THE CORPORATION OF THE DISTRICT OF SURREY BY-LAW NO. 11076 A by-law to amend "Surrey Zoning By-law, 1979, No. 5942."... THE MUNICIPAL COUNCIL of The Corporation of the District of Surrey, in open meeting assembled, ENACTS AS FOLLOWS: l. "Surrey Zoning By-law, 1979, No. 5942," as amended, is hereby further amended, pursuant to the provisions of Section 963 of the "Municipal Act," and the classification of the following parcels of land, presently shown upon the maps designated as the "Zoning Maps" and marked as Schedule "A" under PART III of the said By-law No. 5942, is hereby amended as follows: FROM "AGRICULTURAL ZONE ONE (A-1)" TO "COMPREHENSIVE DEVELOPMENT ZONE (C-D)" Parcel 2 (Statutory Right of Way Plan 75832) of Parcel A (Explanatory Plan 13373), Section 17, Block 5 North, Range 2 West, New Westminster District Plan 616. (12701-110 Avenue) 2. The following regulations shall apply to the lands herein: A. INTENT This Comprehensive Development Zone is intended to accommodate the development of a multi-building project comprising convenience and service commercial uses. B. PERMITTED USES The land and structures shall be used for the following uses only, or for a combination of such uses: 1. From Section B, Permitted Uses of Part XXXVII C-H Highway Commercial Zone, in Surrey Zoning By-law, 1979, No. 5942," as amended, (a) Retail commercial uses: Appliance store Auction room Automotive sales and rentals (new and used) Automotive parts (new) sales Eyewear stores Furniture store Hardware store Hobby brewing stores, providing that the brewing room does not exceed fifty (50) square meters (540 sq. ft.) and that the storage/warehouse facilities do not exceed one hundred (100) square metres (1,080 sq. ft.)
Home improvement, building supplies and garden supplies provided that all storage is enclosed by a building or screened in such a manner that no storage of material shall be visible from the SkyTrain or from grade of such building or screen. Bank, provided that the maximum gross floor area does not exceed three hundred twenty five meters (3,500 sq. ft.) and minimum one automatic teller machine is accessible from outside. Sales and distribution of damaged goods Soda pop shops (b) (c) (d) (e) Service commercial uses: Animal hospital Appliance repair shop Automotive repair shop provided that the vehicles to be repaired do not exceed five thousand (5,000) kilograms GVW. Boat repairs Car rentals Car wash Drive-in and fast food establishment Food catering Health spa Insurance agency, including ICBC Claim Center Mail and phone order store Pick-up and delivery or courier service Taxidermy Tool rental Recreational commercial limited to: Bowling Centre, with a minimum number of 24 bowling lanes, or a recreation facility with similar foot print area. General contractor provided that any contractor's storage yard is enclosed by a building or screened in such a manner that no storage of material shall be visible from the Skytrain or from grade of such building or screen. Industrial uses provided that a sales outlet is part of and incidental to the industrial operation and further provided that all storage is enclosed by a building or screened in such a manner that no storage of material shall be visible from the Skytrain or from grade of such building or screen: Bakery Bookbinding Engraving Jewellery manufacturing Laboratory Leather goods, and clothing fabrication Photographic processing shops with a sales outlet Printing and publishing Shoe repair and manufacture Sign making and painting Textile fabrication Upholstering

The following uses from Section B, Permitted Uses of Part XXXVIII C-L Local Commercial Zone, in Surrey Zoning By-law, 1979, No. 5942," as amended, Barber Shops and Beauty Parlours Dry Cleaning Establishment and Laundromats Grocery Stores, provided that the maximum gross floor area does not exceed three hundred eighty (380) square metres (4,000 sq. ft.) Restaurants, Cafes and Delicatessens Retail Nurseries, provided that all storage is enclosed by a building or screened in such a manner that no storage of material shall be visible from the SkyTrain or from grade of such building or screen: Shoe Repairs Souvenir and Gift Shops Video Rentals and Sales 3. From Section B, Permitted Uses of Part XLA C-G(2) Full Serve and Self-Serve Gasoline Station Zone, in Surrey Zoning By-law 1979, No. 5942," as amended: Combined full-serve and self-serve gasoline stations; provided, however, that no more than one (1) pump island with a maximum of eight (8) self-serve hoses shall be permitted and that at least an equal number of full-serve hoses shall be available on the same site. 4. Accessory uses or buildings shall NOT be permitted and no residential uses or structures of any kind shall be permitted. C. LAND DEVELOPMENT Notwithstanding any other provision of this zone, the uses permitted by Section B shall be conditional upon the immediate availability and adequacy of those Municipal facilities and services hereinafter set forth to serve each parcel of land and each unit of every building, structure and use to be erected, placed or carried on thereon. No use of land and no use of any building or structure thereon shall be deemed to be authorized by Section B of this zone, and all uses otherwise permitted by this By-law are hereby prohibited unless and until all of the following services and facilities have been provided and are immediately available and are adequate therefore to the standards set out as follows: 1. Sanitary sewer, waterworks and drainage works shall be provided and constructed to the standards set out in "Surrey Subdivision By-law, 1986, No. 8830" and amendments thereto. 2. All highways abutting and serving the land including boulevards, street lighting, underground wiring, sidewalks, transit service facilities shall be provided and constructed to the standards set out in "Surrey Subdivision By-law No. 8830" and amendments thereto. 3. Where the uses permitted for the site under the zone as listed above herein, have varying highway and/ or servicing standards as set out in "Surrey Subdivision By-law, 1986, No. 8830" and amendments thereto, the standards requiring the greatest capacity shall apply over the entire site.
D. DENSITY Density shall be in accordance with the provisions of Section D, Density, Part XXXVII - C-H Commercial Zone, in Surrey Zoning By-law, 1979, No. 5942," as amended. E. SITE COVERAGE Site coverage shall be in accordance with the provisions of Section E, Site Coverage, Park XXXVII - Highway Commercial Zone (C-H) of Surrey Zoning By-law, 1979, No. 5942," as amended. F. SUBDIVISION Subdivision shall be in accordance with the provisions of Section F, Subdivision, Part XXXVII - Highway Commercial Zone (C-H) of Surrey Zoning By-law, 1979, No. 5942," as amended. G. HEIGHT OF STRUCTURES The height of buildings and structures shall be in accordance with the provisions of Section G, Height of Structures, Part XXXVII - Highway Commercial Zone (C-H) of Surrey Zoning By-law, 1979, No. 5942," as amended. H. YARDS AND SETBACKS Buildings and structures of all C-H and C-L related uses shall be in accordance with the provisions of Section H, Yards and Setbacks, Part XXXVII - Highway Commercial Zone (C-H) of Surrey Zoning By-law, 1979, No. 5942," as amended; and Buildings and structures related to Gasoline Station uses shall be in accordance with the provisions of Section H, Yards and Setback, Part XLA - Full-Serve and Self-Serve Gasoline Station Zone (C-G(2)) of Surrey Zoning By-law, 1979, No. 5942," as amended; I. LANDSCAPING Landscaping shall be in accordance with the provisions of Section H, Yards and Setbacks, Part XXXVII - Highway Commercial Zone (C-H) of Surrey Zoning Bylaw, 1979, No. 5942," as amended. J. GENERAL PROVISIONS Parts I, II, III, IIIA, IV, V, VI, VII and IX of Surrey Zoning By-law, 1979, No. 5942," as amended, generally apply to this Amendment By-law, as are relevant and non-contradictory. K. OFF-STREET PARKING Location of off-street parking shall be in accordance with the provisions of Section K, Off-Street Parking, Part XLA, Full Serve and Self-Serve Gasoline Station Zone (CG-2) of Surrey Zoning By-law, 1979, No. 5942," as amended.
L. DEVELOPMENT COST CHARGES Development Cost Charges are payable at the rate applicable to the Highway Commercial Zone (C-H) and will be calculated and collected when the building permit is applied for. 4. This By-law shall be cited for all purposes as "Surrey Zoning By-law, 1979, No. 5942, Amendment By-law, 1991, No. 11076." READ A FIRST AND SECOND TIME on the 21st day of October, 1991. PUBLIC HEARING HELD thereon on the 25th day of November, 1991. READ A THIRD TIME ON THE 2nd day of December, 1991. RECONSIDERED AND FINALLY ADOPTED, signed by the Mayor and Clerk, and sealed with the Corporate Seal on the 1st day of March, 1993.
