VICTORIA JUNCTION BODY CORPORATE ALTERATION / RENOVATION APPLICATION Rules Governing Alterations / Renovations Chapter 1: Definitions Alterations shall be broadly defined as any work involving structural alterations or additions to a section or unit including the removal, creation or modification of a wall or any structural part of the building and shall include work that affects the exterior appearance of a section or unit. Applicant shall be defined as the natural or juristic person who completes this application as the owner or acting as the agent or other persons so authorised to complete this application on behalf of the owner of the sectional title. Contractor shall be defined as the natural or juristic person who the Applicant has contracted to conduct alternations / renovations and shall be interpreted to include any person carrying out alterations / renovations at the behest of the Applicant, including the Applicant themself. Noisy work shall be defined as any work that is audible outside of the unit including but not limited to personnel communication and noise from equipment reverberating through walls and floors. Renovations shall be broadly defined as any internal redecoration or refurbishment of the existing interior of a unit or section including the replacement, removal or creation of internal fittings such as kitchen and other cupboards, sanitary ware, floor coverings etc. Chapter 2: Approval by Trustees 1. Permission for alteration or renovation (hereinafter construction work, work or construction ) within a section or a common property must be obtained from the Trustees in writing (hereinafter the application ) prior to the commencement of any work. 2. In doing so, the Trustees may prescribe any reasonable conditions regarding said construction. 3. The Trustees are empowered to consider each application on its own merits and with due regard to any Municipal bylaws and the interests of other owners and occupants of Victoria Junction buildings. 4. Any permission given by the Trustees for work may be revoked at any stage by the Trustees, at their discretion, should any of the below rules and terms and conditions be transgressed. 5. The conditions set out herein are made in the interest of all who have invested and/or live in Victoria Junction. 6. Applicants must appreciate that their proposed activities may affect others in the building and it is most important that any detrimental impact is kept to an absolute minimum and that, once started; the work is completed expeditiously within the work period applied for. 7. It is the function of the Trustees to ensure that all Applicants act with reasonable and diligent care and with due and proper consideration for the remaining owners and occupants of Victoria Junction buildings. 8. Any application approval granted by the Trustees shall not serve as stare decisis for any other applications granted, of any nature, whatsoever. 9. No application shall be submitted retrospectively. Any application made after the commencement of work shall be noted on the application for consideration by the Trustees. 10. The Trustees shall be the sole and final judge as to whether the work proposed constitutes "Alterations" or "Renovations" as referred to herein. 11. The Trustees may, after considering the work to be undertaken by the Applicant, waiver the requirements for a deposit. The Trustees shall avoid arbitrary application of this waiver as far as reasonably possible. 12. No application shall be granted during the months of November, December and January whatsoever.
Chapter 3: Application Terms and Conditions 13. All internal partitioning changes require Council approval. a. All required approvals shall be attached to this application before the application is granted. b. Council approvals are required mainly due to compliance with Fire Regulations, even a minor partitioning change could have serious ramifications to the fire rational of the building and in turn the Body Corporate insurance. 14. Installation of a safe requires Structural Engineer's approval on the positioning and weight and the said report shall be attached to this application. 15. No air conditioning exterior unit shall be installed in the car park area without the prior written consent of the Body Corporate and owner and / or occupant of the applicable bay. a. Provision must be made for a suitable condensate drain. b. No core drilling is permitted without Body Corporate approval. 16. A deposit of R5,000 for renovations and R8,000 for alterations per room being renovated or altered, either in part or wholly, shall be payable to the Managing Agents with the submission of this application prior to any work commencing. 17. Should the cost of repairs to common property and / or fines levied exceed the value of the deposit, work shall cease immediately until the deposit is replenished. 18. The balance remaining of the deposit shall be transferred to the Applicant once the Building Manager is satisfied that no further penalties are due against the deposit. 19. Applications shall be completed and submitted to the Trustees at least 48 hours before the commencement of work. Chapter 4: Contractor Terms and Conditions 20. The Applicant indemnifies the Body Corporate in respect of any damaged caused to common property, including the lift, either inside or outside the building and will pay costs of repairing or restoring the damages caused during the course of any work. 21. The Applicant is responsible, at all times, for the conduct and actions of their contractor. 22. In the event of a contractor damaging the common areas, the Applicant shall be held liable for the cost of the repairs of such damage. 23. The Applicant shall complete the Contractors Form in full. 24. All contractors shall be treated as visitors into the building and must report to Security at the applicable vehicle entrance on a daily basis for verification based on the completed Contractors Form in order to be granted access to the building. a. All contractors shall present their green barcoded ID book, driver s license or passport when reporting to security for verification. b. No entrance shall be permitted without verification against an acceptable form of identification as listed in s 24(a). c. The presented identity document shall remain on the person at all times for verification. d. No contractor shall utilise the walk-in entrances to enter the premises, only the vehicular entrances shall be utilised for ingress and egress. e. Any contractor found utilising the walk-in entrances shall be regarded as a trespasser. 25. Contractors and their employees / sub-contractors shall remain in the precise area of work. a. Any party found loitering outside their specific area of work shall be escorted off the premises by Security. b. Parties escorted off the property shall be denied future access into the building. 26. All contractors are to be identifiable by either uniform or signage bibs at all times, failing which they will be removed from the building. Chapter 5: Construction Work Terms & Conditions 27. No noisy work shall be carried out without the Applicant indicating the intention to carry out said noisy work. 28. Approved noisy work shall only be carried out on weekdays between the hours of 9:00 and 14:00. Only emergency work (work required to prevent substantial damage to property) may be carried out outside of these times. 29. The Applicant shall ensure all debris is removed from the premises daily.
30. No debris may be stored in any common areas without Trustee approval. 31. All building material or equipment left on the premises after the expiry of the contract will be removed and disposed of within 24 hours at the expense of the Applicant. 32. The Applicant shall notify the Trustees if essential services i.e. water and electricity need to be disconnected 24 hours before the work is to take place. 33. The use of fire hoses reels other than to extinguish a fire is strictly forbidden. a. The Applicant shall be held responsible for the cost of servicing the used fire hose reel and for a fine of R 1,000 per offence. 34. Persons not adhering to this code of practice will not be granted entrance into the building by Security. 35. Any contractor that commences building work without adhering to the above shall be stopped and escorted off the premises. 36. It is the responsibility of the Applicant to notify surrounding residents timeously of the proposed work schedule. 37. Only the goods lift in building 2 may be utilised for work. 38. The goods lift may only be utilised to convey goods and may not be utilised to convey contractors only. 39. Only wheelbarrows with pneumatic tyres may be utilised on the common property. 40. Contactors shall ensure common property is cleaned before vacating the building. The Building Manager reserves the right to levy fines against the Applicant for failure to ensure the cleanliness of common property. 41. Body Corporate electricity may not be used except with the written permission of the Trustees in which latter case shall be assessed for the electricity consumed for the account of the relevant Applicant. 42. Excessive use of the lift during alterations will reflect in a substantial increase in the electricity charges accruing to the Body Corporate's electricity account for the period. The increase in the number of units of electricity consumed will be charged to the relevant Applicants account together with an estimate pro-rata charge to cover additional wear and tear and maintenance of the lift equipment and machinery. Chapter 6: Fines and Deposits 43. None-refundable fine for exceeding the duration of work permitted by the Trustees: a. 5% of the initial deposit shall be levied per day that work continues past the approved date of completion. 44. None-refundable fine for commencing work without approval: a. R5,000 for renovations and R8,000 for alterations per room being renovated or altered, either in part or wholly. b. 25% of the fine levied in s 44(a) for each day that work continues without Trustee approval. 45. None-refundable fine for commencing or continuing work outside of the approved hours stipulated in s 27: a. 10% of the current deposit balance for each noise complaint received. 46. None-refundable fine for utilising common property equipment including, but not limited to, fire hoses for the purpose that they are not intended: a. R1,000 per offence and the cost of certifying the fire extinguishing equipment. 47. Deposit for security against damages to common property and fines: a. A deposit of R5,000 for renovations and R8,000 for alterations per room being renovated or altered, either in part or wholly. b. Only the remaining balance of the deposit, after deduction of fines and / or damages, shall be reimbursed.
