BONDURANT CITY COUNCIL REGULAR MEETING Meeting No. 13-15 A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 05th day of August, 2013, at 6:00 p.m. Present: Absent: Mayor Keith Ryan Council Member Amy Bogaards Council Member Jerry Fischer Council Member Eric Johnson Council Member Brian Lohse Council Member Curt Sullivan City Administrator Mark Arentsen City Attorney David Brick City Engineer Bob Veenstra Deputy City Clerk Michelle Wells None Notice of the meeting was posted at the Bondurant City Center, Casey s General Stores, Legacy Bank and the United States Post Office on August 02, 2013. All proceedings hereafter shown were taken while the convened meeting was open to the public. Roll Call was taken and a quorum was declared. Mayor Ryan called the meeting to order at 6:03 p.m. Mayor Ryan led the pledge of allegiance. Motion made by Council Member Bogaards, seconded by Council Member Johnson, to approve the agenda as presented. Roll Call: Ayes: 5. Nays: 0. Motion carried. Motion made by Council Member Bogaards, seconded by Council Member Lohse, to approve the Consent Items consisting of the City Council Meeting Minutes of July 15, 2013, Planning and Zoning Commission Meeting Minutes of June 06, 2013, the Claims Report and Tax Abatement Application for Edwin Lust, 517 3rd Street, Southeast, Bondurant, Polk County, Iowa. Roll Call: Ayes: 5. Nays: 0. Motion carried. Polk County Sheriff s Department Deputy Ryan Phillips stated that there have been reports of suspected break-ins at Kading Properties, but proved to be kids breaking windows that live in the complex.

Page Two Roger Rowland, Bondurant-Farrar LadyJays Softball Coach, introduced the team members and assistant coaches and stated the team was humbled and thrilled to have won the Girls Softball State Championship. Motion made by Council Member Bogaards, seconded by Council Member Fischer, to approve Resolution No. 13-137, a Resolution recognizing the accomplishments of the Bondurant-Farrar LadyJays Softball Team. Roll Call: Ayes: 5. Nays: 0. Motion carried. Motion made by Council Member Bogaards, seconded by Council Member Lohse, to close the regular City Council meeting at 6:16 p.m., and open the Public Hearing for consideration of amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by adding a new Chapter 104, Sanitary Sewer Connection Fee District. Roll Call: Ayes: 5. Nays: 0. Motion carried. No public comments were received during the Public Hearing. Motion made by Council Member Bogaards, seconded by Council Member Johnson, to close the Public Hearing at 6:18 p.m., and open the regular City Council meeting. Roll Call: Ayes: 5. Nays: 0. Motion carried. Motion made by Council Member Sullivan, seconded by Council Member Bogaards, to waive the first and second reading of Ordinance No. 13-204, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by adding a new Chapter 104, Sanitary Sewer Connection Fee District and approve as the third and final reading. Roll Call: Ayes: 5. Nays: 0. Motion carried. Motion made by Council Member Bogaards, seconded by Council Member Johnson, to approve the proposed changes and approve the first reading of Ordinance No. 13-205, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by adding a new Chapter 53, Noise Control. Roll Call: Ayes: 5. Nays: 0. Motion carried. Motion made by Council Member Lohse, seconded by Council Member Bogaards, to approve Resolution No. 13-138, a Resolution approving Fund Transfers. City Administrator Arentsen led a discussion on the proposed Lincoln Street, Southeast, underpass and Municipal Code Section 51.06, Outdoor Storage of Motor Vehicles. Chris Bogaards, Deputy Chief, Bondurant Emergency Services, presented quotes and a Formal Proposal prepared by Jeff Kromrie, Deery Group, for two, first responder replacement vehicles. Deputy Chief Bogaards also stated that the Department was looking into purchasing a used ambulance to be used in a backup capacity. After a lengthy discussion, Council Member Lohse

Page Three stated that he and his wife Mary have been touched by the professionalism of the Fire Department for several years and they know the impact that the department has on the City, adding that they have been searching for a way to thank the City and the Fire Department. He said the family foundation would like to fund the purchase of the two trucks and ambulance. The following item(s) were discussed as part of Mayor Ryan s comments: Asked Council to read the letter from resident at 301 2nd Street, Northwest, and the City Engineer s response, pertaining to the drainage issue between the property of 301 2nd Street, Northwest, and 114 Blaine Street, Northwest. This will be a discussion item at the August 19, Council meeting. Nomination papers for November election available August 12, at City Hall. The following item(s) were discussed as part of City Administrator Arentsen s comments: WRA sewer connection update. Two REAP grants will be submitted August 15. Looking into increasing the water purchase capacity from Des Moines Water Works, as we are close to the amount allowed. Starting Renaud Ridge Plat 2 soon. Received inquiry pertaining to Board of Adjustment meeting scheduled for August 13. The following item(s) were discussed as part of Council Member s and City Attorney Brick s comments: Council Member Bogaards Asked about Prairie Meadows Grant application deadline; and announced Fire Department Association annual BBQ on September 14. Council Member Johnson The Freedom Rock looks awesome; BRSC news: things have been pretty dead but picking up August 17; budget will be back on track after we make some adjustments; and getting ready to hook bathrooms up to the sewer system. Council Member Sullivan Asked for update on traffic signal on Highway 65 by Git-N-Go. Council Member Fischer No comment. Council Member Lohse Suggested inquiring about additional stop sign at 3rd Street, Southeast. City Attorney Brick Reviewed open meetings law.
