He informed the Board that the Respondent had agreed to a Settlement Stipulation imposing $750 in costs, voluntary relinquishment of his license, and to never reapply for a license with this Board. Mr. Daigle, nor a representative, were present at the meeting. Mr. Bolduc stated that he knows Mr. Daigle and worked for him a short period of time, however, that will not change his opinion on the case. Page 3 of 21

Mr. Barthlow made a motion that the Board accept the Settlement Stipulation as presented. Mr. Francis seconded the motion and it passed unanimously. Matthew McDonald, DBPR Case #2011-032699 (McCormick, Kymalainen PCP) Mr. Miller presented the facts in this case. He informed the Board that the Respondent had agreed to a Settlement Stipulation to dismiss the case. Mr. McDonald, nor a representative, were present at the meeting. Vice-Chair Gathright made a motion that the Board accept the Settlement Stipulation as presented. Mr. Holmes seconded the motion which passed with Mr. Bolduc voting against the motion. Bruce Yakola, DBPR Case #2011-027877 (McCormick, Kymalainen PCP) Mr. Miller presented the facts in this case. He informed the Board that the Respondent had agreed to a Settlement Stipulation imposing $649.99 in costs, voluntary relinquishment of his license, and to never to reapply for a license with this Board. Mr. Yakola, nor a representative, were present at the meeting. Mr. Barthlow made a motion that the Board accept the Settlement Stipulation as presented. Mr. Francis seconded the motion which passed with Vice-Chair Gathright voting against the motion. HEARINGS NOT INVOLVING DISPUTED ISSUES OF MATERIAL FACT Al Biancalana Building Code Administrator Mr. Biancalana was not present at the meeting, however, additional information had been submitted for the Board s review. Vice-Chair Gathright made a motion that the Board approve the application based on the additional information. Mr. Francis seconded the motion and it passed unanimously. Page 4 of 21

Mr. Barthlow made a motion that the Board approve the application based on the additional information. Vice-Chair Gathright made a motion that the Board approve the application based on the additional information. Mr. Bolduc seconded the motion and it passed unanimously. Additional information had been submitted for the Board s review. Mr. Bolduc made a motion that the Board uphold the denials as originally stated. Vice-Chair Gathright seconded the motion and it passed unanimously. Mr. Dudley was present at this time. Timothy Webb Provisional Building Inspector, Building Inspector Mr. Webb was present at the meeting and was sworn in by the court reporter. Additional information was provided at the meeting for the Board s review. Building Inspector Mr. Bolduc made a motion that the Board approve the Building Inspector application based on the additional information. Provisional Building Inspector In discussion it was noted that the affidavit from Mr. Danger was not clear regarding Mr. Webb being hired for the building inspector position. Mr. Webb stated that he was not hired as building inspector. Page 6 of 21

Vice-Chair Gathright made a motion that the Board uphold the denial of the Provisional Building Inspector application as originally stated. Mr. Francis seconded the motion and it passed unanimously. Mr. Webb stated that he wished to withdraw his Provisional Building Inspector application. Continuing Education Hearings Not Involving Disputed Issues of Material Fact Broward County Board Of Rules And Appeals 1. Sanitary Drainage Requesting 1 hour GENERAL credit (F-2456, A-2798) 2. Plumbing Fixtures Requesting 1 hour GENERAL credit (F-2457, A-2799) Mr. Dumbaugh was present at the meeting and was sworn in by the court reporter. Additional information had been provided for the Board s review. Vice-Chair Gathright made a motion that the Board approve the courses based on the additional information. RedVector Renewal Course Florida Building Inspectors Laws & Rules (RV-4628) (0006894) Requesting 2 hours LAWS & RULES credit (F-1023, A-2796) Ms. Sakamoto was present at the meeting and was sworn in by the court reporter. Additional information had been provided for the Board s review. Vice-Chair Gathright made a motion that the Board approve the course based on the additional information. Mr. Dudley seconded the motion and it passed unanimously. REQUEST FOR AN EXTENSION OF A PROVISIONAL LICENSE Ronald Crutchfield Mr. Crutchfield was not present at the meeting as he had car trouble on his way to the meeting and staff was notified that he was unable to attend. Information had been submitted for the Board s review. Mr. Bolduc made a motion that the Board grant an extension of the license for a period of six months. Mr. Dudley seconded the motion and it passed unanimously. Page 7 of 21

PROSECUTING ATTORNEY REPORT MARK MILLER Mr. Miller provided the Board with a copy of his report. He informed the Board that there were four private cases and seven public cases in the Office of the General Counsel. OLD BUSINESS There was no old business to come before the Board at this time. 2014 LEGISLATIVE PROPOSALS Definition of Employee Supervision by Provisional Building Code Administrators Following discussion regarding the legislative proposals, Mr. McCormick appointed an Ad-Hoc Committee with Mr. Bolduc as the Chair of the Committee. He stated that the Committee would be the 2015 Legislative Proposal Ad-Hoc Committee. Mr. Holmes and Mr. Dudley were also appointed to the Committee. RULES REPORT CLARK JENNINGS Mr. Jennings did not have a report to give at this time. OLD BUSINESS There was no old business to come before the Committee at this time.
