Use and Development Commitment APC Form 2501REZ PROCEDURE FOR FILING PETITION FOR COUNTY REZONING 1. At the Area Plan Commission office (Room 312) or by phone or e-mail: A. Talk with staff, and determine what zoning you need for the intended activity. Staff can provide information regarding the lists of uses permitted in any specific zoning classification being requested. In many instances, it may be advisable to file a Petition for County Rezoning (petition) that includes a use and development commitment. This is not mandatory. Staff will be happy to discuss the pros and cons of the use and development commitment with you. B. Receive packet containing forms, directions, meeting schedule/filing deadlines, Petition for County Rezoning (petition), County Rezoning Ordinance (ordinance), sample site plan/instructions, Notice of Public Hearing (letter) and County Rezoning Affidavit of Notice (affidavit). The complete rezoning packet is available on-line on our website at www.evansvilleapc.com. A complete copy of the County zoning ordinance is also available at the following website: www.codepublishing.com (Title 17 Zoning) Approved by the Area Plan Commission on 12/14/2017 Page 1 of 5

2. A. Fill out one copy of the provided forms (petition and ordinance). For the sake of simplicity and uniformity, all petitions, plus the affidavit of notice, must be completed on the forms/in the format provided by the Area Plan Commission office. Draw a site plan on 8 ½" x 11" paper, detailing all existing and/or proposed conditions on the property which is the subject of your petition. (OPTIONAL: if you plan to file a County Rezoning Ordinance With Use and Development Commitment, it is suggested you discuss the proposed use and development commitment with staff prior to filing.) B. Bring the completed petition, ordinance (or ordinance with the use and development commitment, if applicable), and site plan to the Area Plan Commission (APC) office so that the staff can check the documents and make sure all of the required information is included. Staff will prepare a location map for you, check your legal description, and check the site plan. The OWNER OF RECORD and the Petitioner must both sign the Petition for County Rezoning. (If the rezoning includes a use and development commitment, the CURRENT OWNER OF RECORD must sign the document.) If the owner of the property is a corporation or similar entity, Area Plan Commission may require proof of the Owner s right to sign legal documents on behalf of the corporation or entity. If the corporation or entity cannot be verified by a business entity name search through the Indiana Secretary of State Business Services Division, proof will be required that the corporation or entity is valid. 3. Take the completed ordinance page or ordinance with use and development commitment page to the Evansville Courier Company legals desk to determine the amount that you will be charged at the time of publication. They are located at the northeast corner of Heidelbach Avenue and Walnut Street. They will give you a printed sample of your proposed legal, and will include the estimate of the cost for publication. (DO NOT PAY THEM.) This fee in the form of a certified or cashier's check - is held in the County Auditor's office pending the approval of your petition. It is refunded if the petition is denied or withdrawn. 4. Sending a certified letter/notice of Public Hearing (with a green return receipt) to the owners of all abutting properties is a requirement for rezoning petitions. You must have your copy of the certified letter receipt (green and white receipt) filled out completely and stamped by the Post Office at the time that you mail the notice. There is a sample letter/notice of Public Hearing included in the rezoning packet. DO NOT SEND THE LETTER OF NOTICE UNTIL AFTER YOU ARE OFFICIALLY FILED AND HAVE DOCKET NUMBERS!! The certified letters of notice must be postmarked on or before the deadline shown on the Application Deadline and Meeting Schedule attached. For clarification, abutting property is defined as any property which would touch at any point the owner s property included in whole or in part in the ordinance for rezoning, including across streets, alleys, and easements, etc. Therefore, owners across streets, alleys, easements, must also be notified. You are also required to send a certified letter of notice to any registered neighborhood association that includes the rezoning area and/or is adjacent to the rezoning area. You must check with the County Commissioner s office for this information. (The neighborhood association(s) are noted on the petition and added to your list of abutting property owners to which you will mail notice of the hearing.) Names and addresses of abutting property owners may be obtained by several means. It is now possible to obtain up-to-date information on-line by identifying the properties on the GIS maps. Identify each property and take the link provided to get to the Assessor s web page. Once you get to the Assessor site, there is a tab about half-way down the first page that states taxes. When you click on the taxes link, it will take you directly to the Treasurer s website where you can obtain the official and most recent OWNER AND MAILING ADDRESS OF RECORD. In person, you may obtain the tax codes and official owner of record at the Assessor's office, and then take the tax codes to the Treasurer's Office for the owner s official mailing address of record. (Be SURE to tell the Treasurer s office that you need the CURRENT most UPDATED owner of record!) When doing your list in this manner, you will find that occasionally the names of the owners of record in the Assessor s office do not correspond with the names on the Treasurer s records; if this situation occurs, obtain information on both parties. (Please bring any irregularities or problems to the attention of APC staff.) 5. Make 5 copies each of the petition, location map, ordinance (or ordinance with use and development commitment, if applicable), and site plan. Staple them together in the order as listed above. Bring these packets to the Area Plan Commission office along with one copy of your list of abutting property owners; include the tax code, name, and official mailing address of record of each abutting property owner. Pay the filing fee to Area Plan Commission, and receive your Plan Commission docket number for the project which shall be referenced by both the applicant and staff on all subsequent documents/communications for the project and a sign to be posted on the property. PLEASE NOTE: THE ORDINANCE PAGE MUST BE COPIED WITH SPACE AT THE BOTTOM AND SPACE AT THE TOP OF THE PAGE. IF YOUR LEGAL DESCRIPTION DOES NOT FIT WITHIN THE SPACE PROVIDED, YOU WILL NEED TO ATTACH A SEPARATE PAGE (OR PAGES) TO THE DOCUMENT. IT IS SUGGESTED THAT YOU UTILIZE 8 ½ X 14 (LEGAL SIZE) PAPER FOR THE ORIGINAL PACKET FOR THE ORDINANCE PAGE. THIS DOCUMENT MAY BE SHRUNK TO LETTER SIZE FOR THE 5 COPIES. 6. Deliver to the County Auditor s office: A. 5 completed packets (It is suggested that you make one extra copy to keep, and have your copy file stamped.) B. CERTIFIED or CASHIER S checks for: i. The cost of publication - made out to the Evansville Courier Company, and the estimate/sample obtained from the Evansville Courier Company. ii. The recording fee of $25.00 made out to the Vanderburgh County Recorder. If all the information is correct, you will be placed on the County Commission agenda for first reading. (First reading by County Commission is required before the Petition for County Rezoning may be heard by the Area Plan Commission. It will not be necessary for you to appear at this meeting.) The County Auditor will assign your REZONING ORDINANCE a docket number for County Commission hearings, and will file stamp each copy. The County Auditor will send you back to the Area Plan Commission office with 3 file-stamped copies of your Petition for County Rezoning to complete your filing of your rezoning petition and enable the Area Plan Commission to proceed with your rezoning. The Area Plan Commission Staff shall: A. Review the sufficiency/completeness of the submittals, and within 3 working days from the filing date, inform the applicant of the sufficiency status of the application based on the evaluation of the information provided. B. If the application is determined to be sufficient, assign a meeting date for the application to be considered by the Area Plan Commission. C. If the application is determined to be insufficient, the applicant shall be notified of the required information that is lacking, and the application must be resubmitted and pass a sufficiency review, before an Area Plan Commission hearing date is assigned. BEFORE YOU ATTEND THE AREA PLAN COMMISSION MEETING COMPLETE THE FOLLOWING STEPS: 7. AFTER FILING, and you have been notified that a hearing date has been assigned by the Area Plan Commission staff after the sufficiency/completeness review, on or before the deadline date shown on the Application Deadline and Meeting Schedule, the Notice of Public Hearing must be mailed by the petitioner by CERTIFIED MAIL/RETURN RECEIPT REQUESTED to each of the owners whose property is abutting the owner s property included in whole or part in the petition for rezoning and also to any neighborhood association if required. (Refer to Step 4 above for information regarding abutting property owners.) 8. POST the rezoning sign on the property, in a place visible to the public, at least 15 days before the Area Plan Commission meeting. 9. Submit the notarized County Rezoning Affidavit of Notice along with one copy of the Notice of Public Hearing and the green return receipts (explain any un-returned receipts) to the Area Plan Commission Office by 12:00 noon the Monday before the Area Plan Commission meeting. It is suggested that the copy of the certified letter receipt be filled out completely and stamped by the Post Office at the time the notice is mailed. In the event that the green card is not returned to you prior to the meeting, bring your white receipt and/or the returned letter itself to the Area Plan Commission office as proof that the letter was sent by you. THIS IS IMPORTANT! If these requirements are not met, the rezoning application will be postponed until the next regularly scheduled meeting, and the notification process must be repeated for that meeting. The petitioner shall also pay a continuance fee to get back on the Area Plan Commission agenda. 10. You, or someone representing you with the ability to contact you during the meeting(s) should any questions arise that the representative is unable to address, will be required to attend the Area Plan Commission meeting and the County Commission meeting at which your petition will be heard IF ALL OF THE ABOVE STEPS ARE NOT COMPLETED AS DETAILED IN THESE INSTRUCTIONS, YOUR PETITION CANNOT BE HEARD AT THE REGULARLY SCHEDULED MEETING. The Area Plan Commission shall make one the following recommendations: 1. Motion for continuance prior to motion to approve can allow petitioner to add or amend the use and development commitment with recommended provisions; if APC approves continuance, petition comes back to APC at subsequent meeting. 2. Motion to approve possible voting outcomes are: Recommend Approval (7+ Yes votes) proceeds to legislative body with recommendation for approval Recommend Disapproval (7+ No votes) proceeds to legislative body as a recommendation for denial No Action (less than 7 Yes or No votes) proceeds to legislative body without recommendation either for or against approval Motion for approval with conditions (7+ votes) after the hearing, the Area Plan Commission will CERTIFY the action of the Area Plan Commission, including the conditions of approval, and the petition will move forward for hearing by the County Commission with those conditions of approval. 11. Your petition will be heard by County Commission. The County Commission will vote on the petition as was certified by the Area Plan Commission, including any conditions if applicable. If your petition is amended after hearing by the Area Plan Commission, and at least 5 working days prior to the scheduled County Commission hearing, and IF the amendment is MORE RESTRICTIVE than the recommendation of the Area Plan Commission (with or without conditions of approval), then the County Commission may vote on this amended petition. If your petition is amended after hearing by the Area Plan Commission and the effect of the amendment is LESS RESTRICTIVE than the recommendation of the Area Plan Commission approval with conditions, then the petitioner must repeat steps (2), (3), (4), (5), and (6) above, with the ordinance including the use and development commitment as the 5th document, inserted in each packet. An adjustment check must be filed with the County Auditor for the increased recording and/or publication fees, and the amendment fee (half the original fee) must be paid to the Area Plan Commission office. You must repeat Step (7) above, again notifying on or before the deadline date shown on the Application Deadline and Meeting Schedule by CERTIFIED MAIL, RETURN RECEIPT REQUESTED each of the owners whose property is abutting the owner's property and any registered neighborhood association that includes the site or is adjacent to the site. The date the amendment is filed will determine which meeting(s) the petition will be heard. If your petition is approved at the County Commission meeting, the Auditor will publish the ordinance in the newspaper and record it with the County Recorder's office. At that point, the rezoning is effective. NOTE: If the petition is withdrawn, or the petition is denied by the County Commission, no one may re-apply for one year for rezoning of the parcel described in the rezoning petition. Your checks for cost of publication and recording of the ordinance may be picked up at the Auditor s office. PROCEDURE FOR AMENDMENT OF THE ORIGINAL PETITION At times, a petitioner may find it necessary or desirable to AMEND their Petition for County Rezoning. The procedure for amendment VARIES depending on the type of amendment to be made, and where the petition is in the zoning process. (OPTION 1): If a use and development commitment is filed or amended after the time of filing the petition to amend zoning maps and prior to hearing by the APC, the applicant must file an amended petition and ordinance, repeating steps (2), (3), (4), (5), and (6) above, with the use and development commitment as the 5th document, inserted in each packet. An adjustment check must be filed with the County Auditor for the increased recording and/or publication fees, and the amendment fee (half the original fee) must be paid to the Area Plan Commission office. You must repeat Step (7) above, again notifying on or before the deadline date shown on the Application Deadline and Meeting Schedule by CERTIFIED MAIL, RETURN RECEIPT REQUESTED each of the owners whose property is abutting the owner's property and any registered neighborhood association that includes the site or is adjacent to the site. The date the amendment is filed will determine which meeting(s) the petition will be heard. (OPTION 2): If a use and development commitment is filed or amended to be MORE RESTRICTIVE than the original commitment after the time of filing the petition to amend zoning maps and after hearing by the APC, the applicant must file an amended petition and ordinance, repeating steps (3) and (6) above, with the use and development commitment as the 5th document, inserted in each packet. An adjustment check must be filed with the County Auditor for any increased recording and/or publication fees if applicable. Any amendment or change to the ordinance after Area Plan Commission approval must be submitted in writing with the required number of copies and filed with the County Auditor and Area Plan Commission at least five business days prior to hearing by the County Commission, or the petition will be continued to the following month s County Commission rezoning hearing. The date the amendment is filed will determine which County Commission meeting the amended petition will be heard. Approved by the Area Plan Commission on 12/14/2017 Page 4 of 5

(OPTION 3): If any changes are made to the legal description, zoning classification, or other integral parts of the petition (other than correction of scriveners errors) filed after the time of filing the petition to amend zoning maps and prior to hearing by the APC, the applicant must file an amended petition, repeating steps (3), (4), and (5) above. If adjustment check(s) are required due to the change made, the checks must be filed with the County Auditor for the recording and/or publication fees, and the amendment fee (half the original filing fee) must be paid to the Area Plan Commission office. You must repeat Step (7) above, again notifying on or before the deadline date shown on the Application Deadline and Meeting Schedule by CERTIFIED MAIL, RETURN RECEIPT REQUESTED each of the owners whose property is abutting the owner's property. The date the amendment is filed will determine which meeting(s) the amended petition will be heard. If any condition exists or arises or if any event occurs after filing the application which makes any representation false, inaccurate, misleading or incomplete, and such fact is known by the applicant, his attorney or other representative, if any (collectively, the "applicant"), it is the responsibility of the applicant to disclose such fact promptly to the Area Plan Commission or its staff at or before beginning the public hearing on the application.
