Jonathon Lodwick Year of call: 2016 Overview Jonathon Lodwick joined chambers in October 2017 after successful completion of a multi-disciplinary pupillage, supervised by Richard Baker (Clinical Negligence and Personal Injury), Adrian Langdale (Crime) and Hari Kaur (Child & Family). He is developing a practice across a range of Chambers specialisms. Prior to commencing pupillage, Jonathon completed the Bar Professional Training Course at City, University of London, where he was awarded the Senior Scarman Scholarship for the highest performance overall. Jonathon brings a broad range of professional and academic experience with him to the Bar. He has worked as a Teacher of Politics at one of the country s leading independent schools and as a Senior Policy Advisor in the civil service. Personal Injury Jonathon has a busy and diverse personal injury practise. He accepts instructions to represent Claimants and Defendants at all stages of proceedings, including: Advising on merits and quantum and drafting approval advices; Arguing interim applications and attending CMCs and CCMCs; Conducting Stage 3 and approval hearings; Appearing in trials, including in Fast Track cases. Jonathon also has experience arguing credit-hire cases and has a firm grasp of the complex case-law in this area. Jonathon spent the first four months of pupillage focusing on clinical negligence and personal injury under the supervision of Richard Baker. He drafted advices on merits and quantum and pleadings including Particulars of Claim, Defences and Schedules of Loss in complex personal injury matters including: road traffic accidents, employers liability claims, and claims under the Fatal Accidents Act 1976 and Law Reform (Miscellaneous Provisions) Act 1934. He attended numerous conferences with lay clients, solicitors and medical experts in complex personal injury matters. Clinical Negligence Jonathon has a particular interest in clinical negligence. He is instructed to draft approval advices, argue interim applications, and appear at CMCs and CCMCs. He has experience advising on all aspects of clinical negligence claims, including liability, merits, causation and quantum. Jonathon accepts instructions to draft pleadings and has experience drafting complex Particulars of Claim and Schedules of Loss. Jonathon spent the first four months of pupillage focussing on clinical negligence and personal injury under the supervision of Richard Baker. He drafted advices on merits and quantum in high value, complex and sometimes novel claims. He was particularly adept at quantifying high-value claims. He gained experience of the whole life-cycle of clinical negligence litigation, from attending numerous conferences with lay clients, solicitors and medical experts and drafting agendas for Joint Expert Meetings to assisting in trials in the High Court and drafting Grounds of Appeal to the Court of Appeal. Clinical Negligence was one of Jonathon s specialist subjects on the Bar Professional Training Course. He achieved an Outstanding grade. Employment Jonathon appears in the Employment Tribunal on behalf of employees and employers. Recent instructions include: Representing a Claimant in a claim involving unfair dismissal and all forms of disability discrimination; Representing a Respondent in a contractual claim for unpaid wages which involved novel points of law, including whether in some circumstances an employer s notice of termination could trump that given by an employee where the contractual notice periods were different. Prior to commencing pupillage, Jonathon qualified as a volunteer for the Free Representation Unit (FRU), representing Claimants in employment cases. He gained experience conducting client conferences, drafting witness statements and lists of issues, negotiating settlements, and preparing schedules of loss. He successfully represented an employee in a multi-day constructive dismissal case involving workplace bullying.

Commercial Jonathon has a varied commercial practice and represents both Claimants and Defendants in the county courts conducting a range of hearings, including interim applications for strike out and summary judgment. He accepts instructions to advise on merits and quantum and to draft pleadings. Jonathon s recent experience includes: Drafting Particulars of Claim and a Reply and Defence to Counterclaim in a contractual dispute involving the implied terms in the Consumer Rights Act 2015; Appearing in the county court on behalf of a bailiff accused of unlawfully taking goods into control and/or converting the goods and successfully obtaining an order that the Claimant pay money into court on account of costs; Representing the petitioner to a winding-up petition in the Commercial Court. Jonathon also has experience arguing credit-hire cases and has a firm grasp of the complex case-law in this area. Public Law Jonathon has a specific interest in public law and is keen to develop a practice in this area. He is a member of the Government Legal Department s Junior Juniors panel and drafts Summary Grounds of Defence in immigration judicial reviews. Before coming to the Bar, he worked as a Senior Policy Advisor in the civil service and brings to his public law work an understanding of the broader policy making environment. Crime Jonathon appears in the magistrates court and Crown Court, prosecuting and defending, including defending in driving offences cases. His recent experience includes securing the acquittal of a driver accused of driving without insurance in a case where his insurance policy permitted driving other cars but the other car itself had no insurance. Child & Family Jonathon spent the final four months of his pupillage under the supervision of Hari Kaur and gained experience of all aspects of public children law. During his second six, he undertook a range of family work, including successfully obtaining a non-molestation injunction in a contested case.
