TREMS AND CONDITION OF THE COMPLETION OF BALANCE WORKS/RENOVATION OF THE EXISTING PDC COMPLEX AT DRABA (SURANKOTE- POONCH) 1. The Contractor/Firm should be registered with contractor state Govt. organization. 2. The Tenderer may visit the site on his own to ensure site conditions for quoting genuine and workable rates. 3. The contractors are advised to quote above/below rates in percentage. Item rates should be quoted only for the items which are outside S.S. of rates 2004 (Rates to be quoted on BOQ form only). The tenders which do not full fill this condition will be out rightly rejected. 4. The rates shall be written both in words and figures. In case of any confusion of rates written in both figures and words, the rates written in words shall be taken as final. 5. Earnest money in the shape of CDR be pledged to Chief Pay & Accounts Officer, Parnai Hydel Project, Jammu. Tender will be out rightly rejected in absence of it. 6. The Tender should be submitted by registered post or speed post only at the risk and responsibility of the Tenderer. 7. Tenderer should ensure that the tender reaches the office of the Chief Project Engineer, Parnai Hydel Project 174/7, Channi Himmat Jammu before the prescribed date and time. Any tender by telegram/fax/by hand will be rejected out rightly. 8. The work shall have to be completed in all respects with in stipulated time period. Penality upto 10% of the total cost of work will be imposed for delaying the works. 9. The Tender is valid for 90 days from the date of opening of the tender. 10. Conditional tender shall be out rightly rejected. 11. The rates to be quoted by the contractor shall be inclusive of all taxes/service tax/income tax/toll tax/octrai charges, sales tax, local tax, GST etc. 12. No extra charges will be paid on a/c of machinery P.O.L to be used at the site of work. 13. The contractor/firm has to make his own arrangements to work during the night hours. 14. No accommodation will be provided by the corporation for the labourers etc. deployed at the site of work. 15. No escalation in rates shall be payable for any escalation in the market price of the labour/material during the period of the contract. 16. Any type of works not included in the rate list but actually executed at the site of work shall be paid as per S.S.R of 2004 with contractors tender appreciation. 17. The tenderers should use two envelops in a common envelop with name of the firm/ agency. In one envelop i.e. part (i) should contains CDR and certificate of Income Tax/sales Tax clearances for the year 2009-10. The 2 nd envelop i.e. part (ii) should contain rate list and rate quoted by the contractor only and will be opened after qualification.

18. The contractor stands responsible to face labour act for engaging the labour below 18 years or any other act in labour clause. 19. Any loss or damage due to natural calamity during execution shall be borne by the contractor. 20. The other conditions will be same as per PWD form No.-25 and general conditions as per the tender document. 21. As soon as the acceptance of the tender is communicated to the successful tenderer, the contract shall be a binding upon him. A formal deed incorporating the terms of the contract will be executed by the successful tenderer with in 5 days from the date of issue of allotment. In case of failure to execute such formal deed, the department will be free to proceed with the re allotment of the work as it would do in the event of any contractor backing out. Any loss sustained to the department through the alternative agency shall be recovered from the original contractor. 22. The quantities given are approximate. The successful tenderer will execute the work well within the agreement amount and within the stipulated time period and as per specified specifications. 23. 90% payment shall be made subject to release of funds lying with the corporate office JKSPDC Jammu/Srinagar and the rest 10% shall be released 1 year after successful completion of work. 24. In case of any dispute the matter shall be referred to Chief Project Engineer, Parnai Hydel Project, Jammu and the decision taken by the Chief Project Engineer shall be final and binding on both the parties. 25. The tender document is non transferable and can be obtained by the desirous firms/tenderers or their authorized representatives after depositing the cost of tender documents with in a written request on proper letter head. 26. A certificate from the concerned to the effect that the contractor has executed works upto 1/3 rd of the advertised amount during any of the last five years be enclosed. 27. If after opening of tenders, it is found that the rates quoted by the lowest tenderer are less by 15% of the advertised amount, the contractor shall have to provide an additional security of 5% of the tendered amount in the shape F.D.R/CDR pledged to Chief Pay & Accounts Officer, Parnai Hydel Project Jammu till the completion of works. 28. The material used for those items which are outside/ with in the sanctioned schedule of rate of 2004 shall be of ISI mark of approved quality duly checked and verified by the Engineer Incharge. 29. Misconduct/Misbehavior during Tender opening process with any officer/official shall be dealt under rules and in terms of the enlistment of registration of the contractor in the department and shall be subject to the cancellation of registration card issued by this department or any other department.

30. Rate quoted by the contractor should be free from any cutting, over writing what so ever in case of any cutting or over writing, the same should be attested and initialed by the Tenderer or otherwise such Tenders shall be rejected out rightly even if all other conditions are full filled. 31. The Tender accepting authority reserves the right to accept or reject any or all the Tenders before or after their opening without assigning any reason there of. 32. In case the last date of receiving the Tender form is declared as Gazetted holiday, the next working day shall be considered the last date of receipt of Tender.
