AMD @ SIGGRAPH STUDENT ARTWORK CONTEST OFFICIAL CONTEST RULES NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE THE CHANCE OF WINNING. VOID WHERE PROHIBITED. 1. Eligibility: AMD @ SIGGRAPH STUDENT ARTWORK CONTEST (the Contest ) The Contest is open to individuals who: (a) are at least 18 years of age (or at least the minimum age of majority in their place of residence, whichever is greater) as of the start of the Entry Period (defined below); (b) are students enrolled in an accredited post-secondary institution; and (c) submit a valid Entry (as defined below), all as provided herein ( Participant ). Residents of Cuba, North Korea, the Sudan, Syria, Burma/Myanmar, Quebec or any countries that are restricted from doing businesses with companies based in the United States are not eligible to participate in the Contest. Employees of Sponsor, their respective subsidiaries, affiliates and agents, and the immediate family (defined as parents, children, siblings, domestic partner, husband or wife) of each such employee, together with those with whom such employees are domiciled, are not eligible to participate. Sponsor reserves the right to disqualify any Participant if Sponsor determines, in its sole discretion that Participant s participation in the Contest or receipt of a prize would violate local law or cause damage to the reputation of AMD and/or any other party. Participant may be required to submit confirmation of his/her eligibility to participate in this Contest. This Contest is being held in the United States and Canada (excluding Quebec) and is void where prohibited by law or where the administration of this Contest as described herein would be unlawful. 2. Sponsor: The Contest is sponsored by Advanced Micro Devices, Inc., One AMD Place, PO Box 3453, Sunnyvale, CA 94088-3453 ( AMD or Sponsor ). This Contest is in no way sponsored, endorsed or administered by, or associated with, any third party social media site or platform. 3. Agreement to Official Rules: Participation in the Contest constitutes Participant s full and unconditional agreement to, and acceptance of, these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein. 4. Entry Period: The Contest begins on June 19, 2014 5pm CST and ends on July 21, 2014 5pm CST (the Entry Period ). Sponsor s computer will be the official timekeeping device for the Contest. 1

5. Submission of Entries: In order to participate, Participants must visit http://experience.amd.com/siggraph2014-artwork-contest/ and follow the directions provided to complete the Entry form, and will shortly thereafter receive an email with directions on how to submit an original piece of artwork in the form described below (collectively, the Entry ). Participant grants to AMD a perpetual, royalty free, worldwide, sublicenseable, non-exclusive license to the Entry (including the right to modify and/or make derivative works of the Entry) and waives any and all moral rights therein. AMD may make such use of the Entry as AMD determines necessary, in its sole discretion, to advertise the Contest, including but not limited to use on or for: social media platforms, print or digital advertising, online advertising/web-site branding and pop up banners. This license will survive in all cases, regardless of whether Participant is a winner of the Contest or is disqualified, all as described herein. 6. Limit of Entries: Each Participant may only submit one (1) Entry into this Contest. Any attempt by any Participant to submit more than one Entry (e.g.; by using multiple/different e-mail accounts, email addresses, identities, registrations and logins, or any other methods) will void all that Participant's Entries and Participant will be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the e-mail account used to register will be deemed to be the Participant. The authorized account holder is the natural person assigned the e-mail account used to register for the Contest. The potential winner may be required to show proof of being the authorized e-mail account holder. Sponsor is not responsible for any lost, late, incomplete, invalid, illegible or misdirected Entry, which may be disqualified, or for any error, human, technical or otherwise. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Contest to be acting in violation of these Official Rules. Only one Entry per Participant will be judged. 7. Entry Guidelines: a. The Entry must not have been entered into any other contest or promotion; b. The Entry must not contain material that violates or infringes another s rights, including but not limited to privacy, publicity, copyright, trademark, patent, or intellectual property- or property-related rights; c. The Entry must not disparage Sponsors or any other person or party affiliated with the promotion and administration of the Contest; d. The Entry must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous; 2

e. The Entry must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; f. The Entry must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where Contest is held; g. The Entry must not contain material that is of a violent nature; and h. Entry must be the original work of the Participant. If the Entry contains any material or elements that are not owned by the Participant, and/or which are subject to the rights of third parties, the Participant is responsible for obtaining, prior to submission of the Entry, any and all releases and consents necessary to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the Entry. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any Participant at any time. Failure to provide such proof may, if requested, render Entry null and void and disqualify the Participant. By submitting an Entry, Participant warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to its use as otherwise set forth herein. i. Entry must: include two artwork files that meet the following requirements: Press ready High Resolution as outlined below. VECTORs: Work in CMYK mode Always convert fonts to outlines Save/export as.ai or.eps format RASTERs: CMYK & Greyscale minimum 300 dpi at print size 22 in x 28 in Bitmap line art minimum 300 dpi at print size 22 in x 28 in Low resolution images are not acceptable. Files not considered press ready ; Photocopies, PowerPoint files, word documents, low resolution jpgs 3

By submitting an Entry, Participant agrees that Participant s Entry conforms to these Guidelines and Official Rules and that Sponsor, in its sole discretion, may disqualify Participant if Sponsor determines, that Participant s Entry or any part thereof fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by Sponsor. In addition, Participant agrees to indemnify Sponsor, its subsidiaries, affiliate and agents for damages any of them may suffer as a result of Participant s breach of, or failure to conform to, these Official Rules. 8. Winner Selection: After the close of the Entry Period, a jury selected by Sponsor will review and score the eligible Entries and will select thirteen (13) finalists with the highest scores. One (1) Grand Prize winner, two (2) Second Prize winners and ten (10) Honorable Mention winners will be selected from among the finalists. Following is scoring criteria that will apply to selection of finalists and winners: Scoring Criteria: In the sole opinion of the judges: 50% of the score for ORIGINALITY (a) Does this work possess creativity? (b) Does this work possess individuality? (c) Does this work show imagination? 25% of the score for TECHNIQUE Does the work demonstrate skillful use of hardware and software tools? 25% of the score for COMMUNICATION Does the work elicit a strong and positive emotional response? The Entry that receives the highest score according to the scoring criteria will be the potential Grand Prize winner, the next two highest scores will be the potential Second Prize winners, and the next ten highest scores will be the potential Third Prize winners. In the event of a tie, the Entry with the highest score for Originality will be the potential winner. In the event that a tie persists (i.e. scores for Originality are the same between Entries of multiple Participants) the Entry received first by AMD will be the potential winner. The interpretation of the aforementioned scoring criteria shall be that of the individual judges in their sole and unfettered discretion and not subject to dispute under any circumstances. The potential winners will be notified by e-mail at the email address provided on the Entry form by July 28, 2014. Potential winners will be required to sign and return to Sponsor, within three (3) days of the date notice is sent, a confirmation of an Affidavit of Eligibility, Liability, Publicity Release and Assignment of Rights ("Affidavit") (except where prohibited) in order to claim his/her prize. NOTE: POTENTIAL WINNERS WILL BE REQUIRED TO IRREVOCABLY ASSIGN ALL RIGHT, TITLE, AND INTEREST IN AND TO 4

THEIR ENTRY TO AMD AND TO WAIVE ALL MORAL RIGHTS THEREIN. If a potential winners cannot be contacted, fails to respond to the notification within the required time period (if applicable), or fails to sign and return the Affidavit within the required time period (if applicable), or if a potential winners is disqualified for any other reason, he/she forfeits the applicable prize, and Sponsor will attempt to award the prize to an alternate potential winners. The alternate potential winner will be the Entry with the next highest score according to the scoring criteria. If after three attempts to award a prize a potential winner cannot be confirmed, the prize will not be awarded. A POTENTIAL WINNER WILL NOT BE A WINNER OF THE CONTEST UNLESS AND UNTIL THE POTENTIAL WINNERS IS CONFIRMED IN ACCORDANCE WITH THE PROCEDURES SET FORTH IN THESE OFFICIAL RULES. 9. Prizes: One (1) Grand Prize - one (1) AMD FirePro W7000 graphics card 4GB (ARV: $749); winner s Entry printed on t-shirt to be given out at the AMD booth at SIGGRAPH 2014 and exhibit winner s original Entry AMD booth structure at SIGGRAPH 2014. Two (2) Second Place Prizes each second place prize consists of exhibit winner s Entry on AMD booth structure at SIGGRAPH 2014 and a $100 Visa Gift Card. Visa gift cards are subject to Visa s additional terms and conditions. Ten (10) Third Place Prizes each third place prize consists of a $50Visa Gift Card. Visa gift cards are subject to Visa s additional terms and conditions. 10. Prize Conditions: Total ARV of prize pool: $1449 USD. Prize value projected as of June 6, 2014. Prize must be accepted as awarded and may not be transferred, substituted or redeemed for cash or otherwise, except at Sponsor s sole discretion or as contemplated herein. Sponsor reserves the right to substitute a prize of equal or greater monetary value if the prize, or any component of the prize, cannot be awarded for any reason. Sponsor is responsible only for prize delivery; not responsible for prize utility, quality or otherwise. Taxes and fees, if any, are the sole responsibility of prize winner. All prize details not specified in these Official Rules will be determined in Sponsor s sole and absolute discretion. Allow up to eight (8) weeks for shipment of physical prizes. Potential winners may waive their right to receive a prize, in which case an alternate winner will be selected in the manner described above. 11. Privacy: You understand that you are providing your information to Sponsor, and not to any third party social media site or any other digital/printed media. Any personal data a Participant submits will be stored on servers in the United States of America. Where applicable, Entry into the Contest constitutes Participant's consent to the export of any personal data collected by Sponsor to the United States of America and its use there only for the purposes of administering this Contest and associated processing (e.g., but not 5

limited to back-up, archiving). Participants' personal data will be stored on these servers and used for the purposes of administering this Contest and associated processing of Entries. For further information about how Sponsor manages your personal data, please see Sponsor s privacy policy at http://www.amd.com/en-us/who-we-are/privacy. 12. Release: By participating in the Contest Participant agrees to release and hold harmless Sponsor, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company s officers, directors, employees and agents (collectively, the Released Parties ) from and against any claim or cause of action, including, but not limited to, damage to or loss of property, arising out of Participant s participation in the Contest, infringement of third party rights or receipt or use or misuse of any prize. 13. Publicity: Except where prohibited by law, participation in the Contest constitutes Participant s consent to Sponsor s use of names, images, likenesses, Entries, personal testimonials, the name of the educational institution Participant attends (if applicable), city and country of residence for promotional purposes in any media or format, worldwide, without further payment or consideration, including but not limited to posting Entry online. 14. General Conditions: Sponsor reserves the right to terminate, amend, suspend or modify this Contest in whole or in part, at any time and without notice or obligation, if in Sponsor s sole discretion, any factor interferes with its proper conduct as contemplated by these Official Rules. Without limiting the generality of the foregoing, if, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the Entry process. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or of any other provision of these Official Rules. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. 15. Limitations of Liability: The Released Parties are not responsible, to the extent permitted by law, for: (1) any incorrect or inaccurate information, whether caused by Participants, printing errors or omission or by any of the equipment or programming associated with or 6

utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to property which may be caused, directly or indirectly, in whole or in part, from Participant s participation in the Contest or receipt or use or misuse of any prize. If for any reason a Participant's Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Participant s sole remedy is another Entry in the Contest provided that if it is not possible to award another Entry due to discontinuance of the Contest, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible Entries received up to the date of discontinuance for any or all of the prizes offered herein. 16. Disputes: Except where prohibited, Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California or the appropriate California State Court located in Santa Clara County, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys fees; and (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
