ACCREDITATION PASS TERMS & CONDITIONS The use of the accreditation pass is subject to the following terms & conditions: 1. GENERAL CONDITIONS 1.1 The Pass Holder is the holder of an accreditation pass ( Pass ) issued by Singapore GP Pte Ltd ( SGPPL ) and applied for by the party submitting to SGPPL an accreditation application ( Applying Party ) in accordance to these terms and conditions. Any Pass Holder s entry to and presence at the FORMULA 1 2018 SINGAPORE AIRLINES SINGAPORE GRAND PRIX ( Race ) and the area around the race track set aside for events relating to the Race ( Circuit Park ) is therefore subject to these terms and conditions and any accompanying risks, obligations and responsibilities. 1.2 By using the Pass, the Pass Holder is deemed to have accepted and agreed to be bound by these terms and conditions. It is the Pass Holder s responsibility to ensure he has read and understood these terms and conditions and any accompanying risks, obligations and responsibilities. It is the Applying Party s responsibility to draw the Pass Holder s attention to these terms and conditions. In addition, the Applying Party warrants and confirms that (a) the relevant consents have been obtained from the Pass Holder by the Applying Party for the disclosure of personal data to SGPPL in accordance with all relevant data protection laws and that the Applying Party shall retain proof of such consents, to be provided to SGPPL upon SGPPL s request; and (b) that the SGGPL Data Protection Policy has been read, understood and consented to by the Pass Holder. 1.3 Only persons aged 16 and above are eligible to apply for a Pass. 1.4 The Pass Holder acknowledges that the Pass is not a spectator pass. Any Pass Holder caught watching the race from bleachers, grandstands and/or from anywhere within the Circuit Park will be deemed to have abused the pass and SGPPL is entitled to revoke the Pass and remove the Pass Holder from the Circuit Park. 1.5 The Pass Holder must report all occurrences of lost passes to SGPPL immediately upon discovery of the loss. The Pass Holder shall be liable for any losses, damages, expenses, or claims however caused arising out of or in connection with the misuse of a lost pass if the lost pass was not reported to SGPPL within 24 hours of its loss. 1.6 Notwithstanding anything contrary in these terms and conditions, the Pass shall remain the property of SGPPL. 1.7 The Pass Holder consents to SGPPL, its related corporations (collectively, the SGPPL Group ), and their respective business partners and agents (collectively, the SGPPL Representatives ) collecting, using and disclosing the Pass Holder s personal data for purposes reasonably required by the SGPPL Group and the SGPPL Representatives to enable them to process the accreditation application and provide access to the Circuit Park which the Pass Holder is applying for. Such purposes are set out in the SGGPL Data Protection Policy, which is accessible at http://accreditation.singaporegp.sg/accreditation/dpp.pdf or available on request. The Pass Holder confirms that they have read, understood and consented to the SGGPL Data Protection Policy.
2. SECURITY 2.1 The Pass Holder shall comply with: a. any security arrangements, directions or notices displayed or given by the Police or officers, employees or agents of SGPPL, Federation Internationale de l Automobile ( FIA ), Formula One Marketing Limited ( FOML ), Formula One Management Limited ( FOM ), and Formula One World Championship ( FOWC ), including without limitation, notices, directions or other requirements relating to access and security at the Race; b. the conditions of entry displayed at the entrances to the Race; and c. all laws, regulations or requirements of the Police or any authorities (including, without limitation, the FIA, FOML, FOWC) having jurisdiction over the activities of SGPPL, the Race and/or the use or occupancy of the Circuit Park and Facility(ies). 2.2 For reasons of security and safety, SGPPL reserves the right in its discretion: a. to refuse suitcases, bags and/or other items being brought in to the Circuit Park (or into any area under the control of SGPPL) whether before, during or after the Race; and b. to inspect any bag or other item which any person wishes to bring in to or remove from the Circuit Park, whether before, during or after the Race. 3. ACCESS, ENTRY 3.1 The Pass Holder acknowledges that the pass is not transferable and SGPPL reserves the right to revoke the pass at any time. 3.2 The Pass Holder is only permitted access to the designated areas of the Circuit Park, and shall not enter any restricted areas designated by SGPPL or FOWC. 3.3 The Pass must be produced for inspection and/or electronically scanned upon entry to and exit from the Circuit Park. An exit scan is required prior to each re-entry. 3.4 The Pass must be displayed at all times. SGPPL reserves the right not to admit a person who does not display his Pass and may require that person to immediately leave the relevant facility. 3.5 SGPPL reserves the right to refuse or admit or to eject from the Circuit Park or/and to confiscate the Pass of any person who does not comply with the terms and conditions for use of the Pass. 4. RISKS AND WARNINGS 4.1 As a condition of entry into the Circuit Park, the Pass Holder acknowledges and accepts that the Race, motor racing and the activities associated therewith are dangerous and being in or in the vicinity of the Circuit Park may involve personal risk. The Pass Holder is reminded of and agree to, accept and acknowledge that the warnings, indemnities and limitation of liabilities set out in Clause 6 below. 5. PHOTOGRAPHS, IMAGES & RECORDING, AND THE COLLECTION OF INFORMATION 5.1 The Pass Holder must not make, create, store, record or transmit any kind of sound recording, visual footage or audio-visual footage of, at or in relation to the Race ( Recording ), or store, record or transmit any information or other data, including official timing, results, performance, telemetry, weather or race control data of, at, or in relation to the Race ( Data ). Unless authorised by SGPPL in writing. The Pass Holder must not bring into or use within the Circuit Park any equipment that may enable a person to do the aforementioned acts. Personal communication devices (including mobile telephones) are permitted within the Circuit Park unless otherwise advised, provided that the Pass Holder does not make, create, store, record or transmit any Recording, Data and any image, including photographic images, with these devices.
5.2 Without limiting any action available to SGPPL, it is a condition of use that the Pass Holder acknowledges and accepts that it is a condition of entry to the Race that the use of any such Recording, Data or Image ("Footage") or any part of it for profit, commercial gain, public advertisement, display or for any other purpose, without the prior written consent of FOM and/or FOWC is strictly forbidden and will constitute a breach of these conditions for which the Pass Holder and/or the Pass Holder s employer may be liable; and 5.3 The Pass Holder acknowledges that SGPPL, FOWC and third parties authorised by FOWC may make or record film or other forms of moving pictures, still pictures, sound recording or any of them of the Race. The Pass Holder hereby grants the SGPPL, FIA, FOM, FOWC and third parties authorised by them permission to use photographs, film, tape, or other images or likenesses of the Pass Holder, or any sound recording, in any media (including publication within and outside Singapore) and for any purpose without identification, compensation or payment of any kind. 5.4 The Pass Holder consents to being photographed, filmed and recorded as members of the Race audience, and consent to the use of any such film, image or recording for public transmission. 6 INDEMNITY AND LIABILITY 6.1 These terms and conditions constitute an agreement between SGPPL and the Pass Holder, and may not be varied except as expressly agreed in writing by an authorised officer of SGPPL. All other terms, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law. Where any conflict arises between the terms contained in the accreditation application form and these terms and conditions, the latter shall prevail. 6.2 SGPPL shall not be held liable for any act or omission by any person not employed directly by SGPPL. SGPPL shall have no liability for the acts or omissions of the FIA, FOML, FOM, FOWC, any engineering project manager appointed by SGPPL or any of their respective servants, agents or employees ( Associated Entities ). 6.3 Each Pass Holder acknowledges and accepts that motor racing, the Race and certain activities associated therewith (including without limitation, support races) are dangerous and accidents can happen and that there is a possibility of an accident causing injury, death, property damage or loss, and accordingly, Pass Holders being in the vicinity of the Race do so at their own risk. Pass Holders acknowledge the risks associated with being in the vicinity of the Race include but are not limited to the risk of suffering harm as a result of motor vehicles (or parts of them) colliding with other motor vehicles, persons or property. 6.4 The vehicles used in the Race can generate noise of up to 130 decibels (db). Exposure to any noise greater than 120 db can cause permanent hearing damage. Each Pass Holder agrees to take the appropriate ear protection, including without limitation, wearing ear plugs and ear muffs. 6.5 Save for death or personal injury to a Pass Holder caused by the negligence of SGPPL, SGPPL shall not be liable to the Pass Holder or the Applying Party by reason of any acts or omissions of SGPPL (or its employees, agents or contractors), any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of these conditions for any loss of profit or any indirect, special or consequential loss, damage, injury, costs, expenses or other claims (whether caused by the negligence of SGPPL (or its employees, agents or contractors) or otherwise) which arise out of or in connection with the provision of the Race (including any delay in providing or failure to provide the Race). 6.6 Save for death or personal injury to a Pass Holder caused by the negligence of the Associated Entities, the Associated Entities shall not be liable to the Pass Holder or the Applying Party by reason of any acts or omissions of the Associated Entities (or their respective employees, agents or contractors), any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of these conditions for any loss of profit or any indirect,
special or consequential loss, damage, injury, costs, expenses or other claims (whether caused by the negligence of the Associated Entities (or their respective employees, agents or contractors) or otherwise) which arise out of or in connection with the Race. 6.7 The Pass Holder further acknowledges and agrees that SGPPL and the Associated Entities do not make any warranty that the Circuit Park at the Race will be provided with due care and skill or that any materials provided in connection with the Circuit Park will be fit for the purposes for which they are supplied. The Pass Holder acknowledges that, to the extent that any warranty is implied, it is excluded to the full extent permitted by law. 6.8 FOWC is the commercial rights holder and commercial organiser of the Race that comprises a round of the FIA Formula One World Championship. The use of the trademarks owned by FOWC and its affiliates (including but not limited to those set out in this Clause 6.8) is STRICTLY PROHIBITED. Formula One Licensing B.V. is the owner of the FORMULA 1 brand which includes the following trademarks: Formula One Licensing B.V. also owns the trademark Singapore GP and SGPPL is the exclusive licensee thereof. Use of such trademark is also strictly prohibited. 7 PROHIBITED ITEMS 7.1 Without prejudice to Clause 2 and Clause 5.1, and in addition thereto, the following items are NOT allowed into the Circuit Park: Alcohol, pets or animals, any item that could be used as a weapon, audio recorders, video cameras, bicycles, scooters, skateboards and roller-blades/skates, cans, chairs/stools, coolers and hampers, fireworks and sparklers, Frisbees, helium balloons, glass (including bottles), food and drink (except for 1 clear plastic bottle of soft drink or mineral water of no more than 600ml), large flags (except for national and team flags), musical instruments and/or amplification equipment, non-collapsible prams/strollers/infant car seats, unauthorised advertising material or flyers, laser pointers, distress signals, whistles or loud hailers, remote controlled crafts and drones, and any item prohibited by legislation. The items listed in this Clause are not exhaustive and a list of all prohibited items will be placed at the entrance to the Circuit Park and/or areas designated by SGPPL. 7.2 For the avoidance of doubt, the Pass Holder shall not bring food or beverages of any description into the Circuit Park.
8 DEFAULT 8.1 SGPPL reserves the right, with reasonable cause, to refuse entry to any person or remove any person from the Race. In particular, any person who does not comply with these conditions may be refused entry or removed from the Race. 9 MISCELLANEOUS 9.1 SGPPL may at any time in its sole discretion amend or vary any provision of these conditions. If the Pass Holder does not consent to such variation or amendment, the Pass Holder shall not use the Passes for purposes of entry to the Race and/or Circuit Park. If, following such amendment or variation, the Pass Holder nevertheless uses the Pass to enter the Race and/or Circuit Park, the Pass Holder, as the case may be, shall be deemed to have irrevocably consented to such amendment or variation and to have agreed to be bound thereby. 9.2 Each of the provisions of these conditions is severable from the other(s). If any such provision or part thereof is or becomes invalid, unenforceable or illegal in any respect, such provision or part thereof shall, to the extent that such term is invalid, be deemed not to form part of these conditions but the validity, enforceability or legality of the remaining provisions hereunder shall not in any way be affected or impaired thereby. 9.3 Any provision of this terms and conditions which is for SGPPL's benefit may be waived at any time by SGPPL. Any such waiver may be conditional or restricted in any manner, but shall not affect SGPPL's right to require compliance with any provision of these terms and conditions. No waiver of any breach of these terms and conditions is considered valid unless made in writing and signed by SGPPL. No waiver, or any failure or delay on SGPPL's part to exercise any right, power, or privilege under these terms and conditions, shall be deemed a waiver of any subsequent breach or default of the same or similar nature, nor shall any single or partial exercise of any such right, power or privilege preclude any further exercise thereof or of the exercise of any other right, power or privilege. For the avoidance of doubt, the issue of a Pass to a Pass Holder does not constitute a waiver of any breach by the Pass Holder of any provision of these terms and conditions, or a waiver of any breach by the Applying Party of any contract entered into or which may be entered into between the Applying Party and SGPPL. 9.4 The Associated Entities may enforce the terms of Clauses 2, 3, 5.2, 5.3, 6.2, 6.6, 6.7, and 6.8, subject to and in accordance with the provisions of the Contracts (Rights of Third Parties) Act (Chapter 53B). 9.5 These terms and conditions are governed by the laws of Singapore and the parties hereby submit to the non-exclusive jurisdiction of the courts in Singapore.
