Ready, City Manager Office of the City Clerk SUMMARY On June 5, 218, a Special Municipal Election was conducted in the City of Palm Springs for the purpose of submitting to the voters a question of whether to prohibit vacation rentals in single family residences (Measure C). The purpose of this item is to certify the results of that election. RECOMMENDATON: Adopt a Resolution entitled "A Resolution of the City Council of the City of Palm Springs, California, reciting the fact of the Special Municipal Election held in the City on June 5, 218, declaring the results, and other matters as provided by law." BACKGROUND: On June 5, 218, a Special Municipal Election was conducted in the City of Palm Springs for the purpose of submitting to the voters a question of whether to prohibit vacation rentals in single family residences. n accordance with Resolution No. 24382, the Special Municipal Election was consolidated with the Statewide Primary Election that was conducted on the same day by the County. The ballots were counted and the results canvassed and certified by the Riverside County Registrar of Voters (Registrar). A copy of the certified election results is attached to this report. ANALYSS: The attached resolution must be adopted by the City Council to officially declare the results of the election (Attachment 1 ). A Certificate of the Canvass of the Election Returns was provided by the Registrar (Attachment 1, Exhibit A). The following question, which was designated as Measure C, was submitted to the Palm Springs registered voters at the June 5, 218, Special Municipal Election: Yes Shall the City of Palm Springs prohibit vacation rentals in single family 1-----------1 residences? With the number of votes against Measure C reaching 7.6%, the measure does not carry and the proposed Ordinance shall not go into effect. FSCAL MPACT: An invoice describing the costs to conduct the consolidated election with the County of Riverside (County) has not yet been received by the City Clerk's Office; however, estimated costs provided by Registrar for the election was $19,-29,. A RESOLUTON OF THE CTY COUNCL OF THE CTY OF PALM SPRNGS, CALFORNA, RECTNG THE FACT OF THE SPECAL MUNCPAL ELECTON HELD ON JUNE 5, 218, DECLARNG THE RESULTS, AND OTHER SUCH MATERS AS PROVDED BY LAW WHEREAS, a Special Municipal Election was held and conducted in the City of Palm Springs, California, on Tuesday, June 5, 218, as required by law; and WHEREAS, notice of the election was given in time, form, and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received, and canvassed and the returns made and declared in time, form, and manner as required by the provisions of the Elections Code of the State of California and City Charter for the holding of elections; and WHEREAS, pursuant to Resolution No. 24382, the Riverside County Registrar of Voters canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CTY COUNCL OF THE CTY OF PALM SPRNGS, CALFORNA, DOES RESOLVE, DECLARE, DETERMNE AND ORDER AS FOLLOWS: SECTON 1. That the ballot measure submitted to the voters is as follows: Shall the City of Palm Springs prohibit vacation rentals in single family residences? Yes No SECTON 2. That the whole number of ballots cast in the precincts except vote by mail ballots and provisional ballots was 3,285. That the whole number of vote by mail voter ballots cast in the City was 12,95, making a total of 15,38 ballots cast in the City. SECTON 3. That as a result of the election, a majority of voters voting on Measure C relating to the prohibition of vacation rentals in single family residences did not vote in favor of it, and that the measure was not carried, and shall not be deemed adopted and ratified. 3

Resolution No. Page 2 SECTON 4.The City Clerk shall enter on the records of the City of Palm Springs, a statement of the results of the election, showing: (1) The whole number of ballots cast in the City; (2) The measure voted upon; (3) The number of votes given at each precinct for and against the measure; and (4) The total number of votes given for and against the measure. SECTON 6. The City Clerk of the City of Palm Springs shall certify to the passage and adoption of this resolution and its approval by the City Council and shall cause the same to be listed in the records of the City.
