The General Court finds that none of grounds relied on by Parliament demonstrated that full access to the documents at issue was likely to undermine, specifically and actually, the decisionmaking process at issue. It annuls thus Parliament s decision. Judgement of 17 April 2018 in Case C-441/17, Commission v. Poland The case concerns a plan of active management operations authorised by the Polish Environment Minister because of the constant spread of the spruce bark beetle on the Białowieża forest, a Natura 2000 site and special protection area under the Birds Directive. In particular, in 2016 the Polish Minister authorised, for the period until 2021, almost a tripling of harvesting of wood in the Białowieża forest district alone, and the carrying out of active forest management operations such as sanitary pruning, reforestation and restoration, in areas where any intervention was previously excluded. In its judgment, the Court declares that Poland has infringed the EU law, as it failed to fulfil its obligations arising from the Habitats and Birds directives to ensure that those forest management measures would not adversely affect the integrity of the Białowieża site. 7.5 Documents recently published by the European Court of Auditors The following documents were recently published: Briefing Paper: Future of the Common Agricultural Policy, March 2018 PV\1157422.docx 25/26 PE622.163v01-00
