A. SPECIFIC CONDITIONS 1. Name of Work:- Supply, Installation, Testing and Commissioning of LED based Solar powered self contained Marine Navigational Light beacon at Neil island (1 No.) and Havelock island (6 Nos.). 2. Scope of Work : 2.1 Installation of LED based Solar powered self contained Marine Navigational Light beacon with programmable IALA flash code at the following locations : No. Locations Range Colour A At Havelock Harbour A1 Rosamand Shoal Beacon 5NM White A2 Port Hand Mark No. 4 5NM Red A3 Port Hand Mark No. 6 5NM Red A4 Stbd. Hand Mark No. 5 5NM Green A6 Stove Point 10NM White B Neil Light Beacon 5 NM White 2.2 Transportation of the Navigational Light Beacons to the respective Installation site. 2.3 Installation of the Navigational Light Beacons on the RCC slab of the Nav-Aids structure at a sufficient height above the guard rail to ensure clear visibility of light for safe navigation. Necessary structure to maintain the required height to be made by the Contractor. 2.4 The Base of the Navigational Light Beacons should be grouted with stainless steel nut and bolts. 2.5 All works required for successful installation of the Navigational Light Beacons will be the responsibility o the contractor. 3. The work should be completed within three (3) months. 4. The supplied equipment must contain all accessories required for its complete and effective performance. 5. The equipment after installation should be ready in all aspects for its use. 6. The bidder must assess the scope of work and quote the rate. All materials, labour, Page 2 of 8
stores, tools, technical expertise, Dinghi etc required for undertaking the scope of work will have to be provided by the contractor and should be included in the price offer. No escalation or additional item will be considered after acceptance of rates by PMB. 7. The equipment must be in accordance to the desired specification and if the equipment at the time of delivery is found defective it shall be rejected outright and the firm will have to replace the same with no extra cost. 8. The scope of work undertaken shall be guaranteed for a period of 12 months from the date of completion and its acceptance by PMB. If any defect is noticed during guarantee period, the contractor will have to rectify the defects by repairing / replacing the defective items/spares and put the Navigational Light Beacon into operation free of cost. 9. Payment: a. 100% of Payment will be released on successful completion of the work and its acceptance by PMB. b. After completion of work a pre- receipted bill in duplicate may be submitted to this office for payment. No part payment shall be made 10. Deductions: a. Applicable Income Tax (TDS) b. Liquidated damages as specified in the tender for delay in execution of the work unless otherwise exempted by CPA, PMB for such delay which are of unforeseen nature and /or beyond the control of contractor. B. GENERAL CONDITIONS 1. Sealed tender superscribing Tender No. and Name of Work should reach to Port Management Board, Phoenix Bay, Port Blair 744101, or deposited in the tender box kept at, PMB Administrative Building, Port Blair on or before the last date & time of the receipt of the tender as specified under NIT. The tender received will be opened on the same day at 1600 hr. in presence of tenderer(s), if any. 2. The sealed main tender envelope should contain two covers containing Technical Offer and Commercial Offer separately. Accordingly respective covers should be marked "Technical Offer" or "Commercial Offer" conspicuously. 3. Name & address of the bidder shall be indicated on both Technical and Commercial envelopes. 4. The envelope marked as "Technical offer" should contain the following: i) Tender Document Fee / cash receipt without which tender will not be accepted. ii) Earnest Money Deposit, without which tender will not be accepted. iii) Attested copy of PAN Card of the firm (or) proprietor. iv) Service Tax Registration Certificate. v) EPF Registration Certificate, if applicable else a declaration that the firm is not covered under EPF. vi) Declaration by the bidder that it has not been Banned / Black listed by any Govt. / Semi-Govt/ Public sector undertakings. vii) Declaration by the tenderer in Annexure "A" that none of his / her / their relative is either employed or working in Port Management Board. viii) Documents satisfying eligibility criteria specified under condition no. 6 of the Notice Inviting Tender (NIT). ix) Make, Model, Technical Brochure and IALA certificate of the equipment offered for Installation. x) Tender document (except price bid) duly signed with seal towards acceptance of terms and conditions of the tender. 5. The Commercial offer shall only contain its commercial offer in the prescribed format placed as Annexure "B" of the Tender Document. 6. Except for writing the amount, the bidder should not make any changes / additions / alterations in the printed Tender Documents obtained either through cash or website. 7. ln case any deviation is found in the Tender Document submitted by the tenderer from the published one, the offer shall be rejected, if such alteration is found at later date, the bidder will be liable to compensate PMB the loss occurred due to such alteration and bidder shall be prosecuted for forgery under IPC/CrPC. 8. The quoted price should remain valid for a period not less than three months from the last date of receipt of tender, for its acceptance. 9. The rates should be quoted in figures and words and free from corrections / overwriting. However, if any discrepancy between the rate(s) quoted in figures and words is/are found, the rate(s) quoted in words shall govern. Page 4 of 8
10. The price offer shall be inclusive of all taxes, duties etc and upto delivery/ completion of the work and handing over to PMB, A & N Islands. Therefore, bidders are advised to get familiarized with applicable rate of statutory levies, taxes, duties etc. and quote their offer accordingly. 11. The currency of the offer shall be "Indian Rupee". 12. The "Commercial offer" shall be opened at any time as may be decided by the Chief Port Administrator. However, the date and time of the same shall be intimated to the eligible bidders well before opening. 13. Submission of tender implies that the bidder has read the tender and has made them self aware of the scope, nature and specifications of the works to be performed and agree to all terms & conditions of the tender document. 14. The successful bidder shall deposit an amount equal to 10% of the contract price as performance security in the form of Term Deposit Receipt/Fixed Deposit Receipt/Bank Guarantee from any schedule bank having a branch at Port Blair, Andaman and Nicobar Islands in favour of Accounts Officer, Port Management Board, payable at Port Blair for a validity period as specified in letter of acceptance (LoA). 15. Earnest Money Deposit will be refunded to unsuccessful tenderers within a month after the award of contract. No interest will be allowed on the Earnest Money Deposit from the date of receipt until it is refunded. 16. Time is essence of the contract and any delay shall be liable for penalty except under those circumstances which arise due to any action or situation which can be termed to be beyond control of the contractor. Applicability of such situation or action shall be decided by the Chief Port Administrator, PMB. 17. Penalty for the non-satisfactory performance / delay in execution shall be levied @1.0% per week of the contractual value, subject to a maximum of 10% of the contractual value. 18. The bidders are advised to inspect the site or get familiarize with site conditions, as to the nature of the work (so far as is practicable), the mean of access, the accommodation they may require and in general shall themselves obtain all necessary information as to risk, contingencies and other circumstances which may influence or effect their tender. The bidder deemed to have full knowledge of the site whether they inspects it or not and no relaxation / escalation consequent on any misunderstanding or otherwise shall be allowed. 19. The Contractor shall make all arrangements for travelling, lodging & boarding facilities for workers and all other services required for executing the work on their own cost unless otherwise specifically provided in the tender document. 20. The Contractor shall be responsible for arranging and maintaining at his own cost all materials, tools and plants, facilities for workers and all other service required for executing the work unless otherwise specifically provided in the tender documents. 21. The safety and insurance of both men and material are the sole responsibility of the contractor. Any loss of life/materials/property etc. and also the accident thereof to both men and materials are to be wholly borne by the contractor. The compensation thereto to Page 5 of 8
the men, in the accident occurred at the site of work or while execution of the work etc shall be wholly borne by the contractor. 22. The Contractor should strictly abide by the rules and regulations of Port and adhere to norms of safety for men and material and take necessary prior approval from the Port or concerned authority, if required. Any damage to property caused within the port due to the negligence of the contractor shall have to be compensated at actual. 23. Without prejudice to any of their legal rights, Port Management Board shall have the power to recover the said amount of compensation /damage from money due or, likely to become due to the contractor. The payment or deduction of such damages shall not relieve the contractor from their obligations to complete any other liabilities and obligations under the contract. 24. lf at any time during the period of contract, it is observed that the performance of contractor is not satisfactory, the contract may be terminated in part or in full after serving Notice on the contractor and the decision of PMB on this matter would be final and binding upon the contractor. PMB will be at liberty to get the remaining work under the contract done through other agency at the risk and cost of the original contractor or recover the cost of such execution of work from the contractor, in addition to any other compensation of damage that PMB is entitled to in terms of the other relevant clauses of the contract. 25. Clarification if any required for finalization of tender shall be obtained prior to finalization of the tender. 26. The CPA, PMB, Port Blair reserves the right to reject any or all tenders without assigning any reason thereof. 27. ln case of any dispute between the parties arising out of this contract, that shall be settled amicably by the parties. In case of failure, the same shall be referred for Arbitration to a sole Arbitrator appointed by the Hon'ble Lieutenant Governor (Administrator), Andaman and Nicobar Islands. The decision of the arbitrator so appointed shall be final and binding. The Arbitrator appointed under this clause shall pass award within a period of 6 (Six) months from the date of reference made to him. Subject to aforesaid, the provisions of arbitration and Conciliation Act, 1996 shall apply to arbitration proceeding under this clause. The Arbitration proceeding under this clause will be held at Port Blair. 28. Any unresolved issue shall be subject to the jurisdiction of the competent court at Port Blair. Page 6 of 8

If at any time, it is found that the information given is Incorrect / incomplete, the contract is liable to be terminated without assigning any reason and the security deposit shall be forfeited and legal actions shall be initiated without any prejudice i.e., to the rights of the PMB, Port Blair to debar the firm from entering into future contracts.
