SOCIAL DEVELOPMENT DEPARTMENT SUSTAINABLE DEVELOPMENT NETWORK THE WORLD BANK RULES AND GUIDELINES Please read through the following Rules and Guidelines to ensure your movie is eligible before filling out the submission form online. 1. Definitions The Organizer is the International Bank for Reconstruction and Development (World Bank) through its Social Development Department within the World Bank Social Development Network (SDN). The Contest is the micro-documentary film contest organized by the Organizer. The Entrant is anyone who enters the Contest by registering according to the established procedures and thus indicates intention to participate in the Contest. The Rules and Guidelines are the present rules and guidelines set by the Organizer for the administration of the Contest and agreed by the Entrant as a prerequisite for participation in the Contest. 2. General The Organizer is launching a micro-documentary film contest titled Vulnerability exposed: Social Dimensions of Climate Change, with the objective to raise awareness and educate on the social implications of climate change. The Entrant agrees to comply unconditionally with all the provisions set out in these Rules and Guidelines. Any Entrant who does not agree, fully or partly, with any provisions, or attempts to defraud or in any way tamper with the Contest of the present Rules and Guidelines, will be considered ineligible. 1

3. Eligibility The Contest is open to everyone around the world who is capable of producing a film using digital equipment, is concerned about the social impact of climate change and interested in creating a film to alert audience about the issue. There is no entry fee. Employees of the World Bank Group and their family members (spouse or domestic partner, child, parent, sibling and respective spouses) and those living in their immediate households, whether or not related are not eligible to enter the competition or win a prize. Multiple submissions from the same Entrant in accordance with the submission process are welcome, but the same film cannot be submitted separately by multiple Entrants. 4. Entry Requirements Duration: Eligible films must be a minimum of 2 (two) minutes and a maximum of 5 (five) minutes in duration. Theme: Films must be original and innovative in presenting the theme of social impact of climate change within the framework of one of the following themes: Conflict: As climate change results in scarcity of resources, and often, economic and political instability, how may it lead to social unrest and armed conflict? Migration: What are the links between climate change and population migration? Social Policy: How do governments prepare effective social policy to meet climate change challenges? Drylands: What is the social response in drylands as related to climate change? Urban Space: How do measures taken to adapt to climate change take into account the needs of the poor in the urban environment? Rural Institutions: How do local institutions in farm-based societies build the capacity to handle the risks associated with climate change and deliver solutions? Indigenous Peoples: How are Indigenous Peoples responding and adapting to the impacts of climate change? Gender: Are there different implications of climate change for men and women, boys and girls? How and/or where can instances of this be seen? 2

Governance: How are institutions responding to climate change in a way that promotes and protects the rights of the individuals and communities? Forests: What are the threats and opportunities for local communities in efforts to reduce emissions from deforestation and degradation? Human Rights: What are the human rights implications of climate change? Language: Films in all languages are accepted for the Contest. However, Entrants are strongly encouraged to include subtitles and a complete script in English, in order to facilitate public outreach and the contest process. Deadline: Entries must be uploaded to YouTube or mailed according to the entry procedures under Section 6 below by Friday, October 24, 2008 at 11:59 US Eastern Time. In case of mailing, the mailing date will define eligibility. 5. Entry Procedure To enter the Contest and compete for the awards, please follow the instructions below: YouTube Visit the contest website, www.worldbank.org/sdccfilmcontest, for Contest details before you start filming. Create an account with YouTube and upload your film on your YouTube page. When you are uploading a film on YouTube, tag your film with the following keywords so that people can find your film on YouTube: World Bank; climate change; film contest; film, video, contest, social development; vulnerability, etc. Also in the Description box, include the following text: This film is an entry to a short-documentary film contest, Vulnerability Exposed: Social Dimensions of Climate Change. Please visit http://www.worldbank.org/sdccfilmcontest and vote your favorite film NOW. After you upload your film on YouTube, complete the online registration form on the contest website with your contact details and the YouTube link to your film. Email or Mail Visit the contest website, www.worldbank.org/sdccfilmcontest, for Contest details before you start filming. If you cannot upload your film on YouTube, you may email your film to socialdevelopment@worldbank.org, attaching the registration form. Alternately, you may send a DVD with your film and the filled out registration form at: 3

DVDs should be sent either by regular mail (specify no commercial value for cultural purposes ) or by courier (e.g. DHL, FedEx, UPS, etc.). 6. Public Viewing and Voting To VIEW the films: All film entries will be available for the public to view and vote on the following website: http://go.worldbank.org/2dukua7iw0. To VOTE for films: The public voting will start as we post the submitted film entries on the following website: http://go.worldbank.org/2dukua7iw0. There will be a limit of one vote per person during the public voting period. The top 15 entries with the most public votes will proceed to the next step for the judging. For the youth award category, the top 5 entries with the most public votes will move onto the next judging phase. The film entries with the most public votes in each category will receive an honorable mention. 7. Judging The top 15 films for the Social Dimensions of Climate Change Award (general category) and the top 5 films for the Young Voices of Climate Change Award (youth category) voted by the public will be considered by a panel of individuals (hereafter referred to as the Judges ), who have distinct areas of expertise, such as media, international development, environment and human rights, etc. relevant to the Contest. The Judges will be responsible for selecting a first place winner, second and third runner-ups for the Social Dimensions of Climate Change Award and one film for the Young Voices of Climate Change Award. All winners will be notified by email during the month of November 2008. 4

8. Entrants Conduct - General Upon contest registration, the Entrant also permits anybody to access, view, store or reproduce the film for personal use. The Entrant shall not submit any film that in whole or in part violates or infringes in any way upon the rights of others; which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights; vulgar, obscene, profane or otherwise objectionable; which encourages conduct that would constitute a criminal offense; gives rise to civil liability or otherwise violate any law; or which contains advertising or any solicitation with respect to products or services. The Entrant shall not modify, exploit, create derivative works, or otherwise interfere with the material submitted to the Contest by other Entrants. In the event of permitted copying, distribution or publication of such material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. 9. Authorship and Co-Authorship Films can be submitted by one individual (sole author) or by a group of individuals (co-authors). The Entrant(s) is(are) the sole authors of the films submitted. The author(s) of the film is(are) the person(s) or group whose name(s) is(are) submitted through the registration process. Persons who participated in the creation and/or production of a film, but whose names were not submitted upon registration, cannot be considered as authors or otherwise added as creators and/or producers at a later stage of the Contest. Nor can they win the awards given for the winning film in each category. In case of a group entry, the names of all individuals of the group must submit their name upon registration. If the group has a name, title or appellation, submission of this group name, title or appellation is not sufficient for registration and eligibility, and must always be accompanied by the names of all individuals of the group. If the film submitted by a group of individuals wins the award prescribed for its category, the award will be made to and owned by all individuals of the group in equal shares. If the same film has been submitted by more than one Individuals/Groups through separate registrations, only the first registration will be eligible for the Contest. The other registrations will be cancelled and their Entrants will not be considered Authors of the film nor will they be eligible for the awards. 5

10. Third Party Rights and Clearances Proprietary rights Submitted films must be the original work of the Entrant and must not infringe upon the copyrights, trademarks, and rights of privacy, publicity or any other proprietary rights of a person or entity, including but not limited to: location releases for footage shot at any location; name, voice and likeness releases for any person whose name, voice, likeness and/or feature appears in the film, other that the Entrant(s); releases for the use of any props, set dressings and other materials used in the film; releases from any individuals participating in the production of the film and releases for any other audio and/or audio-visual materials not wholly owned by the Participant(s), which are used in the film. Clearances If the film contains any material or elements that are not owned by the Entrant(s) and/or are subject to proprietary rights of third parties, the Entrant(s) hereby automatically grant(s) or warrant(s) that any third parties owning material included in the submitted film, has(ve) expressly granted to the Organizer the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material, with the objective to promote the goals of the Contest. Burden of determination The burden of determining that any material is not protected by copyright, trademark, rights of privacy, publicity or any other proprietary rights rests with the Entrant. The Entrant shall be bear the sole liability for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. Minors If any person(s) appearing in any film is (are) under the age of majority in their State of residence, the original signature of a parent or legal guardian is required with each release. Arbitration clause Any dispute of difference arising out of, or in connection with, this Rules and Guidelines and cannot be amicably settled between the Organizer and the Entrant(s), shall be arbitrated in accordance with the UNCITRAL Arbitration Rules as at present in force. The arbitration shall take place in New York. Any resulting arbitral decision shall be final and binding on both parties. Judgment upon any arbitration award may be entered in any court having jurisdiction thereof. Such judgment will be in lieu of any other remedy. In resolving a dispute 6

hereunder, the parties agree that the Terms will be interpreted in accordance with the substantive laws of New York. 11. Termination, Cancellation, Suspension, Disqualification The Organizer, reserves the right, at its sole and unfettered discretion, to consider ineligible any film and disqualify the Entrant(s), or to cancel, terminate, modify or suspend the Contest in whole or in part and without prior notice at any time during the Contest, if it suspects, or actually finds that: The film(s) actually or potentially infringes upon any third party s intellectual property right and/or it is discovered that the necessary clearances for an entered film have not been obtained (see Section 10). The Organizer reserves the right to verify that any intellectual property rights are not infringed and that all related clearances have been obtained. The film does not comply with the established entry requirements and/or in the sole discretion of the Organizer the film contains obscene, unlawful or other objectionable material, as defined in Section 9. The film is promoting any particular products or services. The Entrant(s) is (are) tampering with or otherwise commit(s) fraud of electronic or non-electronic character relating to the entry process or the operation of the Contest or to be acting in violation of these Rules and Guidelines. 12. Entrant s Permission to the Organizer The Entrant hereby grants the Organizer the right to: The right to edit, copy, publish, display and otherwise distribute the submitted film, in whole or in part and use titles, footage and stills on the web site and/or any web sites owned or operated by or on behalf of the Organizer or any of the related or affiliated institutions in the World Bank Group, or on any web site owned or operated by or on behalf of the Organizer, to promote the objective of the contest and/or at events, with the objective to promote the goals of the Contest and the climate change work program of the Organizer; The right to use the submitted film to create trailer, either for individual films or as a collection of films; The right to use the submitted film at events to promote wider awareness on climate change during and following the Contest period. The right to use the Entrants names, likenesses, photographs, voices, sounds and/or biographical information and films in connection with the Contest and for any and all advertising, publicity and promotional purposes relating to the Contest without additional compensation, unless prohibited by law. 7

13. Disclaimer of Liability The Entrant(s) by registering with the Contest agree(s) that the Organizer and all the World Bank Group institutions, its agents, representatives, employees, and contractors, are released and discharged from and against all and any costs, claims, damages, liabilities and expenses of any sort arising out of, or generally relating to: submission of the material for the Contest and participation to it, the use of the material by the Organizer, the decisions made or actions taken by the Organizer in connection to the conduct and administration of the Contest and the acceptance and use on their part of any award. The Organizer and all the World Bank Group institutions, its agents, representatives, employees, and contractors, are not responsible for technical failures of any kind; any problems or delays arising from any technical, software; equipment malfunctions, computer viruses, or congestion; unavailability of the Screening Room or the Registration Site during the Contest Period; any other technical, equipment, or human errors of any kind with regards to the administration of the Contest; or any damage or alteration to the Entrants film that may occur in connection with the uploading or display of the film. Also, the Organizer is not liable for any failure to screen the entered films on the Internet or at any venue, if that failure is due to circumstances beyond its control. The Entrant(s) specifically acknowledge(s) that the Organizer is not liable for the defamatory, offensive or illegal conduct of other Entrant(s) and that the risk of injury from the foregoing rests entirely with the Entrant(s); also the Entrant(s) waive(s) any right to seek injunctive action or other equitable relief relating to any claim against the Organizer and all the World Bank Group institutions, its agents, representatives, employees, and contractors. 14. Changes to the Rules and Guidelines The Organizer shall have the right at any time and without prior notice to modify, suspend or terminate the Contest or the rules and guidelines applicable to the Contest, or any part thereof; and/or impose new rules, if it considers appropriate. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on the Contest s web site, sending electronic or conventional mail to the Entrants, or by any other means by which the Entrants obtain notice thereof. 15. Miscellaneous Monitoring The Organizer shall have the right, but not the obligation, to monitor the Contest and determine compliance with these Rules and Guidelines, and the right at its sole and unfettered discretion to refuse and remove any film, in whole or in part, 8

that, without limiting the foregoing, it finds to be in violation of these Rules or otherwise unlawful and objectionable. Decisions not subject to appeal The decisions of the Organizer are final and binding. 9
