BOROUGH OF FANWOOD MAYOR AND COUNCIL REGULAR MEETING AUGUST 20, 2018 The Regular Meeting of the Mayor and Council was held on August 20, 2018, at Borough Hall, 75 North Martine Avenue, Fanwood, NJ 07023 at 7:07 PM. Mayor Colleen Mahr presided and stated: I hereby announce and request that such be included in the minutes of the meeting that notice of time, place and date of this meeting has been prominently posted on the bulletin board at Borough Hall; mailed to the Times, The Star Ledger, Courier News, Alternate Press by January 10, 2018 filed with the Borough Clerk and mailed to any person requesting same in accordance with the requirements of the Open Public Meeting Act The Pledge of Allegiance was led by Mayor Colleen Mahr. Present: Absent: Also, Present: Russell Huegel, Tom Kranz, Erin Mcelroy-Barker, Katherine Mitchell, Jack Molenaar Anthony Carter arrived later. Regular Meeting July 16, 2018 Special Meeting August 6, 2018 APPOINTMENTS AND ANNOUNCEMENTS Mayor Mahr presented Matthew Juckes with a Devlin Print of the Community House to honor him as Volunteer of the Month. Councilman Carter arrived. PROCLAMATIONS Mayor Mahr presented the following proclamation to representatives from CASA, Court Appointed Special Advocates, for their volunteerism in this most revered organization protecting foster care children. Marla Higginbottom and seven other volunteers were present to receive the Proclamation. COURT APPOINTED SPECIAL ADVOCATE OF UNION COUNTY DAY AUGUST 20, 2018 WHEREAS, the Borough of Fanwood in New Jersey recognizes the problem of child abuse and neglect and is committed to helping its victims; and WHEREAS, Court Appointed Special Advocates (CASA) of Union County recruits, trains, supports and supervises community volunteers as advocates for children who have been removed from their home due to neglect or abuse; and 1

WHEREAS, CASA volunteers ensure children s best interest remain the priority while working toward establishing a safe, stable and permanent home for each child served; and WHEREAS, CASA has a record of public service protecting the safety and well-being of Union County s foster children, defending them from harm and ensuring they are provided with the courtordered services they need; and WHEREAS, CASA establishes and maintains effective relationships with the family court, the Division of Child Protection and Permanency (DCPP), Child Placement Review Board, Office of the Public Defender, Legal Aid, and other child serving agencies/institutions in order to create a cooperative environment in which to best meet the needs of children. NOW, THEREFORE, I, Colleen Mahr, Mayor of the Borough of Fanwood, do hereby proclaim August 20, 2018 as COURT APPOINTED SPECIAL ADVOCATE OF UNION COUNTY DAY in the Borough of Fanwood and urge all residents to become aware of the work and mission of CASA of Union County. Let it be known that we support the education efforts to raise awareness of the CASA program at the local level and the need for community members to provide a voice for the children in foster care. Mayor Mahr and Councilman Kranz presented the following proclamation to The Chelsea At Fanwood for the award received by The Chelsea from the National Center for Assisted Living Week Program. Annette Watson was present to receive the Proclamation. THE CHELSEA AT FANWOOD WHEREAS, the National Center for Assisted Living (NCAL) announced The Chelsea At Fanwood was selected for the National Assisted Living Week Program of the Year for its extraordinary Assisted Living Week program in September 2017, and WHEREAS, the American Health Care Association and National Center for Assisted Living (AHCA/NCAL) represent more than 13,000 skilled nursing centers, assisted living communities, subacute centers and homes for individuals with intellectual and development disabilities and annually recognize outstanding programs and individuals, and WHEREAS, the award winners will be recognized at the 69 th annual AHCA/NCAL Convention and Expo in San Diego, California held on October 7-10, 2018, and WHEREAS, the Borough of Fanwood is aware of the outstanding service that The Chelsea At Fanwood brings to the Borough since 2009 offering an essential service to the residents of Fanwood and is happy to have them as a neighbor. NOW, THEREFORE, I, Colleen Mahr, Mayor of the Borough of Fanwood do hereby proclaim August 20, 2018 as THE CHELSEA AT FANWOOD DAY, to recognize this prestigious award and the commitment and dedication this organization plays in the Fanwood community in an exemplary and compassionate manner. 2

BE IT FURTHER RESOLVED that this message be spread across the minutes of this meeting so that all who follow will know The Chelsea At Fanwood to be an organization offering outstanding service to this community. Land Use and Historic Preservation (Councilman Huegel) Councilman Huegel reported for the Construction Office. E. Recreation and Community Services (Councilwoman Mcelroy-Barker) Councilwoman Mcelroy Barker reported for the Recreation Commission. F. Health and Senior Citizens (Councilwoman Mitchell) Councilwoman Mitchell reported for the Book Sale sponsored by the Library. SPECIAL COMMITTEE REPORTS Liz Jeffery reported for the downtown Antonios Panagopoulos gave a report on engineering for the months of July and August. PRESENTATION OF CLAIMS Kranz/Mitchell moved to adopt the Payment of Claims for the month of August. Motion carried on the following roll call vote. PAYMENT OF CLAIMS BE IT RESOLVED that claims in the amount of 3,224,846.87 having been listed on the Bill List and recorded in the files of the Borough Hall, and approved by the Chairman of the appropriate Committee, be paid. 3

Motion carried. No one spoke. Mitchell/Kranz moved to close the meeting to the public. OLD BUSINESS CONSENT AGENDA Resolution 18-08-136 Molenaar/Huegel moved to adopt Resolution 18-08-136. Motion carried. RESOLUTION 18-08-136 WHEREAS, an application has been filed for a person-to-person transfer of Plenary Retail Consumption License 2005-33-003-015, a pocket License, heretofore issued to BEMSK Enterprises to Carano Square LLC, and WHEREAS, the submitted application form is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current license term, and WHEREAS, the applicant is qualified to be licensed according to all standards established by Title 33 of the New Jersey Statutes, regulations promulgated hereunder, as well as pertinent local ordinances and conditions consistent with Title 33, and WHEREAS, the applicant has disclosed, and the issuing authority has reviewed the source of all funds used in the purchase of the license and the licensed business and all additional financing obtained in connection with the licensed business. NOW, THEREFORE, BE IT RESOLVED that the Fanwood Borough Council does hereby approve, effective August 20, 2018, the transfer of the aforesaid Plenary Retail Consumption License to Carano Square, LLC, and does hereby direct the Municipal Clerk to endorse the license certificate to the new ownership as follows: This license, subject to all its terms and conditions, is hereby transferred to Carano Square LLC, effective August 20, 2018. Resolution 18-08-151 Molenaar/Huegel moved to adopt Resolution 18-08-151. Motion carried. RESOLUTION 18-08-151 WHEREAS, municipalities are excellent fiscal stewards that are run by elected officials who live 4

in these communities, responsible for the efficient use of tax dollars and that have been doing more with less ever since New Jersey was founded in 1787, and WHEREAS, various special interests suggest that there are too many local governments in New Jersey and by reducing the number through forced boundary change will somehow lead to greater economic conditions and better delivery of services, and WHEREAS, no one has ever proven that bigger, centralized government is better or even more cost effective than local municipal government, and WHEREAS, expansive or consolidated governments are often less responsive to citizen and neighborhood needs so it can be hard for neighborhood-level concerns to get addressed, and WHEREAS, the Borough of Fanwood supports voluntary merger or consolidation of local governments if the process is initiated at the local level and it has the support of the majority of the residents. NOW, THEREFORE, BE IT RESOLVED the Borough of Fanwood opposes forced merger or consolidation of local governments and any other legislation that has been or may be introduced in the future to weaken the responsiveness and effectiveness of local government and urges our legislature to consider the comments in this resolution when voting on this form of legislation. BE T FURTTHER RESOLVED that a copy of this resolution be transmitted to Fanwood s legislative delegation. NEW BUSINESS Administration and Finance (Councilman Kranz) Resolution 18-08-137 Kranz/Mitchell moved to adopt Resolution 18-08-137. Motion carried on the following roll call vote. RESOLUTION 18-08-137 WHEREAS, Shain Schaffer PC, 150 Morristown Road, Bernardsville, NJ, was appointed Tax Appeal Attorney for the Borough of Fanwood on January 1, 2018, in the amount of $1,000.00, and WHEREAS, it is now necessary to increase the contract amount due to the increased tax appeal workload, in the amount of $5,000. NOW, THEREFORE, BE IT RESOLVED the Borough Council hereby authorizes an increase to Shain Schaffer s contract for 2018. BE IT FURTHER RESOLVED a copy of this resolution be transmitted to the Borough Kranz, Mitchell, Carter, Huegel, Mcelroy Barker, Molenaar Resolution 18-08-138 Kranz/Mitchell moved to adopt Resolution 18-08-138. Motion carried on the following roll call vote. 5

RESOLUTION 18-08-138 WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transaction, and WHEREAS, the Annual Report of Audit for the year 2017 has been filed by a Registered Municipal Accountant with the Municipal Clerk as per the requirements of N.J.S. 40A:5-6, and a copy has been received by each member of the governing body, and WHEREAS, the Local Finance Board of the State of New Jersey is authorized to prescribe reports pertaining to the local fiscal affairs, as per R.S. 52:27BB-34, and WHEREAS, the Local Finance Board has promulgated a regulation requiring that the governing body of each municipality shall certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled: and General Comments Recommendations WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the section of the Annual Audit entitled: General Comments Recommendations as evidenced by the group affidavit form of the governing body, and WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, as per the regulations of the Local Finance Board, and WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board, and WHEREAS, Failure to comply with the promulgations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB- 52-to wit: R.S. 52:27BB-52-"A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined nor more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office." NOW, THEREFORE BE IT RESOLVED, that the governing body of the Borough of Fanwood, hereby states that it has complied with the promulgation of the Local Finance Board of the State of New Jersey dated July 30, 1968 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance. 6

RESOLUTION 18-08-144 WHEREAS, the Borough of Fanwood wishes to participate in Union County's program for leaf composting at its Conservation Center in 2018. RESOLUTION 18-08-146 WHEREAS, due to the recent storms the Holiday Pine Tree as well as the lights on the tree located on North Avenue have been damaged and need to be removed and replaced. Marge Mazaitis, 270 North Avenue, spoke about the flooding on North Avenue. She also commented about how the flooding in the area would increase with the improvements to the Library. Mitchell/Kranz moved to close the meeting to the public. Motion carried. MAYOR AND COUNCIL COMMENTS Councilman Kranz wished everyone good luck with the remainder of Summer. Councilman Carter commended Fanwood s emergency responders for their actions at an accident that occurred on Martine and North Avenues recently. Councilwoman Mitchell asked all voters to choose wisely at the next election especially regarding stronger gun laws. She also mentioned that the Board of Education did not share the additional funding it received from the State in the 2018 Budget where other Boards did share the funding.
