ATLANTIC COUNTY BOARD OF CHOSEN FREEHOLDERS Stillwater Building 201 Shore Road, Northfield, New Jersey 08225 ~ ~ ~ Minutes of Meeting May 23, 2017 CALL TO ORDER OPEN PUBLIC MEETING STATEMENT PRAYER AND FLAG SALUTE ROLL CALL A regular meeting of the Atlantic County Board of Chosen Freeholders was called to order by Chairman Frank D. Formica at 4 p.m., Standard Time, on the above-mentioned date, in the Stillwater Building located at 201 Shore Road, Northfield, NJ. Statement of Open Public Meeting Compliance: Pursuant to the Open Public Meetings Act, Chairman Formica announced that adequate notice of this meeting, as required by said Act, has been published in The Press of Atlantic City, and mailed to The Current, The Daily Journal, The Hammonton Gazette and The Hammonton News; posted on the bulletin boards at 1333 Atlantic Avenue, Atlantic City, the Stillwater Building, 201 Shore Road, Northfield and the County Clerk s Office in Mays Landing. The prayer was led by Freeholder Dase, followed by the flag salute led by Vice Chairman Risley. The following roll call was recorded: PRESENT: Bertino, Carman, Coursey, Dase, Gatto, Kern, Marino and Risley. ABSENT: Formica. A quorum was present. MINUTES OF MEETING April 25, 2017 Freeholder Carman moved and Freeholder Kern seconded a motion to adopt and dispense with the reading of the April 25, 2017 minutes. AYES: Bertino, Carman, Coursey, Dase, Kern, Marino and Risley. NAYS: None. ABSTAIN: Gatto. Vice Chairman Risley opened the public portion for comments regarding any ordinance or resolution presented on the agenda. There were no comments from the public. County Administrator DelRosso stated, as a result of the retirement of Facilities Director Glen Mawby, the Board was introduced to his replacement, Jerry Griffin. County Administrator DelRosso introduced Jerry Griffin s replacement, Dwight Davis and Mr. Davis replacement, Frank Powers. ORDINANCE NO. 15 FINAL READING An ordinance amending Chapter 97, Article XIII of the Atlantic County Code entitled, to add a section to regulate and permit the operation of unmanned aerial vehicles in specific designated areas Freeholder Marino moved and Freeholder Kern seconded a motion to adopt on final reading Ordinance No. 15-2017 amending Chapter 97, Article XIII of the Atlantic County Code entitled Other Recreational Facilities/Activities to add a section to regulate and permit the operation of unmanned aerial vehicles in specific designated areas of the County Park System. Vice-Chairman Risley opened the public hearing at 4:09 p.m. There being no comments, the public hearing was closed to the public at 4:09 p.m..

ORDINANCE NO. 17 FIRST READING Ordinance to effectuate changes to permit Cross Honor Programs at the John F. Gaffney Green Tree Golf Course RESOLUTION NO. 227 Grant acceptance for the continuum of care planning Freeholder Bertino moved and Freeholder Dase seconded a motion to introduce on first reading Ordinance No. 17-2017 to effectuate changes to permit Cross Honor Programs at the John F. Gaffney Green Tree Golf Course.. accept funding through the Continuum of Care for the Homeless Grant from the U.S. Department of Housing and Urban Development in an amount not to exceed $16,488.00 subjected to a County cash match of $4,122.00, for the period commencing January 1, 2017 and terminating December 31, 2017. RESOLUTION NO. 228 Grant application for the Tanning Registration and Inspection Project. submit a grant application to the New Jersey Department of Health and Senior Services for the Tanning Registration and Inspection Project in an amount not to exceed $3,000.00 for the period commencing July 1, 2016 and ending June 30, 2017.. RESOLUTION NO. 229 Amended grant agreement for a Victim Assistance Freeholder Bertino moved and Freeholder Gatto seconded a motion to authorize an amended grant agreement for a Victim Assistance Grant from the New Jersey Division of Criminal Justice, Office of Victim Witness Advocacy for an amended amount not to exceed $354,571.00.. RESOLUTION NO. 230 Amended grant agreement for the Special Child Health Services Program Case Management and the Integrated Systems Medical Home Pilot Project authorize an amended grant agreement with the New Jersey Department of Health, Division of Family Health Services for the Special Child Health Services Program Case Management and the Integrated Systems Medical Home Pilot Project for additional funding in an amount not to exceed $110,000.00 for an amended grant amount not to exceed $225,827.00.. RESOLUTION NO. 231 Authorizing the purchase of natural gas from Direct Energy Business Freeholder Bertino moved and Freeholder Kern seconded a motion to authorize the purchase of natural gas from Direct Energy Business for the total sum not to exceed $350,000.00 as set forth in the contract awarded by Camden County, for the period commencing November 1, 2016 and terminating November 1, 2017..

RESOLUTION NO. 232 Competitive contract renewal for the provision of Older Americans Act Area Plan Services authorize the renewal competitive contract sub-grant agreement with the Alzheimer s Association-Delaware Valley Chapter for the provision of Older Americans Act Area Plan Services in an amount not to exceed $5,838.00 for the term commencing June 1, 2017 and terminating December 31, 2017. RESOLUTION NO. 233 EUS contract to purchase a storage tank pollution liability with terrorism policy with Crum and Forster Specialty Insurance for the Drexel Avenue underground storage tank. Freeholder Coursey moved and Freeholder Bertino seconded a motion to authorize an EUS contract with Glenn Insurance, Inc., to purchase a storage tank pollution liability with terrorism policy with Crum and Forster Specialty Insurance for the Drexel Avenue underground storage tank in an amount not to exceed $1,125.60.. RESOLUTION NO. 234 Supplementing professional services agreements with various attorneys to provide various legal services Freeholder Kern moved and Freeholder Gatto seconded a motion to supplement professional services agreements with various attorneys to provide various legal services at no additional cost for the period commencing January 1, 2017 and terminating December 31, 2017. AYES: Bertino, Carman, Dase, Gatto, Kern, Marino and Risley. NAYS: Coursey. RESOLUTION NO. 235 Amended intergovernmental agreement for the provision of Special Child Health Services Case Management and Integrated Systems Medical Home Pilot Project Freeholder Bertino moved and Freeholder Dase seconded a motion to amend an intergovernmental agreement with the Atlantic County Special Services School District for the provision of Special Child Health Services Case Management and Integrated Systems Medical Home Pilot Project in an amount of $110,000.00 for an amended agreement not to exceed $225,827.00.. RESOLUTION NO. 236 Emergency contract for the repair of the north span lock system on the Dorset Avenue Bridge Freeholder Gatto moved and Freeholder Carman seconded a motion to authorize an Emergency contract with South State, Inc., for the repair of the north span lock system on the Dorset Avenue Bridge for an amount not to exceed $189,000.00. RESOLUTION NO. 237 Bid contract for fire pump replacements at the Canale Fire Training Center Freeholder Carman moved and Freeholder Gatto seconded a motion to authorize a bid contract with Harring Fire Protection, LLC, for fire pump replacements at the Canale Fire Training Center for the total sum not to exceed $132,825.00 to do the work and/or supply the materials as set forth in the contract.

RESOLUTION NO. 238 Bid contract for priority repairs for Mill Road (CR 651), Bridge (A-04) over Absecon Creek in the City of Absecon Freeholder Kern moved and Freeholder Carman seconded a motion to authorize a bid contract with South State, Inc. for priority repairs for Mill Road (CR 651), Bridge (A-04) over Absecon Creek in the City of Absecon for the total sum not to exceed $718,508.00 to do the work and/or supply the materials as set forth in the contract. RESOLUTION NO. 239 Bid contract to provide washer and dryer repair service at various locations Freeholder Gatto moved and Freeholder Kern seconded a motion to authorize a bid contract with M.C.H. Equipment, Inc., to provide washer and dryer repair service at various locations for the total sum not to exceed $105,000.00 for the two year period commencing May 1, 2017 through April 30, 2019. AYES: Bertino, Carman, Dase, Gatto, Kern, Marino and Risley. NAYS: Coursey. RESOLUTION NO. 240 Bid contract with various vendors to furnish and deliver medical supplies authorize bid contract with various vendors to furnish and deliver medical supplies to members of the Atlantic County Cooperative for the sum not to exceed $324,811.26 through the period commencing April 1, 2017 and terminating March 31, 2018 to do work and/or supply the materials as set forth in the contract. RESOLUTION NO. 241 Bid contract to supply janitorial and custodial supplies authorize a bid contract with various vendors to supply janitorial and custodial supplies to members of the Atlantic County Cooperative for the total sum not to exceed $295,174.47 for the term commencing upon notice of award through February 28, 2018 to do the work and/or supply the materials as set forth in the contract. RESOLUTION NO. 242 Bid contract for supplemental plumbing maintenance and repairs Freeholder Gatto moved and Freeholder Carman seconded a motion to authorize a bid contract with Northeast Plumbing Services, LLC, for supplemental plumbing maintenance and repairs for the total sum not to exceed $270,000.00 for the two year period commencing June 1, 2017 and terminating May 31, 2019 to do the work and/or supply the materials as set forth in the contract. RESOLUTION NO. 243 Resolution authorizing purchases off of State contract Freeholder Kern moved and Freeholder Gatto seconded a motion to authorize purchases from the State contract.

Reappointment of Dr. Barbara Gaba to the Atlantic County Workforce Development Board for a term to expire on June 30, 2020. RESOLUTION NO. 251 Roadway solicitation event in Borough of Longport RESOLUTION NO. 252 Roadway solicitation event in Egg Harbor Township Authorizing consent for a roadway solicitation event by Longport Volunteer Fire Company to be held on Ventnor Avenue (CR 629) at its intersection with 29 th Avenue in the Borough of Longport from 8:00 a.m. to 1:00 p.m. on Sunday, May 28, 2017. Authorizing consent for a roadway solicitation event by Egg Harbor Township Law Enforcement Explorer Post #94, Jersey Shore Council Boy Scouts of America at the intersection of Ocean Heights Avenue (CR 559) and Zion Road (CR 615) in the Township of Egg Harbor from 9:00 a.m. to 4:00 p.m. on Saturday, June 24, 2017.

RESOLUTION NO. 253 Roadway solicitation event in Egg Harbor Authorizing consent for a roadway solicitation event by Egg Harbor Township Law Enforcement Explorer Post #94, Jersey Shore Council Boy Scouts of America at the intersection of Ocean Heights Avenue (CR 559) and Zion Road (CR 615) in the Township of Egg Harbor from 9:00 a.m. to 4:00 p.m. on Saturday, July 8, 2017. RESOLUTION NO. 254 Supporting the concept plan connecting the Garden State Parkway pedestrian walkway/bike path to the Somers Point bike path and the Route 52 Somers Point-Ocean City pedestrian walkway/bike path referenced in Somers Point Resolution 49-2017 MOTION TO ADD RESOLUTION NO. 255 TO THE AGENDA RESOLUTION NO. 255 Amending Resolution No. 3-2017 adding the May 30, 2017 Meeting Freeholder Coursey moved and Freeholder Dase seconded a motion to support the concept plan connecting the Garden State Parkway pedestrian walkway/bike path to the Somers Point bike path and the Route 52 Somers Point-Ocean City pedestrian walkway/bike path referenced in Somers Point Resolution 49-2017 (Sponsor: Freeholder Maureen Kern). Freeholder Marino moved and Freeholder Bertino seconded a motion to add Resolution 255 to the agenda. Freeholder Gatto moved and Freeholder Marino seconded a motion to amend Resolution No. 3-2017, adding a meeting of May 30, 2017 and informing the newspapers. County Counsel stated an additional meeting is required to consider a resolution regarding the constitutionality of the Casino Stabilization Act. Mr. Ferguson answered questions posed by the Freeholder Board. REPORTS OF SPECIAL COMMITTEES OF THE BOARD UNFINISHED BUSINESS NEW BUSINESS WRITTEN COMMUNICATIONS AND PETITIONS PUBLIC COMMENTS There were no reports of special committees of the Board. Vice Chairman Risley opened the meeting to the public at 4:55 p.m. Mark Silver, resident of Ventnor, stated he formerly operated nursing homes in Cherry Hill. Recently retired and offered his expertise in saving the County money in nursing home. He also spoke about countywide tax assessment.

Diane Hesley, Linwood and Somers Point Tax Assessor and President of Atlantic County and NJ State Assessors Association. Ms. Hesley explained the role of the assessor and spoke regarding the Gloucester County Assessment Plan. Robert Vance, Somerset County Tax Administrator, explained the tax assessing process in Somerset County. He emphasized that accuracy is important in assessing. Marie Percotchy, former President of the Association of Municipal Assessors, described the Association s function. She also stated the Association has opposed both of Assemblyman Mazzeo s legislation regarding countywide tax assessment. Brian Conover, Assessor for Vineland and Absecon, stated that the County may have a mass exodus if tax assessing is not done properly. He also stated that the airport is a very important asset and should be utilized for cargo flights. There being no further comments, Vice Chairman Risley closed the public portion at 5:40 p.m. GOOD OF THE ORDER There were no comments for the good of the order. ADJOURNMENT Vice Chairman Risley entertained a motion to adjourn the meeting. Freeholder Bertino moved and Freeholder Marino seconded a motion to adjourn the Freeholder meeting.
