1 1 1 1 1 1 0 1 STATE OF ILLINOIS SS. COUNTY OF COOK IN THE CIRCUIT COURT OF COOK COUNTY COUNTY DEPARTMENT-CRIMINAL DIVISION THE PEOPLE OF THE STATE OF ILLINOIS, Case No. 1 CR -01 Plaintiff, VS RYNE SANHAMEL, Defendant. REPORT OF PROCEEDINGS had at the matter in the above-entitled cause before the Honorable WILLIAM H. HOOKS, Judge of said Court on the 1th day of October, A.D. 01. APPEARANCES: HONORABLE ANITA M. ALVAREZ, State's Attorney of Cook County, by MS. JENNIFER COLEMAN and MS. MARIA AUGUSTUS, Assistant State's Attorney, appeared for the People; MR. JOSH NIEWOEHNER, appeared for the Defendant. Sherry L. Jones, RPR, CSR, CRR, RMR Criminal Court Official Court Reporter License No. 0-000 1

1 1 1 1 1 1 0 1 THE CLERK: Ryne Sanhamel. THE COURT: Good morning, your Honor. MR. NIEWOEHNER: Good morning, your Honor. For the record Josh Niewoehner, N-i-e-w-o-e-h-n-e-r, standing up for Sam Adam, Jr., who is counsel of record for Mr. Sanhamel who appears before your Honor. THE COURT: Okay. MS. COLEMAN: Good morning, Judge. Jennifer Coleman, C-o-l-e-m-a-n, and Maria Augustus for the State. THE COURT: This is set for the State's reply to some filings; is that correct? MS. COLEMAN: That's correct, Judge. THE COURT: Let me see what we have got going. Thank you. Defense, are you going to file a reply to this? MR. NIEWOEHNER: Your Honor, I spoke with Mr. Adam this morning, and he is asking to set this matter for a hearing. He was asking if it works with the State and with the Court for Thursday, October nd. THE COURT: Let's see.

1 1 1 1 1 1 0 1 MS. COLEMAN: Judge, I would suggest -- I do think -- THE COURT: We are off the record, please. (Whereupon, a discussion was held off the record. THE COURT: Defense, I want a reply. MR. NIEWOEHNER: Okay. THE COURT: I want a written reply. MR. NIEWOEHNER: Okay. THE COURT: So when we have a hearing on this matter we will -- the State will know exactly where you are. The reply will be limited to of course what's in the response. Now, how much time will Mr. Adam need for the reply? MR. NIEWOEHNER: Your Honor, he was asking for -- THE COURT: That's for hearing. You want to try to get a hearing date? MR. NIEWOEHNER: Right. THE COURT: Actually, he can file it here. It should be some judges left in the building. If not everybody is going to be at this thing -- MR. NIEWOEHNER: Alternatively he mentioned

1 1 1 1 1 1 0 1 October th if that's better. THE COURT: We will see. Actually, I would like to have the reply before we set a hearing. MR. NIEWOEHNER: Yes, your Honor. THE COURT: That's a little too far down the road and I really do not want an oral -- because of the nature of the matter I don't want an oral reply. MR. NIEWOEHNER: Yes, your Honor. THE COURT: Going back to the State if after I read the response -- the motion to the response if I think there is a hearing that's necessary I will so indicate, but right now I need a reply. MR. NIEWOEHNER: Yes, your Honor. MS. COLEMAN: I was going to give you a signed copy. THE COURT: A copy for me and a copy for the file? MS. COLEMAN: Yes. THE COURT: With that being said, Defense, I need -- on the 0th of October I need you or your partner back in court for your reply. MR. NIEWOEHNER: Okay. THE COURT: And at that time I would -- we

1 1 1 1 1 1 0 1 will probably be setting this down for proceedings, and anything the State has concerning Judge Gallagher's schedule I will take into account then of course. MS. COLEMAN: Okay. MR. NIEWOEHNER: That's fine, your Honor. THE COURT: So it's a by agreement date. Now, is there anything other than this reply -- this response that the Defense is filing today? State, do you have anymore discovery on this matter? MS. COLEMAN: No, not today, your Honor. THE COURT: Okay. State, do you have anything else, either one of the State's Attorney, that you need to put of record? MS. COLEMAN: Judge, there is a chance I won't be here on the 0th. I have two parole hearings but obviously Ms. Augusta -- THE COURT: Maria will file that. She's real competent for the filing. That's okay. You won't be insulting me if you don't show up. I know you're in the background somewhere. By agreement /0/01 for reply to Defense's motion to quash and suppress and if you --

1 1 1 1 1 1 0 1 if you can have Judge Gallagher's schedule at that point. MS. COLEMAN: Sure. THE COURT: We are probably in -- although this is a high priority case in terms of the length of time I've had it on these issues, we will try to get this done in December. It's scheduled for December. If that doesn't work out with the parties -- MS. COLEMAN: In terms of the trial? THE COURT: The trial? MS. COLEMAN: Are you talking about for trial or hearing? THE COURT: I'm talking about possible hearing on the motion. MR. NIEWOEHNER: Yes, your Honor, I will let Mr. Adam know. THE COURT: Defense, anything else? MR. NIEWOEHNER: Nothing else. MS. COLEMAN: Thank you, Judge. THE COURT: Have a good day. Nice seeing everybody. Bond to stand. (Whereupon, the above-entitled cause was concluded.
