The proposed Natatorium venue project will be paid in part out of the previously approved sports venue sales tax proceeds with no additional sports venue sales tax to be imposed on the public. V. MOTIONS 3. Submission of the proposed Fiscal Year 2015 Annual Budget as per Article VI, Section 6.02, Submission of Budget, which states that At least sixty (60) days before the end of the fiscal year, the City Manager shall present to the Council a budget for the ensuing fiscal year with an accompanying budget message. 4. Submitting the proposed 2015-2019 Capital Improvement Program (CIP) as per Article VI, Section 6.05, of the City Charter, which states that "the City Manager shall prepare and submit a five (5) year capital program at least sixty (60) days before the end of the fiscal year." VI. EXECUTIVE SESSION The City Council hereby reserves the right to go into executive session at any time during this public meeting, if such is requested by the City Attorney or other legal counsel for the City, pursuant to his or her duty under Section 551.071(2) of the Government Code, to consult privately with his or her client on an item on the agenda, or on a matter arising out of such item. THE PROPOSED VENUE PROJECT TO BE PAID OUT OF THE PREVIOUSLY APPROVED SPORTS VENUE TAX PROCEEDS WITH NO ADDITIONAL SPORTS VENUE TAX TO BE IMPOSED. WHEREAS, pursuant to an election held on August 12, 2000, the City was authorized to collect a sales and use tax at the rate of one-fourth of one percent (the Sports Venue Sales Tax ) to finance a sports and community venue for multi-purpose entertainment arena (the "Laredo Entertainment Center"); WHEREAS, pursuant to an election held on November 4, 2008, the City was authorized to construct a baseball stadium as a related venue project and to pay for such facility from the previously approved Sports Venue Sales Tax; WHEREAS, pursuant to Chapter 334, Texas Local Government Code, as amended, the City Council is authorized to call an election to finance as a venue project an area or facility that is part of the City s municipal parks and recreation system and to pay for such facility from the previously approved Sports Venue Sales Tax; WHEREAS, this City Council has found and determined that the sports complex, described in the proposition set forth below, shall be part of the City s municipal parks and recreation system; and WHEREAS, this City Council finds and determines that it is necessary and advisable to call and hold an election within the City of Laredo, Texas, on the proposition hereinafter set forth; Now, Therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAREDO: Section 1. Election Ordered; Proposition. An election shall be held in the City of Laredo, Texas, on November 4, 2014, between the hours of 7:00 a.m. and 7:00 p.m., at which election the following proposition shall be submitted in accordance with law: PROPOSITION Authorizing the City of Laredo to finance a sports complex venue project to be located on the campus of Texas A&M International University and the related infrastructure and the maintenance and operation thereof and to authorize the use of the existing sales and use tax levied at the rate of one-fourth of one percent (as approved by the voters on August 12, 2000 and reapproved by the voters on November 4, 2008, not being a new tax) for the purpose of financing the venue project in addition to the venue projects previously approved on August 12, 2000 and November 4, 2008. Section 2. Precincts and Polling Places. The election precincts for said election only, and the polling place for each such precinct on election day, are set forth in Exhibit A attached hereto, which is incorporated herein by reference and made a part hereof for all purposes.

Section 3. Early Voting. The Main Early Voting Polling Place, the Branch Early Voting Polling Places for conducting early voting by personal appearance, the dates and hours for early voting by personal appearance and the address for early voting by mail for said election are hereby designated as set forth in Exhibit A attached hereto. Section 4. Election Officers. The election officers designated by the Webb County Election Administrator are hereby appointed and confirmed to hold said election at said polling places. As determined by the Webb County Election Administrator, the Presiding Judges shall appoint not less than two nor more than five qualified election clerks to serve and assist in conducting said election; providing that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks. An early ballot board is hereby created to process early voting results, and the individual designated by the Webb County Election Administrator is hereby appointed the presiding judge of said board. The presiding judge shall appoint at least two other members of the board. Section 5. Ballots. The official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid PROPOSITION, with the ballots to contain such provisions, markings and language as required by law, and with such PROPOSITION to be expressed substantially as follows: PROPOSITION FOR ) AGAINST ) Authorizing the City of Laredo to finance a sports complex venue project to be located on the campus of Texas A&M International University and the related infrastructure and the maintenance and operation thereof and to authorize the use of the existing sales and use tax levied at the rate of one-fourth of one percent (as approved by the voters on August 12, 2000 and re-approved by the voters on November 4, 2008, not being a new tax) for the purpose of financing the venue project in addition to the venue projects previously approved on August 12, 2000 and November 4, 2008. Section 6. Conduct of Election. (a) All resident qualified electors of said City shall be permitted to vote in said election. (b) The election materials enumerated in Secs. 272.001, et seq., V.T.C.A. Election Code, shall be printed and furnished in both English and Spanish for use at the polling place on election day and for early voting. (c) In all respects said election shall be conducted in accordance with the Texas Election Code. Pursuant to the federal Help America Vote Act and the Texas Election Code, each polling place 2

shall be provided at least one voting system equipped for individuals with disabilities. Sufficient voting equipment to accommodate the voters shall be provided for early voting and at each of the polling places on election day. Section 7. Notice of Election. Notice of said election shall be given by (i) publishing a substantial copy of this Resolution in both English and Spanish one time not earlier than the 30th day or later than the 10th day before election day, in a newspaper published in the City or, if none is published in said City, in a newspaper of general circulation in said City and (ii) posting a substantial copy of this Resolution in both English and Spanish on the bulletin board in the City Hall of said City used for posting notices of meetings of the City Council of said City not later than the 21st day before election day. Section 8. Findings. That it is hereby found and determined that the sports complex shall be part of the City s municipal parks and recreation system. 9. Effective Date. In accordance with the provisions of V.T.C.A., Government Code, Section 1201.028, this Resolution shall be effective immediately upon its adoption by the City Council. [Execution page follows] 3

An election shall be held in the City of Laredo, Texas, on November 4, 2014, between the hours of 7:00 a.m. and 7:00 p.m., at which election the following proposition shall be submitted in accordance with law: PROPOSITION Authorizing the City of Laredo to finance a natatorium venue project to be located at the United Independent School District Student Activity Complex on Highway 359 and Concord Hills and the related infrastructure and the maintenance and operation thereof and to authorize the use of the existing sales and use tax levied at the rate of one-fourth of one percent (as approved by the voters on August 12, 2000 and re- approved by the voters on November 4, 2008, not being a new tax) for the purpose of financing the venue project in addition to the venue projects previously approved on August 12, 2000 and November 4, 2008. Section 2. Precincts and Polling Places. The election precincts for said election only, and the polling place for each such precinct on election day, are set forth in Exhibit A attached hereto, which is incorporated herein by reference and made a part hereof for all purposes.

Section 3. Early Voting. The Main Early Voting Polling Place, the Branch Early Voting Polling Places for conducting early voting by personal appearance, the dates and hours for early voting by personal appearance and the address for early voting by mail for said election are hereby designated as set forth in Exhibit A attached hereto. Section 4. Election Officers. The election officers designated by the Webb County Election Administrator are hereby appointed and confirmed to hold said election at said polling places. As determined by the Webb County Election Administrator, the Presiding Judges shall appoint not less than two nor more than five qualified election clerks to serve and assist in conducting said election; providing that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks. An early ballot board is hereby created to process early voting results, and the individual designated by the Webb County Election Administrator is hereby appointed the presiding judge of said board. The presiding judge shall appoint at least two other members of the board. Section 5. Ballots. The official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid PROPOSITION, with the ballots to contain such provisions, markings and language as required by law, and with such PROPOSITION to be expressed substantially as follows: PROPOSITION FOR ) AGAINST ) Authorizing the City of Laredo to finance a natatorium venue project to be located at the United Independent School District Student Activity Complex on Highway 359 and Concord Hills and the related infrastructure and the maintenance and operation thereof and to authorize the use of the existing sales and use tax levied at the rate of one-fourth of one percent (as approved by the voters on August 12, 2000 and reapproved by the voters on November 4, 2008, not being a new tax) for the purpose of financing the venue project in addition to the venue projects previously approved on August 12, 2000 and November 4, 2008. Section 6. Conduct of Election. (a) All resident qualified electors of said City shall be permitted to vote in said election. (b) The election materials enumerated in Secs. 272.001, et seq., V.T.C.A. Election Code, shall be printed and furnished in both English and Spanish for use at the polling place on election day and for early voting. (c) In all respects said election shall be conducted in accordance with the Texas Election Code. Pursuant to the federal Help America Vote Act and the Texas Election Code, each polling place 2

shall be provided at least one voting system equipped for individuals with disabilities. Sufficient voting equipment to accommodate the voters shall be provided for early voting and at each of the polling places on election day. Section 7. Notice of Election. Notice of said election shall be given by (i) publishing a substantial copy of this Resolution in both English and Spanish one time not earlier than the 30th day or later than the 10th day before election day, in a newspaper published in the City or, if none is published in said City, in a newspaper of general circulation in said City and (ii) posting a substantial copy of this Resolution in both English and Spanish on the bulletin board in the City Hall of said City used for posting notices of meetings of the City Council of said City not later than the 21st day before election day. Section 8. Findings. That it is hereby found and determined that the sports complex shall be part of the City s municipal parks and recreation system. 9. Effective Date. In accordance with the provisions of V.T.C.A., Government Code, Section 1201.028, this Resolution shall be effective immediately upon its adoption by the City Council. [Execution page follows] 3
