CHAPTER-1 NAME, AREA & OBJECTS Name and Constitution 1. The name of the Trade Union shall be Madhya Pradesh Power Sector Junior Engineer s Association(MPPSJEA), hereinafter referred to as the "Union". 2. Only junior engineer s and assistant managers can take membership in this union. junior engineer s/assistant managers hereinafter referred to as the "members" 3. The Union shall consist of an unlimited number of members of either sex and every member shall, subject to the following rules, have an equal voice in all the concerns thereof and in the administration of all the property thereof. 4. Union has motive to fight for every members rights. with less expanses best work too. Office 5. The registered Office and the Headquarters of the Union shall be at Indore with branches in all cities, towns and selected villages in the states of Madhya Pradesh. 6. The Objects of the Union shall be- Objects a). To organise the whole body of employees of the Madhya Pradesh Power Sector Staff Consists all four companies junior engineer s/assistant managars(all Madhya Pradesh power distribution companies, all Madhya Pradesh power generation companies, all Madhya Pradesh power transmission companies, all Madhya Pradesh power management companies ), and its Associate companies and associate unions junior engineers/assistant managers belong to power sector. b). To protect and promote the interests of all members by legitimate and constitutional means. c). To secure- i). Improvement of the status and position of every member in service with regard to pay, allowances, leave, hours of work, etc. ii). To protect rights of members at working place, to fight for every member in service for exploitation at work place with regard to pay, allowances, leave, hours of work, etc. iii)equality of rights and privileges for the same work or office to any member where any other employee is entitled to the same, irrespective of race, colour or creed. iv). Proper representation of the employees on the Board of Directors of the all companies v) Proper representation of the employees on govt of mp.

vi). Adequate compensation for members in cases of injury or accident under the workmen's Compensation Act or any other law. vi) To fight for every matter affected to service. vii) To fight for wrong rules and regulation of companies and Madhya pradesh government and central government that harms the members service in companies. viii) To fight for providing protection at work place and in field during working and during non working from wrong element that harms to members of union. ix) to fight for every legal matter of members about service in companies. x) To fight for increase facilities to members provided by the companies and govt of Madhya Pradesh and central government. xi) To fight for provide safty and good environment at work place. d). To regulate the relations and to establish mutual understanding and concord between the employers and the employees and settle all disputes in a constitutional manner. e) To maintain an official organ for publishing the activities of the Union and disseminating information about the various inequalities and disabilities under which the members toil in respect of their work and other conditions of service. f) To raise and establish separate funds, as and when necessary, for the furtherance of the objects of the Union. g) To work as far as possible in co-operation with other Trade Unions in and outside the country and help any movement that has for its object the general advancement of the working classes in the country not inconsistent with the spirit of the Indian Trade Unions Act, 1926. h) To federate with, or affiliate itself to, any other Association, Union or Society in India and outside having kindred aims and objects. i) And generally to do all such other things as may be considered necessary, incidental or conducive to the attainment of the above objects or any of them subject always to the provisions of Section 15 of the Indian Trade Unions Act, 1926, in matter of expenditure that may be involved. j) To try for establish co-operative stores and credit societies, clubs, libraries, reading-rooms, night classes etc, for the benefit of members, and to organise occasional lectures and social gatherings with a view to develop an understanding of the advantages and facilities of organised life. K) To purchase, take on lease or otherwise acquire, and to hold and manage, sell, exchange, mortgage and otherwise dispose of both movable and immovable properties of every description including Joint Stock Companies shares, debentures and Government papers and all rights and privileges necessary or convenient for the purpose of the members of the Union.

CHAPTER-2 MEMBERSHIP & SUBSCRIPTION Membership 7. None but a junior engineer/assistant manager permanent employee of the Madhya Pradesh power sector companies and its Associate/attached power sector companies covered who is not below the age of 18, shall be enrolled as member of the Union. 8. Minimum qualification of junior engineer/assistant manager should be diploma in engineering, higher degree in engineering is acceptable but candidate should not having the post above junior engineer/assistant manager for membership. Candidate below the post of junior engineer/assistant manager also not applicable for membership of union. 9. Candidate promoted for the post of junior engineer by power sector companies can take membership only successful completion of probation period. 10. Any member of the Union whose services have been removed (not by way of normal retirement) by the company may be allowed to continue his / her membership as and in the manner deemed fit by the Central/ Circle Committee, upto the age, he / she reaches superannuation. 11. At the time of membership candidate should submit following document compulsiory 1)pay slip 2)employee id copy 3)bank passbook copy/bank statement 4)adhar card 5)pran no 6)pan card copy 7) affidavit (should not involve in any activity against union ). 12. Persons working on contract in companies or working in company s franchise of power sector may take membership with limited rights. these persons has no rights to vote and no rights for fight on any post. union will work for these persons as union member at every steps. 13. Admission- All eligible persons shall apply for membership in the prescribed registration form with an admission fee of Rs. 1000 only, through the divisional Secretary of the concerned Circle and in no case the registration form shall be sent directly to the general Secretary. Members can pay online on union website or by cheque in favour of...payable at...indore... i) The divisional Secretary after receiving the form shall send the same to the Chief Secretary for allowing the candidate to become member. ii) The divisional Secretary shall have power to refuse admission to any candidate with assigning proper reason. However, such refusal will be placed before the next Circle Committee for ratification. Every member join at their divisional level. In case new appointment in organisation union members has responsibility for joining new appointed person as member in union. New appointed person has all right of member of union after joining union as per union constitute.

13.(a) Every Member shall pay monthly Subscription at the following rates : (i). Rs. 300/- for each members for every month. b i). Besides the usual rates of subscription, every member shall be liable to pay such subscription or levy, recurring or otherwise, as may be imposed by the Central Committee/Regional Committee /Circle Committee/ divisional Committee or by the General Council. The General Council shall have the right to increase or reduce the usual rates of subscription in the interest of the Union. And union clarify this increase within two month by notice. 14. Benefits, limitation and rules a) Only Members, paid regular membership has right to vote in election process. b) Only members that participate every meeting of union has right to take part in election for any posts in union. c) Continue non-payment of 5 subscriptions by the member has no right to vote and take part in election in the financial year. d) After election on any post security should be deposited rs 1000/- e) After election on any post, non-payment of any subscription penalty should pay rs200/-per subscription and penalty deducted from security deposit amount. After successive three non-payment of subscription with penalty he dismiss from the post of the union automatically. But he remains member of the union. After non-payment five subscriptions he has no right to vote and no right to take part in election in financial year. f) Elected member should remain on the post for four year, election process will occur every four year. g) One member can fight for one post only in election process. h) Any discrepancy by any member in lower committee on any post, central committee has full rights to remove that candidate with proof of discrepancy. And regional committee call for meeting with regional committee, circle committee, division committee and final the new member for the post and inform to central committee. in this type situations the new member remain on the post for remain time before election. i) Any discrepancy by any member in central committee, regional committee may call joint meeting of central committee, regional committee, circle committee and divisional committee by 2third majority and may remove the person from the post. And appoint new member for that post. j) All Election process will occur after every four year. No election occurs before four year. k) Any member can t stay on two posts at a time. Before taking part in election for any post he should resign from previous post either election form will be cancelled. l) Election will occur in every four year in April month only. m) Any special fund raised or any subsidiary institution started hereinafter for the benefit of the members, in accordance with the objects of the Union, shall be guided by bye-rules framed for the purpose, such bye-rules may provide for the conditions subject to which the special benefits accruing

from such fund or institution may be enjoyed by members, and shall, when duly framed, be incorporated in these rules. n) If any member takes any political party membership, he dismissed from union membership. o) After promotion from junior engineer to assistant engineer or equivalent post permanently, membership automatically cancelled. In Probation period of member on higher post member has no right to vote and take part in election for any post. In probation period he dismissed from current post of union but he remains as member of union up to the date of permanent appointment. p) Every member should inform to union about promotion within seven days. q) Promotion from lower cadre to junior engineer, after successful completion of probation, candidate can apply for membership. r) General council s call for strike and for leave, every member should strictly follow. Refusing by any member, membership terminated automatically. s) Every member of union would loyal and honest to union. t) Power management company junior engineers has no right to take part in election on any post. u) Junior engineer attached in offices has no right to take part in election on any post. 15. Register of Members record - i) A Register and computer record showing the name, addresses and descriptions of members shall be maintained at the registered office of the Union. The register shall be a consolidated record of membership of the Union including all its divisional committee. The respective Circle Headquarters shall also maintain a list of the names, addresses and descriptions of members of their respective Circle. ii A Register of Members shall be kept by each divisional Committee and a copy of the entries in the Register or corrections thereof shall be sent each month to the Circle Headquarters. CHAPTER-3 MANAGEMENT & OFFICE BEARERS 16. The Management of the Union shall be vested in: (a) founder members of union as chairman and vice chairman. (b) General Council (c) Central Committee (h) Regional Committee (i) Circle Committee (j) Divisional Committee

17. General Council shall consist of the following office bearers: i. Founder member of union as chairman and vice chairman. ii. General president iii. General secretary iv. General treasurer v. Central committee presidents vi. Central committee secretaries 18. Central Committee shall consist of the following office bearers: i. Central President ii. Central Chief Secretary iii. Central General Treasurer iv. regional Presidents v. regional chief secretaries vi. founder member of union as Chairman and Vice Chairman. 19. Regional Committee shall consist of the following office bearers: i. Regional President ii. Regional Chief Secretary iii. Regional General Treasurer iv. Circle Presidents v. Circle chief secretaries 20. Circle Committee shall consist of following office bearers: i. Circle President ii. Circle Chief Secretaries iii. Circle General Treasurer iv. Divisional Presidents v. Divisional secretary 21. Divisional Committee shall consist of following office bearers: i. Divisional President ii. Divisional chief Secretary iii. Divisional Treasurer iv. members Chapter 4 ELECTION PROCESS 22.Election procedure will be of two types,(1) direct election process this type of election process organised for divisional committee,circle committe,and regional committee.in this Election process members direct elect candidate. (2) indirect election process- this type of election process election will organised for central committee and general council and members not involved directly in election process.

After selection of circle committee and regional committee, these committee elect for central committee. After selection of central committee and regional committee, these committee elect for general council. For Founder member of union as chairman and vice chairman no election process occour and they remain life time in union. every committee president and secratery will be as member in just above committee. Election process will conduct every four year in april month for each committee. First members elect the divisional president, divisional secretary, divisional treasurer this called divisional committee. For circle committee president, secretary and treasurer called circle committee. For regional committee president, secretary, treasurer called regional committee. 23. general council make an committee that organised election process this committee called as election committee. Election committee consists seven members. All seven members of election committee electe members for election process help, these members called election authority members. election authority members work for election process. Election committee members and election authority members has no right to take part in election for any post of union. After successful completion of election process committee dismissed. 24. After election of members on union post every elected member submit affidavit for honest and loyal work to union. CHAPTER-5 power 25.General council has full power for making rules for union. General council has Full power for amendment in constitution in favour of union and members. General council has full power for taking any decision in favour of union and members. 26. general council has power for call to strike and leave. Chapter-6 DISCIPLINARY ACTION 27.CENTRAL DISCIPLINARY ACTION COMMITTEE in meeting of central committee by 2 third majority action may taken against any central committee member. and approval for action should be sanction from general council. 28.regional DISCIPLINARY ACTION COMMITTEE in meeting of rigional committee by 2 third majority action may taken against any regional committee member. and approval for action should be sanction from central committee and general council. 29.CIRCLE DISCIPLINARY ACTION COMMITTEE

in meeting of circle committee by 2 third majority action may taken against any circle committee member. and approval for action should be sanction from central committee and regional committee. 30.divisional DISCIPLINARY ACTION COMMITTEE in meeting of divisional committee by 2 third majority action may taken against any divisional committee member. and approval for action should be sanction from circle committee and regional committee. 31.APPEAL AGAINST THE DECISION OF THE DISCIPLINARY ACTION COMMITTEE Appeal can be done in higher committee.but higher committee will take decision with consultation of that committees 2third majority. Chapter 7 MEETINGS 32.Every committee take meeting with in three month. And special meeting can organised with proper massaging to every member any time. divisional committe and circle committee organise meeting to discuss problems and suggestions every month at their levels and convey it to higher committee for strengthening of union and members. Meeting will organised on first and second Sunday only. In special case meeting can organised any time with prior messaging. Chapter- 8 Funds, Accounts & Audit 33.Funds collected from members at the time of registration by money receipt book only and one copy given to member. Collected fund should deposit every day to union s bank account and summary should mail daily to higher committee. 34.Every committee shall maintain their accounts properly and send account detail every day to higher committee. 35.Divisional committee may raise funds for their meetings. When committee raise any funds he should provide money receipt for member in which he specifies the motive for fund collection. Divisional committee can collect maximum up to Rs 5000 /- in one month for meeting. But they should maintain their accounts properly and should send daily account by mail to higher committee and central committee. 36.Expanse of divisional committee in one month has power up to 5000/- Rs only beyond 5000/- he should take permission from central committee. 37.Inspection of Accounts by the Members-

The books and accounts of the Union including the Register of Members shall be open to inspection by any member of committee any time during normal office hours at the Registered Office /regional committee/ Circle committee /regional committee/divisional committee of the Union with the permission of that committee president. 38.Audit -The accounts of the Union shall be audited by a firm of the Chartered Accountants appointed by the Central Committee.
