Notice Inviting Tender Tender no -RDM -1/2016/1 Dated. Rangia the 20 th April 2016 Sealed tenders are invited from interested firms/traders of open market for supplying the following items as Gratuitous Relief (G.R) during flood/natural calamities/other disturbances for the year, 2016-17. The items required to be supplied are Masoor Dal (Big/Small/Medium size), Gur (Balti/Tin), Chira, Iodized Salt (Bag/Packet of all varieties), plastic tarpaulin sheets for temporary shelters (Quality/Size wise), Candle (Big), Match Box, Wheat Bran, Mustard oil, rice Bran and baby food. The tenders will be received in office of the Sub-Divisional Officer (Civil), Rangia, up to 2.30 PM on 02-05-2016 and will be opened on the same day at 4.00 PM. Detailed terms and conditions of this tender may be obtained from Relief Branch of the Sub-Divisional Officer (Civil) office, Rangia during office hours up to 29-04-2016 and also can be downloaded from the website www.kamrup.nic.in Important: - The nature/quantum of G.R. Material for supply will be at the discretion of Sub-Divisional Officer (Civil), Rangia. Further issuance of supply order for the aforesaid relief items will be only in the event of occurrence of flood/natural calamities/other disturbances and based on essentiality as decided by this office and mere selection of the firm/trader through this short tender notice shall not entitle any right what so ever for placement of supply orders. Description of the tender Floods and natural calamities are regular phenomenon in Assam and the Rangia Sub-Division is regularly affected by floods due to heavy downpour, storms and accumulation of rain waters in the catchment area. So it is absolutely essential to gear up for the tackling floods, storms, heavy rains and other natural calamities. Further there were incidences in the past of other disturbances such as manmade disasters, ethnic disturbances and violence where human displacement is seen needing provision of relief camps, shelter, Gratuitous Relief (G.R) etc. Hence Sealed tenders are invited from interested firms/traders of open market for supplying the following items as Gratuitous Relief (G.R) for providing them to the victims during flood/natural calamities/other disturbances for the year, 2016-17. The GR items identified to be provided to the effected people in the event of flood and/or natural calamities and only in case the sub-divisional administration (represented by Sub-Divisional Officer (Civil), Rangia) decides to provide Gratuitous Relief (GR) to the victims as are 1. Baby food of reputed brand The tenders will be received in office of the Sub-Divisional Officer (Civil), Rangia, up to 2.30 PM on 02-05-2016 and will be opened on the same day at 4.00 PM. Further the placement of work order (supply order) for the Gratuitous Relief (GR) material(s) shall take place only in the event of the Sub-Divisional Administration represented by the Sub-Divisional Officer (Civil), Rangia deciding (in its sole judgment) to provide relief to victim of the flood or natural calamities or other disturbances in the way of Gratuitous Relief (GR) and mere occurrence of flood or natural calamity (ies) or other disturbances also will not entitle the selected bidder any right for claim of placement of work order for supply of Gratuitous Relief (GR) material. In the event of a decision to provide GR to victims of the flood/natural calamities/other disturbances and the Sub-Divisional Officer (Civil), Rangia decides to actually place supply order to the firm/trader selected under this tender, the former (Sub-Divisional Officer (Civil), Rangia) reserves full rights to place supply order against any or all Gratuitous Relief (GR) items or may not place supply order for purchase of a particular Gratuitous Relief item. The Sub-Divisional Officer (Civil), Rangia reserves the rights in all circumstances to accept or reject any tender without assigning any reason thereof, besides the right of accepting tender of more than one supplier (provided the rates are found justifiable). In the event of any emergency and also based on the demand of the situation or any other eventuality the Sub-Divisional Officer (Civil), Rangia reserves the right to procure Gratuitous Relief (GR) items from other sources. In the event of a decision of the sub-divisional administration to actually place supply order to the firm/trader selected under this tender, the former (sub-divisional administration) reserves full rights to place supply order against any or all Gratuitous Relief (GR) items or may not place supply order for purchase of a particular Gratuitous Relief item. In the event of massive floods and natural calamity, the sub-divisional administration may require large quantity of GR materials and the bidder should be prepared to deliver the same in the short duration as per the supply order placed by the Sub- Divisional Officer (Civil), Rangia. However mere stocking of GR materials by the preferred bidder will not entitle him any right what so ever for placement of supply order by the Sub-Divisional Officer (Civil), Rangia and no liability shall vest up on the Sub-Divisional Officer (Civil), Rangia for any costs or losses incurred by the preferred bidder towards procurement/stocking of GR material in the event of non-placement of supply order and the same shall be borne by the preferred bidder. In the event of placement of supply order the GR materials shall be delivered by the preferred bidder at his godown/shop gate to the officials of the office of the Sub- Divisional Officer (Civil), Rangia for onwards transportation to the site of relief operations. In other words the transportation costs of the GR material to the site of relief operations from the godown/shop gate shall be borne by the Sub-Divisional Officer (Civil), Rangia. So rates quoted under this tender shall not include the transportation costs to the site of relief operations. The sub-divisional administration reserves the rights in all circumstances to accept or reject any tender without assigning any reason thereof, besides the right of accepting tender of more than one supplier (provided the rates are found justified). In the event of any emergency and also based on the demand of the situation or any other eventuality the sub-divisional administration reserves the right to procure Gratuitous Relief (GR) items from other sources. General terms and conditions 1. Eligibility criteria: The bidder must fulfill the following eligibility conditions and must also submit documentary evidence in support of fulfilling these conditions while submitting the Technical bid. 1. The firm/trader should be a registered firm/trader. 2. The firm/trader should have been an income tax assesse for the last three financial years i.e. 2013-14, 2014-15 and 2015-16. 3. The firm/trader should have at least Rs. 5 lakhs turnover per year in the similar nature of works as mentioned in scope of work of the tender document during last two financial years i.e. 2014-15 and 2015-16. The firm/trader having higher turnover during the period will be given weightage during evaluation of technical bids. 4. The firm/trader should have adequate financial resources to undertake the contract. 5. The firm/trader should have valid Service Tax Registration Certificate and TIN number. 6. Weightage will be given during evaluation to firm/trader having prior experience in supply of the items during flood/ natural calamities /other disturbances. 7. Firm/trader shall be ready to supply the GR material(s) as per quantity required by the Sub-Divisional Officer (Civil), Rangia in short notice even at few hours notice and should sign an agreement to this effect. 8. Weight age will be given during evaluation to firm/trader of Rangia Sub-Division. The firm/trader from outside Rangia should have local representative(s) in Baksa (Goreswar Part), Nalbari, Kamrup or Kamrup Metro districts with the necessary authority to liaise with the sub-divisional administration, Rangia and supply the GR item(s) in short notice if selected. 9. Must enclose DD for Rs. 5,000/- towards EMD to the technical bid. 10. The firm/trader shall give a declaration in writing stating that it has not been blacklisted by Govt of India/Govt of Assam/any other State Government/Union Territory and does not have any criminal cases against it. Any suppression of facts in this regard will result in rejection of tender submitted. 11. The firm/trader can quote for one or more or all GR item(s). However during evaluation of the bids, the preferred bidder will be selected separately for each GR item and work order also will be issued accordingly. 9

2. Quality and specifications Standard quality materials shall be provided. The Tender Evaluation Committee shall be provided with the sample(s) of material(s) intended to be supplied by the firm/trader and the sample once approved, shall be indicative in nature and all the GR materials supplied under this tender by the firm/trader shall conform to the specifications/standards of the approved sample. 1. Baby food of reputed brand Sub-standard/inferior quality GR material(s) and those GR materials not conforming to the fixed standards/specifications shall be rejected forthwith and the firm/trader will be blacklisted, security forfeited and will be liable to any legal action which the Sub-Divisional administration may take recourse to at its sole discretion. 3. Due date and Time In case the sealed tender is sent by post, it should reach the office of the Sub-Divisional Officer (Civil), Rangia on or before 2.30 pm on 02-05-2016. Further the intending tenderers can also deposit their filled-in sealed tenders in the tender box placed in the office of the Sub- Divisional Officer (Civil), Rangia, Relief and DM Branch on or before 2.30 pm on 02-05-2016. Tenders received after the due date and time or unsealed will be summarily rejected. 4. Mode and SUBMISSION: Offer should be made in two parts namely Technical bid and Commercial bid and in the format given in bid document. Each offer should be placed in a separate sealed envelope super scribed Technical Bid or Commercial bid as the case may be followed by the title mentioned above against Tender Notice name of the vendor and contract address should also be written on the 10

envelope. All correspondence should be with the Sub-Divisional Officer (Civil), Relief & DM Branch, Office of the Sub-Divisional Officer (Civil), Rangia. Tenders should be addressed to the Sub-Divisional Officer (Civil), Relief & DM Branch, office of the Sub-Divisional Officer (Civil), Rangia. Tender consisting of above two covers should be sealed in a cover and could be dropped in the sealed box kept at the Relief & DM Branch, office of the Sub-Divisional Officer (Civil), Rangia or send by post as mentioned elsewhere. 5. Submission of tender cover a) The tender document contains the following Tender details Technical bid Commercial bid The Technical bid prescribed should be filled in original and should be sealed in a separate cover mentioning the tender number along with the duly signed copy of the Scope of the tender and Tender Information as given on Pages No 6 to 8 of the tender document. The technical bid should be superscripted as Technical Bid envelope. The commercial bid as prescribed should be filled in original and quote should be both in rate per quintal or rate per piece or as specified in the price table of the appended commercial bid as the case may be inclusive of all taxes, charges etc., for the items of works mentioned in the Commercial bid document. The filled in Commercial bid must be sealed in a separate cover. The commercial bid should be superscripted as Commercial Bid. The bid must be unconditional and in the format given in the tender document. Both the technical bid and commercial bid should then be put in a single outer cover sealed. The price quoted shall be inclusive of all taxes, duties and all other charges. If the envelope is not sealed and marked as required above, the Sub-Divisional Officer (Civil), Rangia, Relief & DM Branch, office of the Sub-Divisional Officer (Civil), Rangia will not take any responsibility for the bid s misplacement or premature opening. 6. LATE BID Any bid received after 2.30 pm on 02-05-20163 will be rejected. 11

7. Cost of Tender There is no cost prescribed for these tender documents. However the tenders shall bear Rs.- 8.25 court fee stamps on the body of the cover page of the filled-in tender. Further the tender shall be filled-in and deposited in the form and manner as prescribed in this tender document. 8. Earnest Money Deposit Each tender should be accompanied by Earnest deposit of Rs. 5,000/- (Rupees Five Thousand) only by way of crossed demand draft in favour of the Sub-Divisional Officer (Civil), Rangia. The EMD of the unsuccessful bidder will be returned after the finalization of the tender within a reasonable time consistent with the rules and regulations in this behalf. The above EMD amount held by the Sub-Divisional Officer (Civil), Relief Branch, office of the Sub-Divisional Officer (Civil), Rangia till it is returned will not earn any interest thereof. Offers received without Earnest Money Deposit shall be rejected. 9. Details to be furnished All particulars and relevant supporting documents as laid down in the eligibility must be furnished and all the information asked for in the prescribed technical and commercial bid formats must be furnished. The rate should be clearly indicated both in words and figures. Whenever there is a discrepancy between words and figures, the rate indicated in words shall apply. The bidder should initial with his signature any editing/scoring/over writing. The rate quoted should be kept firm for a minimum period of 180 days (six months) from the date of acceptance of tender. Special information as required in the technical bid must be furnished or else the bid is liable to be rejected. 10. Opening of the tender and evaluation thereof The tenders received will be opened in the conference room of the office of the Sub-Divisional Officer (Civil), Rangia by the Tender Evaluation Committee at 4.00 pm on 02-05-2016 in the presence of those bidders or their representatives with a letter of authority who prefer to attend the tender opening. The technical bid will be opened in the first instance and evaluated and Tender Evaluation Committee will prepare the list of technically qualified bidders. 12

Such of the bidders who are qualified in the technical bid alone will be informed of the date and time of opening of the commercial bid. The commercial bids of technically qualified bidders will alone be opened and evaluated. The decision of the Tender Evaluation Committee shall be final in this regard. 11. Security Deposit The successful bidders will be required to remit security deposit in the form of DD or unconditional irrevocable bank guarantee of Rs/- 10000 inclusive of EMD within 07 days from the date of intimation of acceptance of bid and the security deposit will be retained for one year. If the accepted bidder fails to remit the security deposit, the EMD remitted by him, will be forfeited. The security deposit furnished by the successful bidder in respect of his tender will be returned to him at the end of the contract period subject to the satisfaction of Sub-Divisional Officer (Civil), Rangia. In case of successful bidder, they may adjust the earnest money deposit towards part of security deposit payable. If the successful bidders fails to sign the contact or after signing the contract fails to perform any contractual obligation, his security deposit mentioned above will be forfeited and necessary steps will be taken to blacklist the firm. 12. Agreement: The successful bidder shall execute an agreement for the fulfilment of the contract on Rs. 100/- Non judicial stamp paper, within 7 days from the date of acceptance of the tender. The incidental expenses of execution of agreement shall be borne by the successful bidder, hereafter the successful bidder shall be referred to as contractor. The conditions stipulated in the agreement should be strictly adhered to and violation of any of the conditions will entail termination of the contract without prejudice to the rights of Sub- Divisional Officer (Civil), Rangia of recovery of any consequential from the contractor. 13. Payment terms and conditions Even though the prices solicited in commercial bid are for rate per quintal or rate per piece or as specified, the actual payment that would be remitted to the successful bidder will be computed based on the actual quantity supplied or actual number of pieces supplied against each item. No advance payment will be made to the supplier. 13

The payment will be made only subject to receipt of funds from the government of Assam against the GR materials purchased. During the course of the contract if any GR material supplied is found to be substandard/inferior quality or not conforming to the standards fixed by the Tender Evaluation Committee in all such cases no payment shall be paid against such GR material and the firm/trader will be blacklisted, security forfeited and will be liable to any legal action which the Sub-Divisional administration may take recourse to at its sole discretion. Further the payment to the suppler will be subject to condition that the supply of the GR items has been completed in full as stipulated in the terms and conditions of this tender document as assessed by the Sub-Divisional Officer (Civil), Rangia. 14. Evaluation process The following evaluation criteria shall be adopted with respect to the evaluation of Technical bids submitted by the bidder: Sl. Parameter Maximum no marks 1 Experience of the firm/trader having prior experience in supply of the 30 items during flood/natural calamities/other disturbances 2 Financial Capability based on last three financial years i.e. 2013-14; 45 2014-15 and 2015-16 audited balance sheets. If un-audited balance sheets are submitted for a particular year then no weightage will be given for such unaudited balance sheets for that year and will be marked zero (0) for that year. Average of last three years turnover will be taken for marking. Higher marks will be given for firm/trader with higher turnover. 3 Local firm/trader i.e of Rangia Civil Sub-Division. 15 4. Past experience of firm/trader having supplied GR materials to the 10 office of Sub-Divisional Officer (Civil), Rangia Total 100 NOTES: A minimum of 60 marks will have to be obtained by the bidder(s) to qualify the technical evaluation. Tender Evaluation Committee reserves the right to reduce the minimum qualifying marks based on any exigencies that may arise post-evaluation of all the bids. 14

The Tender Evaluation Committee reserves the right to recommend award of contract to one or more bidders. 15. Implementation schedule and termination for non fulfillment of contract All ordered GR items shall be supplied within stipulated time and any default would result in cancellation of the supply order including all future supply orders and the Sub-Divisional Officer (Civil), Rangia will be free to procure from the next best bidder at the prices fixed for the preferred bidder in the first instance (i.e. defaulted bidder) and so on. 16. Validity of rates The rate quoted should be kept firm by the selected/preferred bidder (firm/trader) for a minimum period of 180 days (six months) from the date of acceptance of tender. In case if there is rise in the open market prices of any/all Gratuitous Relief (GR) items during the validity period of the prices fixed under this contract, the Sub-Divisional Officer (Civil), Rangia shall give no relief what so ever to the selected/preferred bidder in the event of price escalation. In case if there is fall in the prices of the Gratuitous Relief (GR) items during the validity period of the prices fixed under this contract, and if the prices in the open market on the day of placement of supply order are lower than the prices fixed and accepted under this tender, the Sub-Divisional Officer (Civil), Rangia shall be at liberty to pay the selected/preferred bidder the lower prices prevailing in the open market vis-à-vis the price fixed under this commercial bid of the tender. For arriving at the reasonableness of the prices to be so re-fixed and paid, the Sub-Divisional Officer (Civil) shall obtain a sample of three open market prices prevailing in Rangia Sub-Division on that particular date of placement of supply order and take an average of three such open market prices and arrive at the final price and it shall be binding on the part the selected/preferred bidder to supply at such lower price so fixed and in case the selected/preferred bidder refuses to do so the Sub-Divisional Officer (Civil), Rangia shall be at liberty to offer the same to other participating bidders in this tender and while doing so shall first give offer to the bidder who is next to the lowest bidder in price terms and in case the bidder refuses then the offer shall be given to the next higher bidder and so on and it shall be binding on all concerned. 18. Other general terms The final acceptance of the tender would be entirely vested with the Sub-Divisional Officer (Civil), Rangia who reserves the right to accept or reject any tender without assigning any reason 15

whatsoever. Further the Sub-Divisional Officer (Civil), Rangia reserves the right not to assign supply of any/some of the item(s) mentioned in the scope of contract to the preferred bidder. There is no obligation on the part of the Sub-Divisional Officer (Civil), Rangia to communicate in any way with the rejected bidder. After acceptance of the tender by the Sub-Divisional Officer (Civil), Rangia, the bidder shall have no right to withdraw his tender or claim higher price. Tenders with incomplete information are liable for rejection. 19. Amendments to the tender The Sub-Divisional Officer (Civil), Rangia reserves the right to amend the Tender conditions up to 29-04-2016 Such amendments will be notified in the website www.kamrup.nic.in and notice board of the office of the Sub-Divisional Officer (Civil), Rangia and if possible in newspapers. All the Bidders must periodically browse website, visit notice board of Sub- Divisional Officer (Civil), Rangia office till the closing date of this Tender for any amendments or corrigendum issued in connection with this Tender. Also, amendments to the tender may be given on the basis of clarifications sought for by the prospective Bidders, solely at the discretion of the Sub-Divisional Officer (Civil), Rangia. Further the Sub-Divisional Officer (Civil), Rangia at his discretion may or may not extend the due date and time for the submission of bids on account of amendments.
