No.28468-A Digital Official Gazette, Tuesday February 20 th, 2018 RESOLUTION JD No.003-2018 THE BOARD OF DIRECTORS OF THE PANAMA MARITIME AUTHORITY, in use of its legal powers, and WHEREAS: That by Law Decree No. 7, of February 10 th, 1998, is created the Panama Maritime Authority, and various maritime entities of the public administration were unified and it was established among its functions to: propose, coordinate and execute the National Maritime Strategy; recommend policies and actions, execute administrative acts; and enforce the legal and regulative standards with regard to the maritime sector; and to monitor the strict compliance of the established in treaties, conventions and international instruments ratified by the Republic of Panama, related to the maritime sector. That according to the established in Article 4, Numeral 3 of Law Decree No. 7 of February 10 th, 1998, beside other functions, the Panama Maritime Authority is authorized to regulate the measurements in order to protect the national interests of the maritime spaces and inner waters. That inside the organic structure it is found the General Directorate of Seafarers, body of administrative services and program execution, which its functioning and internal organization are adjusted to the specified in the Law Decree No. 7 of February 10 th, 1998 modified by Law No. 57 August 6 th, 2008 and in addition, in the regulations that are dictated in its development. That the article 7 of Law Decree No. 8 of February 26 th, 1998, establishes that all seafarers on board of a Panamanian flag vessel, must have a certificate of competency issued by the Panama Maritime Authority in compliance with the national laws, authorizing its owner to execute the functions of the described position in the mentioned certificate. That Numeral 3 of Article No. 18 of Law Decree No. 7 of February 26 th, 1998 establishes that it belongs to the Board of Directors of the Panama Maritime Authority to adopt the administrative, scientific and technological policies to promote and ensure the competitiveness and profitability of the maritime sector and the development of their human resources; to structure, to rule, to determine, to set, to change and to impose taxes and tariffs for the services rendered by the Authority. That the Resolution J.D. No.012-2005 of July 26 th, 2005, creates the Evaluation Committee as an entity attached to the General Directorate of Seafarers, whose function is the study of the applications submitted by natural persons to whom irregular or doubtful documentation has been detected. That the Resolution J.D. No.036-2017 of September 28 th, 2017, approved the minimum requirements for the issuance of seafarers Certificates, who work in jurisdictional waters of the Republic of Panama aboard of Panamanian flag-vessels. That by virtue of the foregoing and in order with the purpose to regulate the technical documentation and the issuance of certificates of competency for seafarers working on jurisdictional waters of the Republic of Panama, the Board of Directors of the Panama Maritime Authority, using the faculties conferred by the Law Decree No. 7 of February 10 th of 1998, BE IT RESOLVED: FIRST: TO ADD the following article to Resolution J.D. 036-2017 of September 28 th, 2017 that will correspond to article sixth: SIXTH: Every seafarer engaged in the transport of passengers must provide, in addition to the requirements established in Article Four, original of narcotics tests, reflecting negative results. The competent authority may carry out random tests of alcohol and drug consumption, when it deems necessary.

No.28468-A Digital Official Gazette, Tuesday February 20 th, 2018 For alcohol tests the following Chart will be considered: QUALIFICATION LEVEL OF ALCOHOL CONCENTRATION PROCESS BLOOD BREATH (Milligrams per deciliter) (micrograms per deciliter) Tolerance Level 10-50 5-24 Warning Alcoholic breath 21-85 25-40 Sanction with fine (*) Proven drunkenness 86 or more 41 or more Sanction with fine and withdrawal of license (**) (***) (*) For alcoholic breath the penalty will be one hundred balboas with 00/100 (Bl.100.00) (**) For drunkenness checked for the first time, a fine of one hundred and fifty balboas with 00/100 (Bl.150.00) will be applied, the license will be withdrawn and will be suspended for a period of three (3) months. (***) For drunkenness checked for the second time, a fine of two hundred and fifty balboas with 00/100 (Bl.250.00) will be applied, the license will be withdrawn and will be suspended for a period of six (6) months. (****) In case of recidivism in the period of one year, the seafarer will be sanctioned with the cancellation of the license and will not be able to request a new license, within two (2) years. In all cases of license retention and suspension, the cost of the fine must be paid to proceed with the devolution of the license. If the drug test is positive, the seafarer will be sanctioned with the cancellation of the license and will not be able to request a new license, within two (2) years. SECOND: TO ADD the following article to Resolution J.D. 036-2017 of September 28 th, 2017 that will correspond to article seventh: SEVENTH: Any seafarer who holds a license of jurisdictional waters of the Republic of Panama will be subject to random tests of alcohol and narcotic drugs, which will be carried out by the competent authorities in the National Ports, when they deem it necessary. If the test or tests are positive, the competent authority will withdraw the license from the seafarer, and it will be sent to the General Directorate of Seafarers of the Panama Maritime Authority, who will proceed with the corresponding sanction. THIRD: By virtue of the foregoing, Articles Sixth and Seventh of Resolution J.D. 036-2017 of September 28 th, 2017, will pass to be Articles Eighth and Ninth respectively.

No.28468-A Digital Official Gazette, Tuesday February 20 th, 2018 FOURTH: TO EMPOWER the General Directorate of Seafarers to sanction, penalize, suspend, cancel, revoke or withdraw the Certificate issued by the Panama Maritime Authority, when it is given for a justified cause. FIFTH: This Resolution shall enter into force from its publication in the Official Gazette of the Republic of Panama. LEGAL BASIS: Law Decree No.7- February 10 th, 1998 and its amendments.
