THE STATE OF TEXAS COUNTY OF ORANGE BE IT REMEMBERED that a Special Court Session was held on Monday, March 25, 2013 at 2:00 P.M. in the Commissioners Courtroom of the Orange County Administration Building with the following in attendance: Carl K. Thibodeaux, County Judge David L. Dubose, Commissioner, Precinct No. 1 Owen W. Burton, Commissioner, Precinct No. 2 John W. Banken, Commissioner, Precinct No. 3 Jody E. Crump, Commissioner, Precinct No. 4 The meeting was called to order at 2:05 P.M., Doug Manning, Assistant County Attorney gave the invocation, Carl Thibodeaux led in the Pledge of Allegiance and the following business was transacted, to-wit: Agenda items are in the order they were taken in the meeting. APPROVE MINUTES Motion made by John Banken, seconded by Jody Crump approving the minutes of the Special Court Session held March 18, 2013, as circulated. 9. APPROVE Motion made by John Banken, seconded by David Dubose to authorize the County Judge to PROJECTS sign, approving the list of projects for the Hurricane Ike Grant 2.2 Funding. ADDENDUM NUMBER ONE: b. RESOLUTION Motion made by David Dubose, seconded by Owen Burton authorizing the Orange County Commissioners Court to accept and sign a Resolution for the Amended Fair Housing Activity Statement Texas Action Plan as part of the Orange County Community Development Block Grant Program.
16. CLOSE OUT Motion made by John Banken, seconded by Jody Crump to approve the report presented by PROJECT Mark Wimberley, Operations and Maintenance Director, concerning items necessary for the close out of the Orange County Convention and Expo Center project and said report be entered into the minutes of the Court. 1. PROCLA- Motion made by David Dubose, seconded by Jody Crump authorizing the Orange County MATION Commissioners Court to issue a Proclamation designating April 2013 as the Southeast Texas Big Read in Orange County. 2. BILLS PAID Motion made by David Dubose, seconded by Owen Burton authorizing payment of bills approved by the County Auditor as per attested listings and also specifically as follows: a. $2,300.00 to Claybar Funeral Home from the General fund (001.111.54290) for Indigent Funeral Expenses. b. $783.45 to Schaumburg & Polk Inc., from the General Fund (001.111.57511) for the Shelter of Last Resort. GENERAL FUND $325,962.24 ROAD & BRIDGE 32,702.66 MOSQUITO CONTROL 2,096.51 ADULT PROBATION 14,879.08 OTHER FUNDS 4,710.38 ----------------------------------------------------- TOTAL FOR PAYMENT $380,350.87 3. NO ACTION No action taken on discussion and possible action to receive and act upon projects as presented by the Director of Emergency Management. 4. FILL Motion made by David Dubose, seconded by Owen Burton to fill a vacant position for the POSITION receptionist in the Orange County District Attorney s Office.
5. INTERLOCAL Motion made by John Banken, seconded by Owen Burton to enter into an Interlocal AGREEMENT Agreement with Polk County, Texas, pursuant to Chapter 791, Tex. Gov. Code (Intergovernmental Corporation Act) and to authorize the County Judge to sign the Interlocal Agreement. This agreement will allow the Orange County District and County Clerk s offices to provide online imaging services to the public. The contract will not cause Orange County to incur additional costs. 6. PURCHASE Motion made by Owen Burton, seconded by David Dubose to remove the amount AUDIO of $359.00 from the designated Contigency Fund to replace the audio component that is broken in the courtroom for County Court at Law No. 2. This audio component is requested by Judge Troy Johnson and Dianna Edwards. 7. RABIES Motion made by John Banken, seconded by Owen Burton appointing Orange County CONTROL Sheriff s Deputy Rocky Bridges to be the Rabies Control Officer for Orange County, OFFICER Texas as set out in the Health and Safety Code, Title 10, Chapter 826, Section 826.013, Section 826.014 and Section 826.017. 8. HERBICIDE Motion made by John Banken, seconded by Owen Burton to approving the test application of APPLICATION herbicides on the County right of way in regards to the herbicides workshop for a limited amount up to $10,000.00 utilizing funds saved in mowing. 10. ACCEPT Motion made by John Banken, seconded by Owen Burton to accept the Road Damage BOND Bond from WHC Inc. as presented by Clark Slacum, P.E. County Engineer. This bond is to ensure that any road damage done by WHC Inc. during the installation of the 12 inch natural gas pipeline (Crosstex NGL Pipeline, L.P.) will be repaired without any cost to the County.
11. INTERLOCAL Motion made by David Dubose, seconded by Jody Crump authorizing the Orange County AGREEMENTS Judge to sign Interlocal Agreements with the Cities in Orange County desiring to purchase road materials on the Orange County Bid Contracts. 12. SPEED Motion made by Jody Crump, seconded by John Banken to establish a truck speed limit LIMIT of 20 miles per hour on Church House Road. 13. NO ACTION No action taken on discussion and possible action authorizing the Road & Bridge Department to install stop signs on Woodridge Drive at Kusnir Lane and on Woodridge Drive at Stone Ridge Drive. 14. NO ACTION No action taken on discussion and possible action on entering into an Interlocal Agreement with the City of Rose City for the inspection and abatement of public nuisances relating to substandard and/or dilapidated structures existing and situated within the territorial jurisdiction of the City. 15. NO ACTION No action taken on discussion and possible action on entering into an Interlocal Agreement with the City of Pine Forest for the inspection and abatement of public nuisances relating to substandard and/or dilapidated structures existing and situated within the territorial jurisdiction of the City. 17. AWARD Motion made by John Banken, seconded by Jody Crump to award the VIOP Telephone BID System Solution for RFP-13001 to Creative Micro Solutions. 18. AWARD Motion made by Owen Burton, seconded by David Dubose to award the Building Monument BID Digital Sign for RFP-13001 to State Sign Corporation.
ADDENDUM NUMBER ONE: a. NO ACTION No action taken on discussion and possible action to review, revise Policy No. 330, Orange County Personnel Policy Manual which deals with travel reimbursement for employees. The Court previously instructed this office to prepare drafts of two competing policies for consideration by the Court. 19. COMMENTS Carl Thibodeaux informed the Court that the Transportation Director is retiring Friday. There will be an agenda item on next week s agenda for the Court to decide on what they will do to fill that position. Carl Thibodeaux wished everyone a good Easter holiday. David Dubose read a statement pertaining to what happens at Golden Triangle Days in Austin, Texas. 20. DEPART- The Court heard and received the following departmental reports. A short written report to the MENTAL members of the Court, followed by no more than a five (5) minute verbal report with questions REPORTS and answers to follow: 4 th Meeting of March Agrilife/Extension Veteran s Office Environmental Health & Code Compliance 21. CLOSED Closed meeting held pursuant to Tex. Gov. Code 551.072, to deliberate the purchase, MEETING exchange, lease or value of real property. Deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person. This meeting will be taped. The Court went into closed meeting. The meeting was taped. 22. RETURN Return to open meeting. Take any action deemed necessary based upon discussion in TO OPEN closed meeting. MEETING REJECT OFFER Motion made by David Dubose, seconded by Owen Burton to reject the offer to purchase the County s mineral rights by Southwest Petroleum Company.
