Excerpts from Chapter 1 of the Elder Law Resource Guide Advance Directives http://www.illinoislegalaid.org/ Advance Directives Advance directives refer to any statement of your future wishes should you become mentally incapacitated. In this chapter, three specific kinds of advance directive documents will be discussed: the Health Care Power of Attorney, the Living Will, and the Power of Attorney for Property. These documents have been selected because they are the most commonly used. In addition, Illinois law has created form documents which, when properly drafted, must be honored by hospitals, banks, etc. The importance of using the statutory forms will be discussed further below. Why draft advance directives? We can become mentally incapacitated at any point in our lives regardless of our age. For instance, if you were to be hit by a car and lose consciousness today, you would need someone to make medical decisions for you and pay your bills until the time that you regained consciousness. This person would be called a surrogate decision maker. As our life spans have continued to increase, so has the incidence of Alzheimer s and other dementia. In turn, the need for surrogate decision makers has also increased. If you have not drafted advance directives and there comes a time when you cannot make your own decisions the hospital will turn to your family to make decisions or, someone in your family would have to go to court to become your guardian. Likewise, in order to ensure that bills such as your rent or mortgage payments are paid on time, someone will need to become your guardian. The Health Care Surrogate Act and guardianship will be discussed in more detail below. It is important to understand that while these legal options are available, they have a number of disadvantages. The greatest disadvantage is that you do not get to choose the person who will be making your decisions, nor will you have left written instructions on how you would like to be cared for. Additionally, guardianship is a public court procedure that can be time consuming, expensive, and emotionally disturbing to your family. By drafting advance directives now, you can prevent legal problems in the future. The Health Care Power of Attorney The health care power of attorney (HCPOA) is a document that allows you to do two things. First, the HCPOA allows you to identify a surrogate decision maker (known as the agent) to make decisions about your medical treatment and living arrangements if you are no longer able to make these decisions yourself. Second, the HCPOA allows you to indicate what kind of treatment you would like at the end of your life. The Living Will The living will is a much more limited document that only deals with end of life decision making. You only need to complete a living will if you feel strongly that you do not want extraordinary life support measures taken in the event that you have a terminal illness and death is imminent. The Power of Attorney for Property The power of attorney for property (PPOA) is a very detailed document that allows you to designate a person (your agent) to make financial decisions for you if you are no longer able to make these decisions yourself. Do I need to use the statutory forms? There are a number of benefits to using the statutory forms for powers of attorney and living wills. First, these forms comply with Illinois law and other, more general forms, may not. For instance, other forms may indicate that you can choose one or more agents to make your health care decisions. This is not the case in Illinois where you can only have one agent. Second, when the statutory forms are used, businesses and health care agencies are required by law to honor them or face civil penalties. Finally, the terms in the statutory form are defined in Illinois law. Therefore, in the future when these documents are actually in effect, it will be much more difficult for someone to argue that your intent was not clear. For these reasons, it is strongly recommended that you use the statutory forms for powers of attorney and the living will. Do I need an attorney to help me with these documents? We strongly recommend that you have an attorney assist you with the completion of these documents. The Illinois Health Care Surrogate Act The Illinois Health Care Surrogate Act (HCSA) is a law that takes effect when a person can no longer make his/her own medical decisions, has not drafted a health care power of attorney, and has not had a guardian appointed. Under the HCSA, doctors and hospitals are required to abide by the decision of the surrogate and are required to select the surrogate in the order stated in the Act which is: the disabled person s spouse, if none or if they are unavailable, any adult children, if none or if they are unavailable, any adult siblings of the disabled. If none of these apply, the next options are adult grandchildren, close friends, and finally, the guardian of the estate. Disadvantages of Relying on the Health Care Surrogate Act The designated surrogate may not be the person you would have chosen to make your decisions. (1) If you have two or more possible surrogates (e.g., you have three children or four siblings) they each have equal decision making power and the majority rules. But if they cannot come to an agreement, the family must go to court for guardianship. (2) Many doctors and hospitals are unaware that the Health Care Surrogate Act exists and simply allow the relative present at the time to make health care decisions. (3) Surrogates do not have written guidance on your wishes as they would have if you complete a health care power of attorney. Therefore, although they are required to make health care decisions as you would have wanted, they might not be aware of your wishes or may find it difficult to comply with them without written guidance. 141

I,, being of sound mind, willfully and voluntarily make known my desires that my moment of death shall not be artificially postponed. If at any time I should have an incurable and irreversible injury, disease, or illness judged to be a terminal condition by my attending physician who has personally examined me and has determined that my death is imminent except for death delaying procedures, I direct that such procedures which would only prolong the dying process be withheld or withdrawn, and that I be permitted to die naturally with only the administration of medication, sustenance, or the performance of any medical procedure deemed necessary by my attending physician to provide me with comfort care. In the absence of my ability to give directions regarding the use of such death delaying procedures, it is my intention that this declaration shall be honored by my family and physician as the final expression of my legal right to refuse medical or surgical treatment and accept the consequences from such refusal. Signed City, County and State of Residence The declarant is personally known to me and I believe him or her to be of sound mind. I saw the declarant sign the declaration in my presence (or the declarant acknowledged in my presence that he or she had signed the declaration) and I signed the declaration as a witness in the presence of the declarant. I did not sign the declarant s signature above for or at the direction of the declarant. At the date of this instrument, I am not entitled to any portion of the estate of the declarant according to the laws of intestate succession or, to the best of my knowledge and belief, under any will of declarant or other instrument taking effect at declarant s death, or directly financially responsible for declarant s medical care.
