On August 5, 2015, the Official Committee of Unsecured Creditors (the Committee ) of Adinath Corp. and Simply Fashion Stores, Ltd. (the Debtors ) filed a complaint against Defendants in this adversary proceeding styled The Official Committee of Unsecured Creditors v. Swapnil Shah, et, al. (Adv. No. 15-16885-LMI) (the Complaint ) [ECF No. 1]. 2. On August 6, 2015 the Court issued the Summons on the Defendants [ECF No. 2]. Additionally, on August 13, 2015, the Court issued the Amended Summons on the Defendants (the Amended Summons ) [ECF NO. 16]. 3. On August 19, 2015, the Court entered the Order Setting Filing and Disclosure Requirements for Pretrial and Trial [ECF No. 22]. 4. Pursuant to the Amended Summons the deadline for the Defendants to file a response to the Complaint is on or before September 14, 2015. 5. The Defendants request a fourteen (14) day extension of time to respond to the Complaint to on or before September 28, 2015. 6. Good cause exists for this extension as it will allow the Committee and Defendants ample opportunity to discuss the issues in the Complaint prior to Defendants being required to respond to the Complaint. 2

Counsel for the Committee agrees with and joins in requesting the relief sought herein. 9. The Motion is filed without prejudice to the Defendants and without waiving their right to assert any and all defenses in this matter including, but not limited to the defenses of improper venue, jurisdiction, service of process, failure to state a claim, and failure to join all essential parties. 10. Pursuant to Local Rule 5005-1(G)(1)(a), the Defendants attach a proposed Order granting the relief requested herein.
