Development Variance Permit Application No. 12-011-DVP (Montgomery) for the Property Located at #3 12877 Kidston Road Report from the Interim Director of Development Services dated July 10, 2012 (p. 13) Email from Mr. and Mrs. Chomin dated August 8, 2012 (p. 41) THAT Development Variance Permit No. 12-011-DVP (Montgomery) be issued to the owners of #3 12877 Kidston Road (Strata Lot 3, DL 55, ODYD, Strata Plan KAS1883) to vary the Height of Building and Structures regulations of the Residential Single Family Zone in the District of Coldstream Zoning Bylaw No. 1382, 2002, and amendments made thereto, as follows: 1. Section 701.4.a, height of building and structures, is varied from 11 metres (36.09 feet) to 15.42 metres (50.58 feet) on lots that exceed 5% average natural slope for construction of a single family dwelling; AND THAT Development Variance Permit No. 12-011-DVP (Montgomery) be issued to the owners on the condition that the house design incorporates structural posts to support the first storey of the dwelling on the downhill (lake) side of the property and that landscaping be provided to mitigate the visual impacts of these posts and the downhill (lake) side wall of the crawl space; AND FURTHER THAT as a Condition Precedent for the issuance of Development Permit No. 12-011-DVP (Montgomery), the owner or applicant submit: 1. Structural drawings acceptable to the Building Official for the first storey and crawl space which minimizes the amount of fill, incorporates structural posts (and not retaining walls), and reduces the visual impacts of the structural elements generally; and

A landscaping plan acceptable to the Director of Development Services which adequately addresses the visual quality objectives for the lower storey foundation and crawl space.
