Third Quarter Report RCMP Report from Inspector Kolibaba, dated October 21, 2004 Traffic Accident Reports for July, August 2004 Victims Assistance Program Reports for July, August, September, 2004 Inspector Kolibaba was present to speak to his Third Quarter Report for 2004. b. Bylaw Contravention Notice No. KH123363 Registered on Lot 1, Plan 21991, 5777 Highway 6 Mr. Skelton of 5777 Highway 6, requested Council s consideration of removing Bylaw Contravention Notice No. KH123363 registered on Lot 1, Plan 21991, and resolving the matter which relates to the building of an illegal suite on the property in question. Mr. Skelton advised that there is currently someone living in the suite.

OCP Review Lot 111, Plan 710A, Section 25, Township 9, ODYD OCP Review Policy Direction Commercial Shopping Centre Bob McKay representative of Trintec Enterprises Inc. was present to speak to two matters as outlined in his letters, dated October 19, 2004 and October 29, 2004, with respect to his property located adjacent to Aberdeen Road and Highway 6. d. Petition Noise Bylaw/CN Rail Shunting of Trains Barb Haner of 556 Guildford Court, spoke to the petition presented and received November 2, 2004, regarding the shunting of trains at 4:00 a.m., and requested Council s support in trying to have the shunting yard moved out of Coldstream. She further requested that in the meantime, the District s noise bylaw be enforced. e. Request for Donations Festival of Trees and Art Auction Kevin Rothwell representing the Vernon and District Association for Community Living, requested Council s support with the Association s Festival of Trees and Art Auction. He further invited Council as individuals to attend the auction. f. OCP Review Coldstream Elementary School Site and Buildings Chuck Johnson of 7900 Bonavista Drive, presented to Council a petition, requesting Council consider the purchase of the Coldstream Elementary School site and buildings, for the possible future use as a Community Centre, Park, and Fire Hall. g. Development Variance Permit Application 04-043-DVP Lot 118, Plan 710A, 68 North Aberdeen Road (Wasylyszyn) Steve Wasylyszyn of 68 North Aberdeen Road, was present to answer questions of Council.

Development Variance Permit Application 04-042-DVP Strata Lot 5, Plan KAS1883, #5, 12877 Kidston Road (Mr. & Mrs. Blaney c/o Jim van Ellenberg Designs) Jim van Ellenberg of Jim van Ellenberg Designs, and representing the owners of #5, 12877 Kidston Road, Mr. & Mrs. Blaney, was present to speak in support of Development Variance Permit Application 04-042- DVP, to allow for a height variance. Cathy Clark representing the Strata Council, spoke in support of Development Variance Permit Application 04-042-DVP, and advised Council that the Strata Council had supported the height variance requested. 2. (2) The applicant be required to construct the retaining wall down below the existing infrastructure to the satisfaction of the Director of Operational Services. This will allow for maintenance of the infrastructure in the future. (3) The Development Variance Permit note that as part of the Building Permit review process, based on the size of the proposed building and difficult terrain for access, special features may be required by the Building Official and NORD Fire Prevention Officer. 5.
