THE STATE OF SPRINGFIELD 99 TH GENERAL ASSEMBLY LEGISLATIVE SCORECARD 2016

Dear Friends and Partners: Every year, Citizen Action/Illinois examines the voting records of elected officials in the Illinois General Assembly. The Scorecard is a tool created to enable concerned citizens to hold their elected officials accountable for their votes during the year. For 2016, Citizen Action/Illinois selected 14 key votes in the House and 12 key votes in the Senate of the 99th General Assembly for analysis. The second year of the 99 th General Assembly continued a protracted, ideological battle between Governor Bruce Rauner and his GOP allies and the Democrats, who have utterly rejected his reforms known as The Turnaround Agenda. This has led to Illinois longest budget impasse in history, which has severely affected low-income and the disabled communities, health services, and localities across the state. Although a temporary budget was approved in late June to get the state through the rest of the year, there is much more work to be done in securing a fully-funded, fair and honest budget for Illinois. However, in the midst of this protracted battle, there were a great number of other issues being debated and voted on in Springfield. The 99 th General Assembly Legislative Scorecard appropriately exhibits how members of the General Assembly fared on these each of these issues. Though this legislative scorecard is only one indicator of a legislator s performance in Springfield, it is our hope that it will provide citizens with a good gauge of each official s dedication to social and economic justice as well as protecting Illinois consumers. SUMMARIES AND POSITIONS HJRCA 26 (A) Millionaire s Tax Sponsor: Speaker Michael Madigan Failed in House (68-47-0) Needed 3/5 Majority (71 Votes) BILLS SCORED IN THE ILLINOIS HOUSE Summary: This bill would have added an additional 3% surcharge on incomes over $1 million per year, specifically only on each dollar after $1 million. Revenues from this surcharge would be dedicated solely to the use of education funds, dedicated on a per-pupil basis. SB 250 (B) Automatic Voter Registration Sponsor: Sen. Andy Manar; Rep. Robyn Gabel Passed House (86-30-0) Passed Senate (42-16-0) Vetoed by Governor Summary: This bill would modernize Illinois voter registration system by automatically registering citizens to vote when they apply for a driver s license or other state-issued form of identification, with an opt-out option for those whom do not wish to be registered. In tandem, the bill saves the state millions of dollars by updating data information systems and eliminating duplicative systems in voter registration. 9

HB 557 (C) Elected School Board for Chicago Sponsor: Rep. Robert Martwick Passed House (110-4-0) No Action in Senate Summary: This bill would change the City of Chicago s system of mayoral appointments to the governing board of Chicago Public Schools to an electoral system with 20 electoral districts, beginning in 2018. HB 580 (D) Fair Arbitration Legislation Sponsor: Rep. Emanuel Welch; Sen. Don Harmon Veto Override FAILED in House (68-49-1) Veto Override PASSED in Senate (38-17) Override Motion Failed Summary: Legislation which would have provided an alternative to a state employee strike or lockout as a path to resolving contract negotiations by extending the mandatory arbitration procedure for public safety personnel to all workers in the state. Bill was passed by both chambers but vetoed by the Governor, who is seeking to impose pay cuts and benefit reductions on state and university employees. SB 1564 (E) Healthcare Right of Conscience Act Sponsor: Rep. Robyn Gabel; Sen. Dan Biss Passed House (61-54-0) Passed Senate (2015) (34-19-0) Signed into Law by Governor 10

Summary: This bill would have enacted a set of reforms related to women s healthcare, which includes a woman s right to proper medical information and referral from their primary doctor if she is seeking services that the current medical provider does not provide due to their personal beliefs. SB 2043 (F) MAP Grant Restoration Sponsor: Sen. John Cullerton; Rep. Kelly Burke Veto Override FAILED in House (69-48-0) Veto Override PASSED in Senate (37-17-2) Override Motion Failed Summary: This bill would have restored a total of $397 million to Monetary Award Program that was cut under the Rauner budget and added an additional $274 million for community colleges throughout the state. MAP grants typically are awarded to low and middle-income families to help subsidize the ever-escalating costs of higher education. The Governor vetoed this bill. SB 2465 (G) State Prison Criminal Justice Reform Sponsor: Sen. Dan Biss; Rep. Kelly Cassidy Passed House (60-54-0) Passed Senate (32-19-1) Vetoed by Governor Summary: This bill prohibits the Illinois Department of Corrections from suing inmates to recoup the cost of their room and board during their detention, which tends to target the poorest of inmates and create high rates of recidivism. 11

Emanuel Welch Passed House (117-0-0) Passed Senate (53-0-0) Signed into law by Governor Summary: This bill would amend the Illinois Wage Assignment Act and bring the state into federal compliance by requiring that consumers are made aware of their ability to revoke wage assignment, which is a method used by payday and auto title loan companies to tap into a consumer s paycheck in order to force repayment. SB 2931 (I) Homecare Workers Wage Increase Sponsor: Sen. Michael Hastings; Rep. Sonya Harper Passed House (67-44-2) Passed Senate (34-16-0) Vetoed by Governor Summary: This bill would require that the State of Illinois pay contracted homecare workers and personal assistants for those with disabilities a $15/per hour wage rate, which is consistent with a living wage here in Illinois. HB 4036 (J) Victims Economic Security and Safety Act - Update Sponsor: Rep. Camille Lilly; Sen. Toi Hutchinson Passed House (73-42-0) Passed Senate (40-14-0) Signed into law by Governor 12

Summary: This bill amends the existing VESSA law to stipulate that all employees, not just those of companies with more than 49 employees or more, have the right to up to 12 work weeks of leave for those victims of sexual or domestic abuse. HB 4351 (K) DON Score Protection Sponsor: Rep. Greg Harris; Sen. Dan Biss Passed House (68-40-2) Passed Senate (35-18-1) Vetoed by Governor Summary: Ensures that the state s Determination of Need (DON) for Medicaid and other critical health services is kept in place at 29 and cannot be unilaterally raised by the Governor or other entities. Also ensures that when a new assessment tool to determine need is implemented, those that become ineligible due to new criteria are still able to access services for up to 11 months. HB 4633 (L) Unclaimed Life Insurance Sponsor: Rep. Robert Martwick; Sen. William Haine Passed House (75-34-0) Passed Senate (54-0-0) Signed into law by Governor Summary: An initiative spearheaded by Treasurer Mike Frerichs, this bill would bring Illinois into the fold with 18 other states in protecting consumers from bad-apple actors in the Life Insurance industry. This bill requires that all 13

companies make good faith efforts to match their list of policyholders against federal death records as well as report any unclaimed benefits to state authorities. HB 5576 (M) Illinois Contraceptive Coverage Act Sponsor: Rep. Elaine Nekritz; Sen. Toi Hutchinson Passed House (61-52-0) Passed Senate (35-22-0) Signed by Governor Summary: Guarantees coverage without cost-sharing for all FDA-approved contraceptive drugs, devices and supplies. Prevents insurance companies from using schemes to prevent access to the most effective forms of birth control. HB 5736 (N) All Kids Health Program Extension Sponsor: Rep. Elizabeth Hernandez; Sen. Iris Martinez Passed House (77-38-0) Passed Senate (44-12-0) Signed by Governor Summary: This bill extends the repeal date of the All Kids Health Insurance Program in Illinois from July 1, 2016 to July 1, 2019, thus ensuring that 41,000 low-income children will not lose access to the healthcare they need. 14
