING: () SELF PROCLAMATION; () USE OF A CRIMINAL GANG S IDENTIFYING SIGN, SYMBOL, NAME, OR ANY OTHER MEANS OF RECOGNITION; () ASSOCIATION WITH KNOWN CRIMINAL GANG MEMBERS AND: (I) DEMONSTRATED ASPIRATION TO BECOME A CRIMINAL GANG MEMBER BY ADOPTION OF THE CRIMINAL GANG S STYLE OF DRESS, TATTOOS, HAND SIGNALS, OR SYMBOLS; OR (II) PARTICIPATION IN CRIMINAL GANG ACTIVITIES, INCLUDING ATTENDING CRIMINAL GANG MEETINGS; () IDENTIFICATION AS A CRIMINAL GANG MEMBER THROUGH ASSESSMENT AND VERIFICATION WHILE IN THE CUSTODY OF THE DEPARTMENT OF PUBLIC SAFETY AND CORRECTIONAL SERVICES; OR () PHYSICAL EVIDENCE INCLUDING PHOTOGRAPHS OR WRITTEN OR ELECTRONIC CORRESPONDENCE. (e) (f) Solicit has the meaning stated in 0 of this article. Underlying crime means: () a crime of violence as defined under of this article;

HOUSE BILL () A VIOLATION OF 0 (SECOND DEGREE ASSAULT), 0 (EXTORTION), (DANGEROUS WEAPONS), 0 (WEARING, CARRYING, OR TRANSPORTING A HANDGUN), 0 (MALICIOUS DESTRUCTION), 0 (INDUCING FALSE TESTIMONY OR AVOIDANCE OF SUBPOENA), 0 (RETALIATION FOR TESTIMONY), 0 (INTIMIDATING OR CORRUPTING JUROR), 0 (HUMAN TRAFFICKING), 0 (RECEIVING EARNINGS OF PROSTITUTE), OR 0(A)(), (), OR () (HOUSE OF PROSTITUTION), OR (GAMBLING) OF THIS ARTICLE; [()] () a felony violation of [ 0, 0,] 0 (EXTORTION), 0 (MANUFACTURE OR POSSESSION OF DESTRUCTIVE DEVICE), 0 (DISTRIBUTION OF CDS), 0 (MANUFACTURING CDS OR EQUIPMENT), (SECOND DEGREE ARSON), (ATTEMPT TO BURN STRUCTURE OR PROPERTY), 0 (FIRST DEGREE BURGLARY), 0 (SECOND DEGREE BURGLARY), 0 (THIRD DEGREE BURGLARY), (THEFT), OR [, 0, 0, or 0](UNAUTHORIZED USE OF A MOTOR VEHICLE) of this article; or 0 Article. 0. (a) [()] () a [felony] violation of (B) OR (C) of the Public Safety A person may not[: 0 ()] ACTIVELY participate in a criminal gang [knowing that the members of the gang engage in an ongoing A pattern of criminal gang activity; and () knowingly] and willfully direct or participate in the commission of an underlying crime, or act by a juvenile that would be an underlying crime if committed by an adult, committed for the benefit of, at the direction of, or in association with a criminal gang. (b) A person may not commit a violation of VIOLATE subsection (a) of this section involving the commission of an underlying crime that results in the death of a victim. (c) () (i) Except as provided in subparagraph (ii) of this paragraph, a person who violates this section is guilty of a felony and on conviction is subject to imprisonment not exceeding years or a fine not exceeding $0,000 or both. (ii) A person who violates subsection (b) of this section is guilty of a felony and on conviction is subject to imprisonment not exceeding 0 years or a fine not exceeding $0,000 or both.

HOUSE BILL () (I) A sentence imposed under PARAGRAPH ()(I) OF THIS SUBSECTION this section FOR A FIRST OFFENSE [may] SHALL be separate from and consecutive to [or concurrent with] a sentence for any crime based on the act establishing a violation of this section. (II) A SENTENCE IMPOSED UNDER PARAGRAPH ()(I) OF THIS SUBSECTION FOR A SECOND OR SUBSEQUENT OFFENSE, OR PARAGRAPH ()(II) OF THIS SUBSECTION SHALL BE SEPARATE FROM AND CONSECUTIVE TO A SENTENCE FOR ANY CRIME BASED ON THE ACT ESTABLISHING A VIOLATION OF THIS SECTION. (III) A CONSECUTIVE SENTENCE FOR A SECOND OR SUBSEQUENT OFFENSE SHALL NOT BE MANDATORY UNLESS THE STATE NOTIFIES THE PERSON IN WRITING OF THE STATE S INTENTION TO PROCEED AGAINST THE PERSON AS A SECOND OR SUBSEQUENT OFFENDER AT LEAST 0 DAYS BEFORE TRIAL. (d) A person may be charged with a violation of this section only by indictment, criminal information, or petition alleging a delinquent act. (e) () The Attorney General, at the request of the State s Attorney for a county in which a violation or an act establishing a violation of this section occurs, may: 0 (i) (ii) aid in the investigation of the violation or act; and prosecute the violation or act. 0 () In exercising authority under paragraph () of this subsection, the Attorney General has all the powers and duties of a State s Attorney, including the use of the grand jury in the county, to prosecute the violation. () Notwithstanding any other provision of law, in circumstances in which violations of this section are alleged to have been committed in more than one county, the respective State s Attorney of each county, or the Attorney General, may join the causes of action in a single complaint with the consent of each State s Attorney having jurisdiction over an offense sought to be joined. (f) Notwithstanding any other provision of law and provided at least one criminal gang activity of a criminal gang allegedly occurred in the county in which a grand jury is sitting, the grand jury may issue subpoenas, summon witnesses, and otherwise conduct an investigation of the alleged criminal gang s activities and offenses in other counties. 0.

HOUSE BILL (A) A PERSON MAY NOT ORGANIZE, SUPERVISE, FINANCE, OR MANAGE A CRIMINAL GANG. (B) A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A FELONY AND ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 0 YEARS OR A FINE NOT EXCEEDING $0,000 OR BOTH. (C) A SENTENCE IMPOSED UNDER THIS SECTION SHALL BE SEPARATE FROM AND CONSECUTIVE TO A SENTENCE FOR ANY CRIME BASED ON THE ACT ESTABLISHING A VIOLATION OF THIS SECTION. 0. NOTHING IN THIS SUBTITLE MAY BE CONSTRUED INCONSISTENTLY WITH THE PROVISIONS RELATING TO JURISDICTION OVER JUVENILE CAUSES CONTAINED IN TITLE, SUBTITLE A OF THE COURTS ARTICLE. SECTION.
