MINUTE BIBB COUNTY BOARD OF COMMIIONER June 22, 2004 5:00 p.m. (pecial Meeting Time) The regular meeting of the Bibb County Board of Commissioners was held in the Commission Boardroom on Tuesday, June 22, 2004 at 5:00 p.m. Board Members present: Chairman Tommy C. Olmstead, Vice Chairman amuel F. Hart, r., Commissioner Elmo A. Richardson Jr. and Commissioner Charles W. Bishop. News Media: Chase Ambrose, FOX TV 24. Chairman Olmstead recognized and welcomed Reverend Dale Freeney, Lay Member, Forest Hills United Methodist Church, for the PRAYER FOR THE DAY. Chairman Olmstead asked everyone to stand for the Pledge of Allegiance. ANNOUNCEMENT Chairman Olmstead announced that the second public hearing would be held following tonight s Board meeting on the FY 2005 Budget & Millage and the third and final public hearing would be held on Wednesday, June 30, 2004 at 6:00 p.m. followed by a special called meeting at 6:30 p.m. to adopt the FY 2005 budget. Chairman Olmstead announced that Commissioner Elmo Richardson has been appointed to the Governor s Transportation Task Force. APPROVAL OF MINUTE On motion of Commissioner Richardson, seconded by Commissioner Hart and carried, the Minutes of the regular meeting of June 8, 2004 were approved as written. RECOGNITION OF VIITOR 1

Chairman Olmstead recognized and welcomed Ms. Johnnie Mae Dawkins and Ms. Nettie Thomas of Kings Park. REFERRAL: The following item was referred to ENGINEERING/PUBLIC WORK: upplemental Agreement No. 2 between the tate of Georgia Department of Transportation and Bibb County for the Bibb County Traffic ignal Timing Project. RECORD & INFORMATION: ACTION: Monthly departmental reports and agency activities received for record: Clerk, tate Court. Ratification of the following Resolutions of the Board of Commissioners: Honoring Mrs. Elizabeth Brazzeal Richardson upon her 90 th birthday on June 14, 2004; Honoring Reverend and Mrs. Herbert. Williams on the occasion of their 35 th Anniversary in the Gospel ministry on June 13, 2004; Honoring abrina ikora, Miss Macon 2004, for her community service and achievements and future competition in the Miss Georgia Pageant ; and In observance of the 12 th Annual Juneteenth Freedom Festival on June 19, 2004 at Tattnall quare Park. On motion of Commissioner Bivins and seconded by Commissioner Richardson, the aforementioned resolutions were ratified. The Committee recommends approval of the request from the Tax Commissioner s Office to write off $177,566.25 in uncollectible ad-valorem taxes. 2. The Committee recommends approval of the transfer of designated funds of $2 million from the General Fund to the Pension Fund and $1.3 million from the General Fund to the Worker s Compensation Fund. 3. The Committee recommends that bids received for Insecticides for Tick Control be awarded to Chick upplies for Rabon in the amount of $33,858.00. The Committee further recommends that bids received for Insecticides for Mosquito Control be awarded to B&G Chemical for Bactimos Briquets in the amount of $7,815.00. 4. The Committee recommends the bids for the Term Contract for Law Enforcement Uniforms be awarded based on firm unit prices for the term July 1, 2004 through June 30, 2005, and as follows: Command Uniforms ection A Deputy Clothing 3

Uniforms Unlimited ection B Accessories Army urplus ection C & D hoes & Leather 5. The Committee recommends that the Term Contract for Battle Dress Uniforms be awarded to Army urplus based on the firm unit prices for the term of July 1, 2004 through June 30, 2005. 6. The Committee recommends extending the Term Contract for Vehicle Maintenance and Repair with Mitchell s Automotive based on the firm unit prices for the term of July 1, 2004 through June 30, 2005. 7. The Committee recommends that bids received for Natural Gas ervice be awarded to cana Energy Marketing, Inc at NYMEX plus.29 per therm for the term of July 1, 2004 through June 30, 2005. The Committee further recommends that Chairman Tommy Olmstead be authorized to execute the contract. 8. The Committee recommends that because of lack of available space that the County deny the request of the Georgia Department of Human Resources for additional space at 175 Emery Highway. 9. The Committee recommends that the contract with Macon Communications for Radio Maintenance be extended at the same unit prices for the term of July 1, 2004 through June 30, 2005. The Committee further recommends acceptance of the proposal to include portable radio batteries in the contract at an additional cost of $1.50 per month per battery. 4

10. The Committee recommends approval of retaining the services of Mr. Travis hepherd, a local consultant, to perform additional testing and reporting to tate Environmental Protection Division concerning violations with gas pumps at the Bibb County Law Enforcement Center and authorization for Chairman Olmstead to sign an agreement with ECA, LLC, contingent upon requested information being received. 11. The Committee recommends approval of authorization for Chairman Olmstead to sign the lease between Bibb County and the Department of Veterans ervices for the rental of 369 square ft. located at 653 econd treet for a monthly rate of $565.40. 12. The Committee recommends that effective June 2, 2004, the hourly rate for Mr. Larry E. mith of the Macon-Bibb County Board of Elections be increased from $12.00 to 15.00 per hour and paid as a part-time employee rather than a voucher check. 13. The Committee recommends approval of payment to the Trane Company in the amount of $15,187.19 covering the County s share of repair cost covering the cooling system in the Regional Transportation Management Center located at 415 Oak treet. This approval is made with the stipulation that the system warranty be reinstated effective May 1, 2004. 14. Based on recommendation from the County Attorney, the Finance Committee recommends that the request from Mr. Bryan Bateman, Chairman of the outh Bibb County Property Owners Association, for Bibb County to pay Reimbursement of $9,814.38 covering attorney fees, be respectfully denied. 5

15. The Committee recommends that authorization be given to the Macon-Bibb County Recreation Department to use unobligated Bibb County Greenspace Funds, as of June 22, 2004, in the amount of $192,860.00 toward the purchase of 141-1/2 acres of land in outh Bibb County. This approval is granted with the stipulation that the land be deeded to Bibb County. 16. The Committee recommends approval of authorization of Chairman Olmstead to sign an agreement between Bibb County and the Georgia Department of Corrections for the services of inmate work crews from the Central tate Prison facility on Public Works projects for the contract period July 1, 2004 through June 30, 2005, at a rate of $35,700.00 per year. was approved as presented 17. The Committee recommends approval of authorization for Chairman Olmstead to sign an agreement between Bibb County and the Georgia Department of Corrections for the services of inmate work crews from the Western Detention Center facility on Public Works projects for the contract period July 1, 2004 through June 30, 2005, at a rate of $35,700.00 per year. was approved as presented 18. The Committee recommends approval of authorization for Chairman Olmstead to sign the lease between Bibb County and the Macon-Bibb County Economic Opportunity Council for lease of 4,772 sq. ft. Located at 653 econd treet at a rate of $31,590.00 per year. was approved as presented 19. The Committee recommends approval of authorization for Chairman Olmstead to sign the lease between Bibb County and A. T. Holt Company for parking in Walnut treet Lane at a rate of $200.00 per month. At this point in the meeting, Chairman Olmstead recognized and welcomed Mr. Clifford Johnson, Jr. of Kings Park. RIK MANAGEMENT COMMITTEE - No Report. 6

ENGINEERING/PUBLIC WORK COMMITTEE - Committee Chairman Bishop reported the following: 1. The Committee of the Whole recommends that the petition from Ms. Beverly K. Olson, Horseshoe, LLC, for the registration of tarcadia Circle be approved and that said road be placed on the Official Road Register for maintenance by Bibb County forces. 2. The Committee of the Whole recommends that the petition from BOH Development, Inc., for the registration of Nautica Pointe Road be approved and that said road be placed on the Official Road Register for maintenance by Bibb County forces. 3. The Committee of the Whole recommends that the petition from Charleston Developers for the registration of Troon West, Ravenel Court, Rutledge Way and Carrick Way be approved and that said roads be placed on the Official Road Register for maintenance by Bibb County forces. 4. The Committee of the Whole recommends that the petition from Charlie N. McGlamry, President, Barrington Hall Development Corporation, for the registration of Winsor Way and Buckingham Mews be approved and that said roads be placed on the Official Road Register for maintenance by Bibb County forces. 5. The Committee of the Whole recommends approval of the ordinance to fix the maximum speed limit on Governor MacDonald Drive and Taylor Road at 25 miles per hour. 7

6. The Committee reports that a Traffic ignal Permit Application has been submitted to the Georgia Department of Transportation by Traffic Engineer Bill Wikle for tate Route 74 (Thomaston Road) at its intersection with Lamar Road/Johnson Road. 7. The Committee of the Whole recommends approval of the following resolution regarding GDOT documents covering the Forest Hill Road Improvement Project, RIP#8: Resolution authorizing the Chairman and Clerk to execute the Contract for Maintenance Local tate Route Acceptance Resolution TOBEOFKEE COMMITTEE - Committee Chairman Bishop reported the following: The Committee recommends approval for Cumulus Broadcasting to conduct the Annual parks Over The Park Fireworks Event at andy Beach Park on July 4, 2004. The Committee also authorizes the Chairman Power-To-Act on the event contract. PUBLIC AFETY COMMITTEE - No Report. HUMAN REOURCE AND INFORMATION ERVICE COMMITTEE - In the absence of Committee Chairman Bivins, Commissioner Bishop reported the following: 1. The Committee recommends the elimination of future part-time Commissioners from the County Retirement Plan, and grand fathering existing Commissioners. 2. The Committee recommends Mr. Doye Green to serve on the Macon-Bibb County Library Board of Trustees to complete the unexpired term of Mr. John Wilkerson. The term expires June 30, 2008. 8

3. The Human Resources and Information ervices committee recommends the appointment of Ms. Jean Boyd to the Macon-Bibb County Library Board of Trustees. 4. The Committee recommends the deletion of Pension ection Code 2-151 regarding potential cost-of-living raises. DICUION Commissioner Bishop stated that he thinks this is an impairment of contract and that he will vote against it. Chairman Olmstead called for the question. The motion passed by a four to one vote (4-1). Commissioner Bishop cast the dissenting vote. ORDINANCE, REOLUTION & LEGILATIVE COMMITTEE - No Report. MIDDLE GEORGIA REGIONAL DEVELOPMENT CENTER - No Report. LICENE & TAX COMMITTEE - Committee Chairman Richardson reported the following: The Committee recommends that the 2003 penalty imposed on The Kroger Company by the Macon-Bibb County Board of Tax Assessors as it relates to their personal property tax return be refunded directly to The Kroger Company rather than to Aegis (property tax specialists) the authorized agent acting on their behalf. On motion of Commissioner Richardson and carried, the before mentioned recommendation PROPERTIE COMMITTEE - No Report. UNFINIHED BUINE - None. NEW BUINE - None.
