POST AGENDA PIKE COUNTY BOARD OF COMMISSIONERS REGULAR MONTHLY MEETING 9:00 a.m. Wednesday, August 9, 2017 The Pike County Board of Commissioners held its Regular Monthly Meeting on Wednesday, August 9, 2017 at 9:00 a.m. in the Courthouse, Main Courtroom, at 16001 Barnesville Street, Zebulon. Chairman Briar Johnson convened the meeting and Commissioners Tim Daniel, Tim Guy, Tommy Powers and James Jenkins attended. County Manager John Hanson, County Attorney Tom Morton and County Clerk Jo Ann Wrye were also present. (O.C.G.A. 50-14-1(e) (2)) 1. CALL TO ORDER... Chairman J. Briar Johnson 2. Employee recognition for service to Pike County Sibley Norton was recognized by County Manager Hanson and Sheriff Jimmy Thomas for his five years of service to Pike County. County Manager Hanson stated he has seen Officer Norton in action and is very professional, carries himself very well and does an excellent job for the Sheriff s Department. County Manager Hanson thanked Officer Norton for his 5-years of service to Pike County. Sheriff Jimmy Thomas stated Officer Norton started out in the Jail and does a fine job for the Sheriff s Department. Sheriff Thomas said Officer Norton is a lifetime resident of Pike County noting it is good to see you can return something to your own community. Sheriff Thomas said Officer Norton does a great job and thanked him for his service. Kevin Boyt was recognized by County Manager Hanson and Planning and Development Director, David Allen. County Manager Hanson thanked Kevin for his 10 years of service and stated he does an excellent job. He said Kevin does all the inspections in the county and is very fair and honest in his job. County Manager Hanson stated he has not received one call complaining about Kevin in the four years he has been County Manager. He thanked Kevin for his 10 years of service stating Kevin does a great job. Planning and Development Director, David Allen stated Kevin is a very hard worker and is super busy as well as helps out in the office too. He said Kevin is rarely out and has to make Kevin go home when he is sick. David thanked Kevin for his service and stated he does a great job. 7. REPORTS FROM COMMISSIONS, DEPARTMENTS, COMMITTEES, AUTHORITIES a. Monthly Reports submitted from County Departments and County Authorities, including a Revenue/Expenditure Statement for all departments and a summary check register. Motion/second by Commissioners Daniel/Guy to approve, motion carried 5-0. -1-

County Manager Comment County Manager Hanson reminded the Board of the upcoming Workshop scheduled for Thursday, August 17 th at 9:00 at the City of Zebulon Opportunity Center. The lane closure that was scheduled for Monday Wednesday of this week has been delayed until next week at the same time due to the rain. Georgia Military College will make an announcement this morning that they will be coming to Pike County; they will have classes at the City of Zebulon Opportunity Center. County Manger Hanson stated this will allow an individual to get an Associate s Degree in Pike County, they offer 24 different degrees. He said this is a great opportunity for those that cannot get into a major college. Georgia Military College is looking forward to working with Southern Crescent and Gordon College to serve the students in this area. Hanson stated this is exciting news for Pike County and the economy to have someone of this magnitude to have an interest and actually put something here in Zebulon. The announcement will be at 12:00 noon today at the City of Zebulon Opportunity Center. County Manager Hanson told the Board he has the paperwork available for the refinancing of the Water Authority loan, the Water Authority has expressed an interest in refinancing their loan. He said they will be able to fund the refinance in this budget year but next year there will need to be approximately $35,000 added to their budget in order to accelerate the loan to be paid off in 15 years in lieu of 40 years. This will allow for a significant savings. d. 9. NEW BUSINESS a. Consider one appointment to the Pike County Tax Assessor Board to fill a six-year term, set to expire August 31, 2023. Applicant has met criteria. Motion/second by Commissioners Guy/Daniel to reappoint Christopher Tea, motion carried 5-0. b. Consider one appointment to the J. Joel Edwards Public Library Board to fill a three-year term, set to expire August 31, 2020. Applicant has met criteria. No motion was made. c. PUBLIC HEARING: To receive public input regarding SE-17-05 Homer L. Gibbins Sr., property owner, and Homer L. Gibbins Jr., applicant, are requesting a special exception in an A-R zoned district to allow for a General Home Occupation (boxing lessons at home gym). The subject property is located adjacent to 1903 Harden Road, and has approximately 80 feet of frontage along the western side of Harden Road and approximately 894 feet of frontage along the northern side of Glover Road. The subject property is located in Land Lot 128 of the 8 th District of Pike County, Georgia. The property currently consists of 65.91acres and is further identified as Tax Map Parcel #090 007. David Allen, Planning and Development Director addressed the Board stating this came before the Board of Appeals on July 20, 2017. They recommended approval with conditions. Homer Gibbins, Jr. Homer Gibbins, Sr. Motion/second by Commissioners Powers/Daniel to approve with conditions, motion carried 5-0. Conditions are as follows: 1. The operating hours shall not be expanded from Monday, Tuesdays, and Thursdays from 6:00 to 9:00 pm without further approval by the Board of Appeals and Board of Commissioners. 2. The listed conditions and approval of same shall be tied to the current applicant and property owners and shall not be transferrable to any other future property owners. 3. No public parking shall occur on the shoulder or within the right-of-way of Harden Road. Access to the gym building shall be via Harden Road only and not Glover Road. 4. Any new signs shall comply with the County Sign Ordinance and shall only be located at the Harden Road entrance. d. PUBLIC HEARING: To receive public input regarding Approval / denial of the private maintenance covenant for a proposed private street, required per Code Section 155.02 (Y)(2). Also, approval / denial of the road name Oconostota Road for the proposed private street. The proposed street right-of-way will be located off of Harden Road, Land Lot 128 of the 8th Land District, and is further identified as Tax Map Parcel #090 007. David Allen, Planning and Development Director addressed the Board stating this is in regards to the same property owned by the Gibbins. Staff is recommending approval. David also noted that Mr. Buffington will be using this road and will need to be added to the maintenance covenant. -3-

Motion/second by Commissioner Powers/Daniel to approve Road Maintenance Agreement and road name change, motion carried 5-0. e. PUBLIC HEARING: To receive public input regarding SE-17-06 Steven H. Pierce, property owner, and Michael Pierce, applicant, are requesting a special exception in an A-R zoned district to allow for an annual, outdoor benefit concert on the subject property. The subject property, located off of Jonathans Roost Road, has approximately 1485 feet of frontage along the northern side of Jonathans Roost Road and approximately 2830 feet of frontage along the eastern side of Jonathans Roost Road. The property is located in Land Lot 123 of the 1 st District of Pike County, Georgia. The subject property consists of 97.78 acres and is further identified as Tax Map Parcel #049 003. David Allen, Planning and Development Director stated this came before the Board of Appeals on July 20, 2017 and they recommended approval with conditions. David advised the Board the applicant and owner found they could have this event at the Parks and Recreation grounds and will do that next year since it is too late to change the location at this point. They do not mind if the Board wants to approve for them to have it for one year and then next year find out what they need to do to have it at the Parks and Recreation grounds. Cory Dogue Terry Patterson Mike Pierce Fred Lacey (He was in opposition until concerns he had were answered) There was some discussion among the Board about approving the event for one or two years. Motion/second by Commissioners Jenkins/Daniel to approve the event for two years, motion carried 4-1 with Chairman Johnson opposing because of the two years. The conditions are as follows: 1. Adequate off-street parking shall be provided for the general public on the subject property. No parking associated with events shall occur on the road shoulders or rights-of-way. 2. The subject property is approved for only one charity concert / event (and associated children s activities) occurring on a single day out of every calendar year. Any additional frequency or duration of future events shall require further approval by the Board of Appeals and the Board of Commissioners. 3. This approval is good for a 24 month duration (from date of initial approval), after which it must be reviewed and approved again by the Board of Appeals and Board of Commissioners if it is to operate beyond the initial 24 month approval period. Any repeated violations of the approval conditions shall result in a rescission of the approval. 4. The concert / event shall be completely over by 12 am midnight (lights out). The gate shall open no earlier than 12 noon, and the music shall be completely stopped by 9 pm. 5. The serving of alcohol is prohibited at designated concert events on the subject property. 6. Litter removal must be completed within 3 days of the end of an event to not violate the County Litter Ordinance. -4-

7. Any use of porta-johns on the property must obtain necessary Health Department approval, and porta-john placement shall be coordinated with the Director of Planning and Development. 8. Prepared food for the event must be approved by the Health Department. 9. Approval of this special exception request shall be non-transferrable to any future property owners besides the current property owner and applicant. 10. Prior to commencement of the first concert event on the subject property, the applicant must document to Pike County, the establishment of a 501c3 or other nonprofit entity for proper disbursement of the scholarship money. 11. Traffic control devices shall be used, and a minimum of six County deputies shall be deployed. 12. The applicant shall work with Pike County on preparing Jonathans Roost Road for the event, and the roads shall be in identical or better condition after the event. 13. The applicant shall also coordinate with Pike County on providing a fire truck and ambulance on or near the property during the event. f. PUBLIC HEARING: To receive public input regarding Text amendment to Title XV, Land Usage, adding new Chapter 167, Ga. Highway 18, Ga. Highway 109, and Ga. Highway 362 Overlay Districts Ordinance, relative to establishing design standards for certain commercial, industrial, and institutional developments along these specified Highways. David Allen, Planning and Development Director addressed the Board stating this was brought before the Planning Commission on July 13, 2017 and they recommended approval with changes. There was discussion among the Board regarding square footage, materials, signs and certain types of businesses being restricted from Pike County such as adult entertainment, pawn shops, junkyard, and tattoo parlors. David Allen stated the Planning Commission wondered if the restrictions were too restrictive because it basically covers the whole county if approved. David Allen would like for the County Attorney to take a look at those restrictions before the 2 nd Reading. Motion/second by Commissioners Guy/Daniel to approve the 1 st Reading and for the County Attorney to review the restricted businesses listed in 167.06, motion carried 5-0. g. Approve/Deny Per Code Section 155.03(A), alterations to existing subdivision plat off of Old Madden Bridge Road. David Allen, Planning and Development Director addressed the Board regarding this issue. Motion/second by Commissioners Guy/Daniel to approve, motion carried 5-0. 10. PUBLIC COMMENT- (Limited to 5 minutes per person) None 11. EXECUTIVE SESSION - None 12. ADJOURNMENT Motion/second by Commissioners Powers/Guy to adjourn at 10:02 a.m., motion carried 5-0. -5-
