Submit Applicant s authorization form if applicant or authorized agent is different than owner (see attached). Submit incorporation documents if the owner is a corporation (LLC, INC, etc.), or trust documents (if applicable). Submit a sketch plan map of the site at the scale of one (1) inch represents fifty (50) feet, or other suitable scale, to show: The proposed location of the telecommunication antenna tower and other support structures (guy wires), including distances from the property lot lines, above-ground power lines, fall-zone easements (if applicable) and other structures on the property. Location and identification of any easements, rights-of-way, and County, State or Federal roads or highways. Submit a vicinity map showing adjacent properties, general land uses, zoning and roadways within five hundred (500) feet of the proposed telecommunication antenna tower site. Submit a map indicating the service area/radius of the proposed telecommunication antenna tower in addition to the service area/radius of other existing telecommunication antenna towers within ten (10) miles of the proposed telecommunication antenna tower location. Submit the deed or legal instrument identifying the applicant s interest in the property. Submit a list of all the surrounding property owners (surface estate) within 500 feet of the property under consideration. This list must be a certified list of the names, addresses, and the corresponding parcel number assigned by the Weld County Assessor of the owners of property. Also submit the affidavit stating that the list is accurate (see attached). This list shall be compiled from the records of the Weld County Assessor, the Weld County Website, www.co.weld.co.us, or a person qualified to do the task. This list expires in thirty days of the date compiled. Submit elevation drawings of the proposed facility showing all towers, structures and other improvements related to the facility, showing specific materials, placement and colors. Submit a letter of intent to allow co-location on the tower. Submit a decommission plan for when the tower becomes obsolete or is no longer in use (letter of intent or lease agreement statement which addresses removal of the tower facility at the expense of the tower facility and/or property owner if it is deemed abandoned). Submit a statement describing the telecommunication facility (technical need, reasons for its design and location, its role in the network, and the total capacity of the structure, including the number and type of antennas). Submit the FAA response to the Notice of Proposed Construction or Alteration (FAA Form 7460-1 or equivalent), if the facility is located near an airport or a flight path (if applicable). Submit a schedule for the installation of landscaping and screening and site maintenance (if applicable). Submit a telecommunication facility inventory. The first application for a proposed telecommunication facility by a provider must include a detailed inventory of all the provider's existing and approved telecommunication facilities within unincorporated and incorporated County, and one (1) mile beyond the County border, (if applicable). If required, submit photo-realistic renderings (photosyms) of the site after construction, demonstrating the true impact of the telecommunication facility on the surrounding visual environment. ZONING PERMIT for TELECOMMUNICATIONS ANTENNA TOWER (ZPTT) PROCEDURAL GUIDE APPLICATION FEE HEARINGS/MEETINGS PROCESSING TIME $ 500.00 Administrative Staff Review or Board of County Commissioners 60 days $ 250.00 Investigation Fee, (if required) Fees are non-refundable and due at time of application submittal. Fees are set by the Board of County Commissioners by Resolution. County Staff is not authorized to negotiate fees and cannot, under any circumstance, change, reduce, or amend the fees set forth in the Weld County Planning Fee Schedule. PURPOSE The purpose of this packet is to provide applicants with information regarding the Weld County Zoning Permit for a Commercial Tower process. It is the responsibility of the applicant to be knowledgeable of the specific requirements of the Zoning Permit for Telecommunication Antenna Tower application process. Specific requirements regarding Zoning Permits may be found in Chapter 23, Article IV of the Weld County Code. GENERAL INFORMATION BUILDING PERMITS Building permits are required in addition to the Zoning Permit for Telecommunication Antenna Tower. The building permit may be obtained from the Building Inspection Department, 1555 N 17 th Avenue, Greeley, Colorado 80631, Phone 353-6100 extension 3540. The permit will be released only after approval of the Zoning Permit. TELECOMMUNICATION ANTENNA TOWERS Telecommunication Antenna Towers are allowed as accessory uses, subject to Zoning Permit for Telecommunication Antenna Tower requirements or as a Use by Special Review permit, per the height guidelines for legal lots, below. Use by Right or Accessory Use Zoning Permit for Use by Special Review Permit Telecommunications Antenna Tower approval required Up to 35 feet in height >35 feet up to 70 feet in height Greater than 70 feet in height TELECOMMUNICATION ANTENNA TOWER DEFINITION Any structure that is designed and constructed primarily for the purpose of supporting one (1) or more antennas, including camouflaged, lattice, guy or monopole TELECOMMUNICATION ANTENNA TOWERS. This includes radio and television transmission, microwave, and common-carrier, personal communications service (PCS), cellular telephone, and/or alternative TELECOMMUNICATION ANTENNA TOWERS, and the like. This definition does not include any structure erected solely for a residential, noncommercial individual use, such as television antennas, satellite dishes or amateur (HAM) radio antennas, including, but not limited to AMATEUR RADIO ANTENNA/TOWERS. APPLICATION REQUIREMENTS Telecommunication Antenna Towers requiring the issuance of a Zoning Permit are subject to the application requirements of Section 23-4-870 and Telecommunication Tower Antenna Standards of Section 23-4-830 of the Weld County Code. The applicant shall submit 1 packet containing all items required on the Submittal Checklist. The packet shall be bound with either paper clips or binder clips (no substitutes). The Department of Planning Services may request additional information, application packets and/or fees that will aid in the review of the Zoning Permit application. Page 2

ADMINISTRATIVE REVIEW The Board of County Commissioners delegates the authority to issue a Zoning Permit for a Telecommunications Antenna Tower which otherwise requires the approval of the Board of County Commissioners through a public hearing process to the Department of Planning Services upon the determination by the Department that: 1. The applicant is in compliance with the criteria identified in the Weld County Code, for the specific category of zoning permit that is being applied for. 2. The Department of Planning Services has sent notice and has not received signed notification from at least thirty percent (30%) of surrounding property owners within five hundred (500) feet of the subject property in opposition to the location of the Telecommunication Antenna Tower. If opposed, the petition shall indicate that the surrounding property owners who have signed the notification have objections to the issuance of a zoning permit for the Telecommunication Antenna Tower. 3. The Department of Planning Services and has not received referral responses in opposition to the location of the Telecommunication Antenna Tower from municipalities within one-half (½) mile of the subject property. INVESTIGATION FEE An additional investigation fee shall be added to the cost of the permit application when specific land, uses, building, or Telecommunication Antenna Towers that require a permit by the Weld County Code are located, moved, operated, or constructed prior to obtaining a permit. The investigation fee shall be fifty percent of the fee established by separate action by the Board of County Commissioners for land-use applications. The payment of such investigation fee shall not relieve any persons from fully complying with the requirements of the Weld County Code, nor from any other penalties. Page 3
