Public comment in support was received and now staff recommends that the Board waive the second reading and adopt the ordinance (Attachment A). r I L t U ORDINANCE NO. 1475 AN ORDINANCE OF THE YOLO COUNTY BOARD OF SUPERVISORS AUTHORIZING THE IMPLEMENTATION OF A COMMUNITY CHOICE AGGREGATION PROGRAM The Board of Supervisors of the County of Yolo, hereby ordains as follows: SECTION 1. PURPOSE The purpose of this Ordinance is to authorize the implementation of a community choice aggregation program through the Valley Clean Energy Alliance Joint Powers Authority, as required by California Public Utilities Code section 366.2(c)(12). SECTION 2. ADDITIONS TO TITLE 2 OF THE COUNTY CODE Chapter JO is hereby added to Title 2 of the County Code: Chapter 10: Community Choice Aggregation Sec. 2-10.01: Authorization to Implement a Community Choice Aggregation Program. In order to provide businesses and residents within unincorporated Yolo County with a choice of power providers, the County of Yolo hereby elects to implement a community choice aggregation program within the jurisdiction of unincorporated Yolo County by participating in the Community Choice Aggregation Program of the Valley Clean Energy Alliance, as described in its Joint Powers Agreement. SECTION 3. SEVERABILITY If any section, sub-section, sentence, clause, or phrase of this Ordinance is held by a court of competent jurisdiction to be invalid, such decision shall not affect the remaining portions this Ordinance. The Board of Supervisors hereby declares that it would have passed this Ordinance, and each section, sub-section, sentence, clause, and phrase hereof, irrespective of the fact that one or more sections, sub-sections, sentences, clauses, and phrases be declared invalid. SECTION 4. EFFECTIVE DATE This Ordinance shall take effect and be in force thirty (30) days following its adoption. Prior to expiration of fifteen (15) days after its passage of this Ordinance, it shall be published by title and summary only in the Davis Enterprise or other newspaper of general circulation together with the names of members of the Board of Supervisors voting for and against the same.
