Background and Summary of Proposal There have been five Conditional Use Permits for Religious Uses in the subject shopping center since 1998. The church is seeking to relocate from 3540 Holland Road and lease space within an existing 5,000 square-foot unit in this shopping center, also along Holland Road. As this unit was not one of the previous particular requests within the center for a Conditional Use Permit, a Conditional Use Permit for Religious Use is required. In addition to church activities, the applicant intends to provide childcare services at the site with up to five employees. Childcare is a permitted use in the B-2 Business District. The general planning principles for the Suburban Area focus on creating and maintaining great neighborhoods through stability and sustainability; protecting and enhancing open spaces and places of cultural and historical significance; and creating and maintaining a transportation system that provides connectivity and mobility. Achieving these goals requires that all land use activities either maintain or enhance the existing neighborhood through compatibility with surroundings, quality and attractiveness of site and buildings, improved mobility, environmental responsibility, livability, and effective buffering with respect to type, size, intensity and relationship to the surrounding uses. Natural and Cultural Resources Impacts This site is within the Chesapeake Bay watershed. As the property is almost entirely impervious, there do not appear to be any significant natural or cultural resources associated with the site. This section of Holland Road is designated on the City s MTP as ultimately a six-lane divided facility. There are no CIP roadway projects planned for this area of Holland Road. Public Utility Impacts Water & Sewer This site is currently connected to both City water and sanitary sewer service. Evaluation and Recommendation This Conditional Use Permit request to allow a Religious Use within a 5,000 square-foot unit within an existing shopping center along Holland Road is consistent with the land use policies for the Suburban Area as it compatible with surrounding residential and commercial uses. The site has adequate parking and there do not appear to be any conflicts between the proposed use and existing uses in the shopping center. Staff recommends approval of this request with the conditions below. Recommended Conditions 1. The occupancy shall be as established by the Building Official s Office and the Fire Marshall. 2. The applicant shall obtain all necessary permits and inspections from the Planning Department / Permits and Inspections Division and the Fire Department. The applicant shall obtain a Certificate of Occupancy for the change of use from the Building Official. Further conditions may be required during the administration of applicable City Ordinances and Standards. Any site plan submitted with this application may require revision during detailed site plan review to meet all applicable City Codes and Standards. All applicable permits required by the City Code, including those administered by the Department of Planning / Development Services Center and Department of Planning / Permits and Inspections Division, and the issuance of a Certificate of Occupancy, are required before any uses allowed by this Use Permit are valid.
