COLEMAN: Good morning, Judge. Jennifer Coleman, C-o-l-e-m-a-n, and Maria Augustus for the State. THE COURT: This is set for the State's reply to some filings; is that correct? MS. NIEWOEHNER: Your Honor, I spoke with Mr. Adam this morning, and he is asking to set this matter for a hearing. He was asking if it works with the State and with the Court for Thursday, October nd. MR. NIEWOEHNER: Okay. THE COURT: I want a written reply. MR. NIEWOEHNER: Okay. THE COURT: So when we have a hearing on this matter we will -- the State will know exactly where you are. The reply will be limited to of course what's in the response. Now, how much time will Mr. Adam need for the reply? MR. NIEWOEHNER: Your Honor, he was asking for -- THE COURT: That's for hearing. You want to try to get a hearing date? MR. NIEWOEHNER: Right. THE COURT: Actually, he can file it here. It should be some judges left in the building. THE COURT: Going back to the State if after I read the response -- the motion to the response if I think there is a hearing that's necessary I will so indicate, but right now I need a reply. MR. I have two parole hearings but obviously Ms. Augusta -- THE COURT: Maria will file that. She's real competent for the filing. That's okay. You won't be insulting me if you don't show up. THE COURT: We are probably in -- although this is a high priority case in terms of the length of time I've had it on these issues, we will try to get this done in December. It's scheduled for December. If that doesn't work out with the parties -- MS. COLEMAN: In terms of the trial? THE COURT: The trial? MS. COLEMAN: Are you talking about for trial or hearing? THE COURT: I'm talking about possible hearing on the motion. MR. NIEWOEHNER: Yes, your Honor, I will let Mr. Adam know. THE COURT: Defense, anything else? MR. NIEWOEHNER: Nothing else. MS.
