EMD :- The firm is required to enclose Earnest money as indicated above in the form of call deposit/demand draft/fdr of any scheduled bank issued in favour of the General Manager, ANIIDCO. Tender document of such tenders who do not deposit EMD in the above manner shall be summarily rejected. 5

2. Tenderers should submit the following documents along with the tender document i) Copy of Experience certificate of having executed similar work of single value not less than the amount equal to 80% of the estimated cost or two works costing not less than the amount equal to 50% each of the estimated cost or three works costing not less than the amount equal to 40% each of the estimated cost, during the last five years ending 30.09.2015. ii) Copy of Valid Contractor Registration Certificate. iii) Copy of PAN Card. iv) EMD as at Clause 1 of terms and conditions. v) Copy of Registration certificate of EPF if any, and if not declaration to be submitted that EPF may be deducted as per rules. vi) Demand draft of ` 150/- in case the tender documents are downloaded from the website. 3. Performance Guarantee : An amount of 5% of the total Work Order value shall be deposited within 15 days from the receiving of Work Order, in the form of call deposit/demand draft/ Bank Guarantee/FDR of a scheduled bank or Sate Bank of India which will be released immediately after the completion of job. 4. Security Deposit : SD Amount of 5 % of the value of the work shall be deducted from the running account bills and the same will be released only after six months of completion of work. 5. The contract is item rate contract. The contractor has to quote item rate to attend all the works as per the schedule of quantities of tender document after inspecting the site and understanding the nature of work. 6. The contractor should have Registration under EPF Act; failing which he shall furnish a list of employees engaged for the awarded work for making of payment of running account bill or final bill and the same shall be remitted to the EPF authority by ANIIDCO. 7. Payment shall be made on actual measurement basis over the quoted rate per item. 8. Any type of advance payment shall not be provided by ANIIDCO. 9. The terms and conditions governing tender and the specifications for the execution of relevant work have been stipulated in the tender documents. 10. Validity of Tender : 04 Months from the Date of Opening of Tender. 11. Tender shall be opened on 20.10.2015 at 03:30 PM In presence of attending tenderers, If the date of opening of the tender happens to be a Bandh or holiday, the tender will be opened on the next working day at the same time and place. 12. ANIIDCO reserves the right to accept or reject any or all tenders at their sole discretion without assigning any reason whatsoever. The tenderer shall ensure that completed tender is delivered to or dropped in the tender box provided at the premises of ANIIDCO, Vikas Bhawan, Port Blair on or before the closing hours as mentioned in tender document. PART-I: INSTRUCTIONS TO THE BIDDER (General Rules and Conditions for the guidance of contractor) 1. All works proposed to execute by contract will be notified in a form of invitation of tenders, either in the newspapers or by pasting those in the notice board of ANIIDCO. Such tender notices shall be signed by the General Manager, or any other competent authority. In addition, Tender will be hosted in the website www.and.nic.in 2. This form will state the work to be carried out, the date for submitting and opening tenders, the time allowed for the completion of work, amount of earnest money and the mode of deposit, rate of deduction of security deposit, specifications and general conditions to be carried out, designs and layout, schedule of specifications etc. duly sealed and signed for the purpose of identification of ANIIDCO. The form of tender will also state the price of tender documents and the dates and time allowed for obtaining the same. 3. In case, the tender being submitted by a firm, it must be signed separately by each partner. In the event of the absence of any partner it must be signed on his behalf by person holding a power of attorney authorizing to do so. Such power of attorney to be produced with the tender and it must disclose that the firm is duly registered under The Indian Partnership Act. The firm must also submit the original or attested true copies of their registered deed with the tender. 4. Receipt for payment made on account of work, when executed by a firm must also be signed in the name of the firm by one of the partners or by some other persons having authority to give effectful receipts for and on behalf of the firm. 5. Any person/firm submitting a tender should fill up the schedule of specifications with the rates at which he is/they are willing to undertake each item of work. Tenders, which propose any alteration in the prescribed specifications and course of work as well as in the time allowed, or which contain any other conditions are liable to be rejected. 6. The General Manager, or his authorized subordinate officer/representative shall open the tenders in the presence of contractors or their representative who are present at the time and date prescribed for opening the tenders. The amount of the tenders will be entered in the form of a comparative statement. 7. In the event of a tender being accepted, the contractor concerned has to enter into an agreement with ANIIDCO in the form as in Part III of the tender documents, to the effect of carrying out the works as per the terms and conditions lay down by ANIIDCO. 8. The earnest money deposit of the contractors whose tenders are rejected shall be released after finalization/award of tender to successful contractor. 9. The tenderer shall have to abide by the rules and other terms and conditions of the tender up to the completion of the work. 7

10. Overwriting shall not be done anywhere while filling up the tender documents. However correction, if any, shall have to be authenticated by the contractor. 11. The rates and amounts tendered should be quoted in decimal coinage both in figures and words. 12. The contractor will have to sign in each written/printed page of the tender documents in token of having read and clearly understood the nature and value of work to be done and conditions under which to be executed. 13. Please note that this tender document will be the integral part of agreement. Therefore tenderer should adhere the terms and the conditions stipulated in this tender document till the completion of work, if awarded. 14. The Contractor whose near relative are employed in ANIIDCO in a responsible capacity (Assistant Manager & above or equivalent) are not permitted to tender for works in ANIIDCO. 15. Each tenderer may submit a programme of execution in respect of this work, if awarded to him. 16. The site for execution of this work will be available on award of the work. 17. The contractor shall make his own arrangement for the procurement and transportation of all material and machinery required for this work. 18. The tenderer should study carefully and satisfy himself the conditions of the contract, drawings and designs, specifications, site conditions, access to the site, and local rainfall and other climatic condition, nature of surface and surface of soil, character of equipments and facilities directly or indirectly needed during the execution of work, availability of labour and material etc. 8

PART II FORM OF AGREEMENT THIS AGREEMENT IS MADE ON THIS DAY OF... 2015 between The Andaman And Nicobar Islands Integrated Development Corporation Limited a Company registered under The Companies Act 1956 and having its registered office at Vikas Bhawan, Port Blair acting through General Manager, {hereinafter called (ANIIDCO) which term shall where the context admit, include his successors in office and assign(s)} on the one part and...{hereinafter called (The Contractor) which terms shall where the context admit, include his heir(s) and executor(s) administrator(s) legal representatives(s) and permitted assign(s)} on the other part on terms and conditions hereinafter set forth. 9

WHEREAS M/s... having office/resident of representative through its proprietor namely.. the Contractor has agreed to execute the job/jobs in connection with the work of Extension of chamber of General Manager in Basement Floor, ANIIDCO Office Complex, Vikas Bhawan, Port Blair as specified in conditions in accordance with the specifications, terms and conditions hereinafter mentioned in the tender notice, specification, general rules and directions for the guidance of the contractor, work order etc. forms part of this agreement. AND WHEREAS an agreement is required to be executed by and between the parties hereto that unless there is something repugnant in the subject or context, words used in this agreement shall have the meaning respectively assigned to them and singular shall include plural and vice-versa. 11

[[[[[[[ PART- III : ITEM RATE TENDER FOR WORKS To General Manager, ANIIDCO Ltd., Port Blair. Sir, I/We hereby submit the item rate tender to execute the work particulars of which are given below within the specified time at the quoted rates in the schedule of specification for each item of work and in all respects according to the designs, specifications, instructions, terms and conditions etc. stipulated in the contract documents and in all respect in accordance with the amendment to such conditions, if any, made by ANIIDCO from time to time for the prompt execution of the work. PARTICULARS OF WORK 1. Name of Work : Extension of chamber of General Manager in Basement Floor, ANIIDCO Office Complex. 2. Situation of Work : Vikas Bhawan, Port Blair. 3. Brief description of work : As per tender document. 4. Earnest Money Deposit : ` 1,254 /- (To be paid through Demand Draft/ or in the form of Call deposit pledged in the name of General Manager, ANIIDCO Ltd.) 5. Security Deposit : The security deposit will be 5% subject to a maximum of ` 5 lakh 6. Time of Completion : 15 Days. The amount of security deposit may please be collected by deducting from the running account bills of work at the rates mentioned above and earnest money deposit along with the tender may also please be adjusted in the security deposit (treated as part of the security deposit). Time allowed for the completion of this work in all respects, should commence from third day after the date of signing of agreement or the date of issue of work order to start the work which ever is earlier. The time allowed shall be inclusive of monsoon. Should this tender be accepted I / We hereby agree to abide by it and fulfill all terms and conditions of this contract annexed hereto so far as applicable and or in default thereof to forfeit and pay to ANIIDCO to The Managing Director, or his successors in office the sum of security deposit mentioned above and in the contract documents. 13

A Sum of Rs. (Rupees.... only) obtained on deposit at call pledged in the name of ANIIDCO with the bank is enclosed to prove the deposit of earnest money. If I/We fail to commence the work specified above at the prescribed time, I/We agree that The Managing Director, or his successors in office shall without prejudice to any other rights or remedies be at liberty to forfeit the said earnest money absolutely otherwise the said earnest money shall be retained by him towards the security deposit mentioned in clause 2(a)..day of.. PART- IV: DETAILS OF WORK AND GENERAL CONDITIONS 1. The work to be undertaken is for the work of Extension of chamber of General Manager in Basement Floor, ANIIDCO Office Complex, Vikas Bhawan, Port Blair. 2. The time limit allowed for the completion of this work is 15 days, which will be reckoned from the fifteenth day after the date of issue of work order to commence and the work order will form an integral part of the agreement. 3. The contractor will have to sign on each page of the tender document in token of having read and clearly understood the nature and value of work and all the conditions under which the work is to be executed. 4. The contractor should not block any existing road / path by dumping/ staking materials or by any means. 5. The contractor should study the site conditions and understand the nature of works involved and chalk out his programme of execution. The programme of execution of work should be intimated to The Engineer-in-charge of the work well in advance. 6. The designs / specifications incorporated are tentative and subject to modifications according to the site conditions. In case of any modification, copies of the detailed and modified drawings / specifications shall be supplied to the contractor free of cost from ANIIDCO. 7. High standard of workman ship in all the trades are required and the contractor should ensure that only skilled and experienced tradesman are employed. 8. Contractor will have to make its own arrangements for the procurement / collection and transportation of materials etc. required for this work. 9. On completion of the work, the contractor should dismantle all the hutments, clear of the rubbish and handover the work and site in good condition. The contractor should clear all the residue materials belonging to him from the site of work before handing over the work. 10. The security deposit of the contractor of the agreement shall be free to be released to him only after completion of the warranty period from the date of completion or date of taking over the work which ever is later. 11. In case of any dispute the orders issued by The Managing Director shall be competent, final and binding to the contractor. 12. This contract is an item rate contract, the payment will be made to the actual quantity executed and measured. 13. 1% Building Cess shall be recovered from Contractor s bill and will be remitted to A & N Administration.
