Chapter I Introduction A. Background The Student now a day think that if as long as they learn nicely, have a good score and can receive the degree on what faculty they learn,has been enough. As long as in the future they can receive money for living, it is all fine. They use the theory of economy. They pay for the education so they must receive the money of their work from what they learn before in the school. The educational member focusing on what they can receive rather than what they can give or what the things they could fix by applying their education. Especially if they also don t have the love to their country, they can easily forget how they should do their obligation, since they received so many goodness from the country. B. Problemformulation What isthe meaningof NationalIdentity? What are Right and Obligation? How as student we can show our national identity? What are the obligation and right of the student toward Indonesia? C. Chapter II Analysis A. National Identity National identity is a feature that is owned by a nation that is philosophically differentiate nation with other nations. Based on such understanding is that every nation in the world will have its own identity according to the uniqueness, character, traits and character of the nation. So national identity is an entity related to the area and always has the area (their homeland), common history, legal system and laws, rights and obligations as well as the division of labor based on profession. Similarly, it is also determined by the process of how the historical shaped. Based on the essence of the national identity of a nation can not be separated with the identity of a nation or more popularly referred to as the identity of a nation.national identity is the identity owned by a nation. Personality or identity of the Indonesian people will vary with the personality or identity Australian nation, Americans, and others. Personality or national identity was taken from cultural values and religious values that we stand for the truth. If someone were to say that Indonesia is a nation of civilized, cultured nation, a nation that ethical, then that is to say the personality or identity of the Indonesian people. National identity was formed because we feel that we as a nation Indonesia shared experiences, the same history and the same sorrow. Understanding the personality of a true identity first emerged from psychologists. Man as an individual is difficult to understand if apart from other humans. Therefore humans in interaction with other individuals always have a habit of nature, behavior, as well as a distinctive character that distinguishes humans with other humans. However, in general terms or terms of personality as a whole or totality, the identity of the biological factors, psychological and sociological underlying individual behavior. Behavior consists of habits, attitudes, traits, and different character on someone that someone is different from the others. Therefore, it is reflected in the overall personality of a person's behavior in relation to other human beings. B. The Right And Obligation Justinian first define an Obligation, in his institutions. Today the term obligation, as it applies within civilian legal systems, means more specifically a legal bond between two or more person, by which one person, one debtor, is held liable to other, the creditor, to perform a prestation consisting of doing or not doing something at risk of legal sanction. Thus the term encompasses both sides of the equation, both the duty of the debtor and the right of the creditor. In this way it differs from the common English language conception of Obligation which denotes only the duty aspect. Every obligation has four essential requisites otherwise known as the elements of obligation. They are: 1. A passive subject (called debtor or obligor): the person who is bound to the fulfillment of the obligation. 2. An active subject (called creditor or obligee): the person who is entitled to demand the fulfillment of the obligation. 3. Object or prestation: subject matter of the obligation 4. A juridical or legal tie: the vinculum; the efficient cause that binds or connect the parties. Rights are legal, social, or ethical principles of freedom or entitlement; that is, rights are the fundamental normative rules about what is allowed of people or owed to people, according to some legal system, social convention, or ethical theory. Rights are of essential importance in such disciplines as law and ethics, especially theories of justice and deontology. Rights are often considered fundamental to civilization, being regarded as established pillars of society and culture and the history of social conflicts can be found in the history of each right and its development. According to the Stanford Encyclopedia of Philosophy, "rights structure the form of governments, the content of laws, and the shape of morality as it is currently perceived." The connection between rights and struggle cannot be overstated rights are not as much granted or endowed as they are fought for and claimed, and the essence of struggles past and ancient are encoded in the spirit of current concepts of rights and their modern formulations. C. What can we do to showing our National Identity as a student In this country we are using the system that there is a period that will be changed time by time, because of we are republicans. The leader will be changed in every view years in order to get the better situation, because we never know if there are others people can lead our country better. And the time will come when the younger replacing the older. Leader is not always someone we see. There are people who become the leader of small group, even a leader of their own self. For example, a person who lead himself to make a commitment enlarge the education quality in the native clan in the village where the whole facilities that they supposed to have in the city where they were get all the knowledge are not exist. Sometimes the smallest were everything. When there are a volunteer, who wiling to teach the education of native people they just make the groups of that people having better education. So that in the future, they will become more successful person. If there are many of those volunteer, can you imagine how much educated person will be exist in this country and how much they can raise our country condition? All of the citizen need to understand the national identity which is come from the country herself, not to compare with the other because of we have our own history which define our country. When we have the love to the country, we will try to develop them especially with any kind of ways which are sometimes not right because it loosen the national identity of Indonesia. Indonesia has their own fundamental theory which cannot be replace by anyone. The globalization and modernization has weakening our national life. For example in the fourth pancasila we should make the representative but now for the democracies we spend lot of money for election. All of that causing the depletion of nationalism, the erosion spirit of mutual assistance, the strengthening of primordial ties, rampant acts of violence. Also we become an individualist, pragmatism, and consumeristic. As student, the younger generation, we need to fix this for in the future the other generation will follow because we are the young generation having the biggest effect on this country. We are the evaluator, we need to think precisely, critically, and diplomatic. When we have the nationality we must prove it if we have it. Make our nation proud of us, have the achievement bring good name of our nation to International. That is for the big project, but for now all we need to do is to look inside our country, fix what we see as something wrong with the right way. For example, we see many poor people in the street whose child cannot go to school because of the limit time they have since they have to looking for money to live. We are as the student with education, need to help as much as we can with teaching them, giving them our advice, direct them to having the education. The other example is that we are as the student of medical should learn how to really deal with people not only learn what are the anatomy of human but also deepen our knowledge about how the condition of now a day people in the world and we have to practice our self with it. D. The right and the obligation of a student Each person based on the UUD deserve to get the education. As we can see, the government has been trying to do things for the poor so that they still can get their right but we feel that the government has not yet doing their best. In the city, we easily see how the child in the street on the school learning hour selling the newspaper. The other matter that has not yet finished for now is that why the people who live in the native clan still unreachable by the modernity of educational. The government was too focusing to some area which like the java island, they still not yet focus on the whole Indonesia area. The obligation of a student in Indonesia written on Undang-UndangNomor 20 Tahun 2003 tentangsistempendidikannasional yang menyebutkanbahwapengertianpesertadidikadalahanggotamasyarakat yang berusahamengembangkandirimelalui proses pembelajaran yang tersediapadajalur, jenjang, danjenispendidikantertentu. So as student our truly job is to develop our self through the education facilities that has been prepared for us. That is what the government give us, and how about what can we do for our nation? As a return for the kindness that were given to us? Of course by doing our obligation first but what can we do next? We must bring our nation name to the international for something good of course, then in the future we applying all the education which we have receive to develop our beloved country. We must do our job nicely, not to be easily distracted especially by the modernization and globalization. If the young generations are corrupt, how in the future they will be able to lead our country nicely and bring the nation to the great era. That is why, the younger generation have so many demands. The education are not only needed for broaden their academic knowledge but also to strengthen their morality understanding. Not only that, the student were given the knowledge of our country, how the struggle of our elder, the history of the fallen. All of that were given to the student so that they can continue the struggle, so that they having the love to their nation. For one day they will able to lead our country to the better position, with all of their abilities with all of their power, because when you love something, you can do anything. Chapter III Solution A. Conclusion As a student we really have the big impact for the nationality, we are as the educational person with smart thinkingshould be able to applying what we have learn for the common good. We as student must being fast thinking with our environment, doing everything that we can do for the nation especially in the educational matters. B. Suggestion We as the current student should be thinking fast of the changing situation, we have to developing a love toward our country.
