AN ORDINANCE OF MANATEE COUNTY, FLORIDA, RELATING TO CONTRACTOR LICENSING; CREATING SECTION 2-6-101 OF THE MANATEE COUNTY CODE OF ORDINANCES TO PROVIDE FOR LOCAL CERTIFICATES OF COMPETENCY FOR GARAGE DOOR SPECIALTY CONTRACTORS; PROVIDING SCOPE, DEFINITIONS, APPLICABILITY, AND PROCEDURES FOR GARAGE DOOR SPECIALTY CONTRACTORS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MANATEE COUNTY, FLORIDA: Section 1. Section 2-6-101 of the Manatee County Code of Ordinances is hereby created to read as follows: 2-6-101. Garage door specialty contractors. (a) Scope. The purpose of this section is to provide for local certificates of competency for garage door specialty contractors. (b) Definitions. (1) Garage door specialty contractor is a contractor whose services are limited to the execution of contracts requiring the experience, knowledge and skill necessary for the fabrication, assembling, handling, erection, installation, replacement, dismantling, adjustment, alteration, repair, servicing and design work when not prohibited by law, in accordance with accepted engineering data and/or according to manufacturers specifications, of garage doors and allied construction materials. (2) The scope of such work shall include and be limited to garage doors and garage door assemblies, including hardware and operating devices. The scope of such work shall include wood work incidental to the garage doors and allied construction materials. It shall be limited to the repair and/or replacement of wood incidental to the installation of garage doors. The scope of such work shall comply with all plans, specifications, codes, laws and regulations applicable.
(3) The garage door specialty contractor shall not perform any work that alters the structural integrity of the building, including but not limited to, roof trusses, lintels, load bearing walls and foundations. (4) The garage door specialty contractor shall be allowed to install low voltage electrical wiring for safety features and cord and cap connected to the garage door assemblies, devices, motors and equipment. Any other electrical work incidental to the installation, replacement, dismantling, repair or servicing of the garage doors, including but not limited to, installation, replacement, removal, repair or servicing of receptacles, lights and switches, shall be contracted to a licensed electrical contractor. (5) The garage door specialty contractor shall subcontract, with a licensed qualified contractor in the field concerned, all other work incidental to that which is defined herein but which is the work of a trade other than that of a garage door specialty contractor. (c) Applicability. The provisions of this section shall apply to garage door specialty contractors performing work in the unincorporated area of Manatee County. (d) Procedures. (1) Qualifications. a. Any person who desires to obtain a local certificate of competency as a garage door specialty contractor shall apply to the Manatee County Construction Trades Board in writing. b. A person shall be eligible to apply for a local certificate of competency as a garage door specialty contractor if the person: 1. Is eighteen (18) years of age; 2
2. Is of good moral character; 3. Complies with the requirements specified in paragraph (d)(2) of this section; and 4. Passes the garage door specialty examination and the business and law examination as provided in paragraph (d)(3) of this section or qualifies for exemption from examination in accordance with paragraph (d)(4) of this section. (2) Additional requirements. a. A person who applies for a local certificate of competency as a garage door specialty contractor shall comply with the requirements and qualifications for contractors established in Section 2-6-73 of the Manatee County Code of Ordinances, with the following exceptions: 1. Any person who qualifies for exemption from examination in accordance with paragraph (d)(4) of this section shall not be required to provide written verification of experience in the construction trade set forth in paragraph (b)(5) of Section 2-6-73. 2. Any person who applies for a local certificate of competency as a garage door specialty contractor shall not be required to provide documentation of eligibility requirements set forth in paragraph (b)(6) of Section 2-6-73. 3. Any person who qualifies for exemption from examination in accordance with paragraph (d)(4) of this section shall not be required to provide evidence of the examination scores set forth in paragraph (b)(8) of Section 2-6-73. 3
b. In addition to the eligibility requirements specified in subparagraph (d)(3)a. of this section, any person who does not qualify for exemption from examination in accordance with paragraph (d)(4) of this section shall provide written verification of two (2) years of experience in the construction trade as required by paragraph (b)(5) of Section 2-6-73 of the Manatee County Code of Ordinances. (3) Examination. a. A person shall be eligible to take the garage door specialty examination if the person meets the eligibility requirements according to one (1) of the criteria established in section 489.111(2)(c)1., 489.111(2)(c)2., or 489.111(2)(c)3., Florida Statutes. b. An applicant shall receive a minimum score of seventy-five (75) percent on the garage door specialty examination and on the business and law examination prepared, proctored and graded by a nationally recognized testing service. (4) Exemption from examination. Any person who meets both of the following criteria shall be exempt from the requirement to take the garage door specialty examination and the business and law examination: a. Such person provides documentation that he or she obtained a local certificate of competency as a garage door specialty contractor from another county or a municipality in the State of Florida on or before October 1, 2013; and b. Such person provides evidence that he or she was doing business as a garage door specialty contractor in Manatee County on or before October 4
1, 2013. Section 2. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, the invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared severable. Section 3. This ordinance shall take effect on October 1, 2013.
