The tenderer should have successfully executed similar type of works during last 3 (three) years in State Govt./ Central Govt. / Govt. undertaking / Urban local bodies / PSUs. The tenderer can purchase the tender documents from the office of the, Project Management Unit, OWSSB at Water works Road, Puri during office hour on payment of cost of DTCN in shape of account payee Demand Draft/Banker s Pay Order (Non-Refundable) drawn in favour of the, on any Nationalized Bank payable at Puri. The tender documents can also be downloaded from the Website http://puri.nic.in from dated 25.04.2015 to 04.05.2015. The intending Tenderer can use the down loaded tender documents provided that the cost of tender paper is furnished with the Tender Documents in shape of Demand Draft / Pay Orders in favour of Project Engineer, payable at Puri along with the tender. The DD / Pay orders towards cost of Tender Paper (downloaded) should be made within the last date of sale of Tender Paper i.e. dated 04.05.2015, failing which the tender will be liable for rejection. OWSSB shall not be held responsible for any delay / difficulties / inaccessibility of the downloading facility for any reason whatsoever. If the last date of sale of Tender Paper will be declared as holiday, the next working day will be the last date of sale of Tender Paper. The EMD should be in shape of account payee Demand Draft / Banker s Pay Order drawn in favour of the, payable at any Nationalized Bank at Puri. 4 SCOPE OF WORK AND GENERAL INSTRUCTIONS FOR BIDDERS 1. The, invites tender from registered Manpower service provider/ agency/ Organisation to provide Manpower services i.e. Junior Engineer (Electrical), Pump Operator, Electrician, Watchman, Sewerage worker, etc. On contractual basis for day to day operation and maintenance of 15 MLD Sewage treatment plant. 2. The contract for providing the aforesaid Manpower services is likely to commence from 01.06.2015 and would continue till 31.05.2016. The period of the contract may be further extended beyond 31.05.2016 provided the requirement of the OWSSB/Department for manpower persists at that time at the same contract price with allowable increase in cost as per WPI of RBI on approval of competent authority or may be curtailed/terminated before 31.05.2016 (date) owing to deficiency in service or substandard quality of manpower deployed by the selected Service Provider Agency/Organisation or because of change in the OWSSB/Department s requirements. The OWSSB/Department, however, reserves right to terminate this initial contract at any time after giving two week s notice to the selected Service Provider/ agency. 3. OWSSB/Department has tentative requirement for 31 nos. different category personnel as listed in the DTCN Price bid. The requirements may increase/decrease in any/all the categories. 4. The estimated cost of the contract is Rs. 2893368.00 including EPF, ESI, Service tax, Labour cess, and service charges. 5. The interested Agency/Organisation may submit the tender document complete in all respects along with Earnest Money Deposit (EMD) of Rs. 29000.00 and other requisite documents by 07.05.2015 up to 5.00 PM to, PMU, OWSSB, water works road, infront of Hellipad, Puri-752002. 6. The tender has been invited under one bid system. The bid documents shall be submitted in one sealed envelope super scribing Tender for Providing Manpower Services to Orissa Water supply and Sewerage Board. 7. The Earnest Money Deposit (EMD) of Rs. 29000.00 (Rupees Twenty nine thousand only), should be necessarily accompanied with the Bid document in the form of Demand Draft / Pay Order drawn in favour of,, in any Nationalised bank payable at Puri, failing which the tender shall be rejected summarily. The EMD of unsuccessful tenders would be returned ( without interest ) after finalisation of tender. 8. Successful bidders, after issue of LOI (Letter of Intent) by, shall submit initial security deposit (ISD), 2% of the accepted contract value in the form of Bank Draft / Pay order in favour of, PMU, OWSSB, Puri, in any Nationalised bank payable at Puri, The EMD amount furnished by successful bidder will be adjusted towards ISD. 9. Additional Performance Security shall be deposited by the successful bidders when the bid amount is seriously unbalanced i.e. less than the estimate cost by more than 10%. In such event the successful bidder will deposit the additional performance security to the extent of the differential cost of the bid amount to the estimated cost in shape of DD/Pay Order /NSC/ KVP/POSB/POTD/ Deposit receipt of schedule Bank drawn/pledged in favour of Project Engineer. PMU,OWSSB, Puri.

The Tendering Agency / Organisation are requested to enclose photocopies of the following documents (duly Notarised or attested by Gazetted Officer of the State Governments / Central Government), along with the Technical Bid, failing which their bids shall be summarily rejected I) Registration of agency / Organisation. II) PAN card. III) Documents in support of the Financial turnover of the agency IV) Service Tax Registration / Clearance certificate. V) EPF & ESI registration certificate. 11. The conditional bids shall not be considered and will be out rightly rejected in very first instance. 12. All entries in the tender form should be legible and filled clearly. If the space for furnishing information is insufficient, a separate sheet duly signed by the authorised signatory may be attached. No overwriting or cutting is permitted in the Bid Form. In such cases, the tender shall be summarily rejected. However the Over writing or the cuttings, if any, in the Bid Application must be initialled by the person authorised to sign the tender bids. 13. The bids shall be opened on the scheduled date and time at 11.30 AM on 08.05.2015 in the office room of,, in the presence of the representatives of the Manpower Service Providers Agency/ Organisation, if any who wish to be present on the spot at that time. 15. The Competent Authority of the Orissa Water Supply and Sewerage Board reserves the right to reject any or all bids without assigning any reason.

6 TECHNICAL REQUIREMENT TECHNICAL REQUIREMENTS FOR THE MANPOWER SERVICE PROVIDER AGENCY/ ORGANISATION 1. The tendering Agency/Organisation should fulfil the following technical specifications: (a) The Agency/Organisation shall have to open an office within 7 days after award of the contract and shall be located within Puri. The Agency/Organisation should provide the name, designation and contact number of the person to liaise with OWSSB/ Department/ Office. (b) They should have their own Bank Account; (c) They should be registered with Income Tax and service Tax departments; (d) They shall have registered with appropriate authorities under Employees Provident Fund and ESI. (e) Minimum turn-over requirement -.Minimum 25.00 lakhs per annum. (Last three years) (f) Necessary documents copies should be furnished to full fill the requirement, either attested or notarized from competent authority. The tenderer shall provide the original document for verification if required by the competent authority. Failling to produce the original documents the contract will be cancelled/ rescinded. (g) Good moral character certificate of service personnel shall be provide from a Gazetted Officer for at least three years. (h) Physical fitness certificate from CDMO/ ADMO/ Asst. Surgeon of District Head quarter Hospital is to be furnished for all categories of manpower by successful agency, within one month from award of work. (i) Necessary documents copies regarding minimum educational qualification and experience should be furnished, either attested or notarised in respect of all categories of services ( as per Table-1)..

8 GENERAL TERMS & CONDITIONS 1. Safety equipments like helmet, Hand gloves, towel, Gun boot, Uniform, are to be provided by the manpower provider to their personnel as per requirement and to be approved by Authority. 2. The deployed personnel shall have uniform as prescribed by office and their name shall be displayed through a badge. 3. The Agreement shall commence from 01.06.2015 and shall continue till 31.05.2016 unless it is curtailed or terminated by the authority owing to deficiency of service, substandard quality of manpower deployed, breach of contract etc. or change in requirements. 4. The Agreement shall automatically expire on 31.05.2015 unless extended further by the mutual consent of the agency/organisation and the Authority on same terms and conditions or modified. 5. The Agreement may be extended, on the same terms and conditions, or with some additions/deletions/modifications, for a further specific period of three years mutually agreed upon by the Manpower Service Provider Agency/ organisation and the Authority if the performance during the present contract period is found satisfactory by the authority. 6. Manpower Service Provider Agency/ organisation shall not be allowed to transfer, assign, pledge or subcontract the rights and liabilities under this Agreement to any other agency or organisation by whatever name be called without the prior written consent of the Authority. 7. At present, OWSSB has requirement for 31 nos. of different category skilled and unskilled personnel as mentioned in the DTCN. The requirement of the man power may further increase or decrease marginally, during the period of initial contract and also the tenderer would have to provide additional manpower services, if required, on the same terms and conditions. 8. Manpower Service Provider Agency/ organisation will be bound by the details furnished by it to the Authority while submitting the tender or at subsequent stage. In case, any of such documents furnished by it is found to be false at any stage, it would be deemed to be a breach of terms of Agreement making it liable for legal action besides termination of the Agreement. 9. The Authority reserves the right to terminate the Agreement during initial period also after giving 30 days notice to the Manpower Service Provider Agency/ organisation.

9 10. The persons deployed shall be required to report for work at schedule time to the Officer/supervisor as may have been kept by in charge of the Office Establishment of the office concerned and would leave at schedule time after handing over charge to his reliever and may also require to work beyond schedule time for which he would not be paid any extra remuneration. In case, the person deployed remains absent on a particular day or comes late/leaves early on three occasions, proportionate deduction from the remuneration for one day will be made and the service provider shall provide a substitute well in advance. 11. The person deployed may be called on holidays during urgency/ emergency to attend duty and shall not be paid extra remuneration by this office on attending such duty. 12. The Manpower Service Provider Agency/ organisation shall nominate a coordinator/ Supervisor who shall be responsible for immediate interaction with the Office so that optimal services of the persons deployed could be availed without any disruption. 13. The entire financial liability in respect of manpower services deployed in the Sewage Pumping stations of the Office concerned shall be that of the Manpower Service Provider Agency/ organisation and the Department or Office concerned will in no way be liable. It will be the responsibility of the Manpower Service Provider Agency/ organisation to pay to the person deployed a sum not less than the minimum wage rate quoted in the financial bid and produce such evidence as may be required by the OWSSB / Office concerned. 14. For all intents and purposes, the Manpower Service Provider Agency/ organisation shall be the Employer within the meaning of different Rules & Acts in respect of manpower so deployed. The persons deployed by the Manpower Service Provider Agency/Organisation shall not have any claim whatsoever like employer and employee relationship against the Department or Office concerned. 15. The Manpower Service Provider Agency/ organisation shall be solely responsible for the redressal of grievances or resolution of disputes relating to persons deployed. The Department shall, in no way, be responsible for settlement of such issues whatsoever. In case the grievances of the deployed person are not attended to by the Manpower Service Provider Agency/ organisation the deployed person can place their grievance before a Joint Committee consisting of a representative of the OWSSB/ Department or Office concerned and an Authorised representative of the Manpower Service Provider Agency/ organisation. 16. The OWSSB/Department shall not be responsible for any financial loss or any injury to any person deployed by the Manpower Service Provider Agency/ organisation in the course of their performing the functions/duties, or for payment towards any compensation. The Manpower service provider Agency/ organisation should make insurance of the

10 employees for any such type of incidents on life/ accident/ injury etc. Evidence of insurance deed in favour of the deployed employees / manpower shall be furnished to the OWSSB/ Office by the agency/ organisation after award of work, within one month time. 17. The Manpower service provider Agency/Organisation shall provide quality in: Cleaning of sump deposits, removal of solid wastes, LT electrical system, Pump house operation, lighting system, etc. The quality of services by the agency/ organisation shall be accessed through monthly basis. The Agency/ organisation shall submit the assessment forms duly filled up and signed by competent authority to the office along with bills for the work.

The persons deployed by the Manpower Service Provider Agency/Organisation shall not claim nor shall be entitled to pay, perks and other facilities admissible to regular / confirmed employees during the currency or after expiry of the Agreement. 19. In case of termination of this Agreement on its expiry or otherwise, the persons deployed by the Manpower Service Provider Agency/ Organisation shall not be entitled to and shall have no claim for any absorption in regular or other capacity. 20. The person deployed shall not claim any benefit or compensation or absorption or regularisation of deployment with office under the provision of rules and Acts. Undertaking from the person deployed to this effect shall be required to be submitted by the Manpower Service Provider Agency/ Organisation after award of work, within 15 days. 21. The Manpower Service Provider Agency/Organisation must be registered with the concerned Govt. Authorities, i.e. State Govt. Labour Commissioner, Provident Fund Authorities, etc. after award of work/ prior to award of work as applicable, and a copy of the registration should be submitted. The Manpower Service Provider Agency/Organisation shall comply with all the legal requirements for obtaining License under Contract Labour (Regulations and Abolition) Act, 1970 if any, at his own part and cost.* 22. The Manpower Service Provider Agency/Organisation shall provide a substitute well in advance if there occurs any probability of the persons leaving the job due to his own personal reasons. The payment in respect of the overlapping period of the substitute shall be responsibility of the Agency/Organisation. The Manpower Service Provider Agency/Organisation shall be responsible for contributions towards Provident Fund and Employees state insurance wherever applicable. 23. The persons deployed by the Manpower Service Provider Agency/Organisation should have good police records and no criminal case should be pending against them. Police clearance certificate shall be provided against all personnel deployed/to be deployed by the successful tenderer after execution of agreement to the authority for verification and acceptance within three months from award of work order. 24. The persons deployed should be polite, cordial and efficient while handling the assigned work and their actions should promote good will and enhance the image of the Employer/ Office concerned. The Manpower Service Provider Agency/Organisation shall be responsible for any act of indiscipline on the part of the persons deployed. In case of any deviation, the agency/ Organisation shall remove errant personnel on written order from employer. *Note :- Registration / License under the Contract Labour (Regulation and Abolition) Act, 1970 is applicable Manpower Service Provider employing more than 20 workmen.

13 LEGAL 25. The persons deployed shall, during the course of their work be privy to certain qualified documents and information which they are not supposed to divulge to third parties. Breach of this condition shall make the Manpower Service Provider Agency/Organisation liable for rescission of contract. 26. The Manpower Service Provider Agency/Organisation shall be responsible for compliance of all statutory provisions relating to minimum wages payable to different types of worker in respect of the persons deployed by it in the field or office concerned. The OWSSB shall have no liability in this regard. 27. The Manpower Service Provider Agency/Organisation shall also be liable for depositing all taxes, levies, Cess etc. on account of service rendered by it to the Department or office concerned to the concerned tax collection authorities, from time to time, as per the rules and regulations in the matter. Attested Xerox copies of such documents shall be furnished to OWSSB. As per statutory requirement, the employer shall deduct TDS from bills of agency/ Organisation from time to time. 28. The Manpower Service Provider Agency/Organisation shall maintain all statutory registers under the Law and shall produce the same, on demand, to the authority of the Department or office concerned or any other authority under law. 29. The Tax deduction at Source (T.D.S.) shall be done as per the provisions of Income Tax Act/Rules, as amended, from time to time and a certificate to this effect shall be provided by OWSSB. 30. In case, the Manpower Service Provider Agency/Organisation fails to comply with any liability under appropriate law, and as a result thereof, the OWSSB will put to any loss / obligation, monetary or otherwise, the OWSSB will be entitled to get itself reimbursed out of the outstanding bills or the Performance Security Deposit of the Manpower Service Provider Agency/Organisation, to the extent of the loss or obligation in monetary terms. 31. The Agreement is liable to be terminated because of non-performance, deviation of terms and conditions of contract, non-payment of remuneration of employed persons and non-payment of statutory dues. OWSSB will have no liability towards non-payment of remuneration to the persons employed by the Manpower Service Provider Agency/Organisation and the outstanding statutory dues of the service provider to statutory authorities. If any loss or damage is caused to OWSSB by the persons deployed, the same shall be recovered from the unpaid bills or adjusted from the Performance Security Deposit/ ISD.

14 FINANCIAL 32. The Bid should be accompanied with an Earnest Money Deposit (EMD), refundable without interest, of EMD Rs 29000.00 in the form of Demand Draft / Pay Order drawn in favour of, failing which the tender shall be rejected out rightly. 33. The Earnest Money Deposit in respect of the Agencies/Organisation which do not qualify shall be refunded to them without any interest. In case of successful tenderer if the agency fails to deploy the required manpower against the initial requirement within 15 days from date of placing the order/ drawal of agreement the giving any further notice. EMD shall stand forfeited without 34. Successful bidders, after issue of LOI (Letter of Intent) by, PMU, OWSSB, Puri shall submit initial security deposit (ISD), 2% of the accepted contract value in the form of Bank Draft / Pay order in favour of, PMU, OWSSB, Puri, in any Nationalised bank payable at Puri, The EMD amount furnished by successful bidder will be adjusted towards ISD. 35. Additional Performance Security shall be deposited by the successful bidders when the bid amount is seriously unbalanced i.e. less than the estimate cost by more than 10%. In such event the successful bidder will deposit the additional performance security to the extent of the differential cost of the bid amount to the estimated cost in shape of DD/Pay Order /NSC/ KVP/POSB/POTD/ Deposit receipt of schedule Bank drawn/pledged in favour of. PMU,OWSSB, Puri. 36. In case of breach of any terms and conditions attached to this agreement, the Performance Security Deposit and ISD of the Manpower Service Provider Agency/Organisation shall be liable to be forfeited besides annulment of the Agreement. 37. The Manpower Service Provider Agency/Organisation shall raise the bill, in triplicate, along with attendance sheet and Quality assessment sheets duly verified by OWSSB in respect of the persons deployed and submit the same to the prescribed authority/ OWSSB in the first week of the succeeding month. As far as possible the payment will be released by the second week of the succeeding month. 38. The claims in bills regarding Provident Fund, and Service Tax etc. should be necessarily accompanied with documentary proof pertaining to the concerned bill month. A requisite portion of the bill or whole of the bill amount shall be held up till such proof is furnished, at the discretion of OWSSB/Department authorities. 39. The amount of liquidated damage calculated @ Rs. 500 per day on account of delay, if any, in providing a suitable substitute for the period beyond three working days by the Manpower Service Provider Agency/Organisation shall be deducted from its monthly bills in the succeeding month.

15 40. The Authority reserves the right to withdraw or relax any of the terms and condition mentioned above so as to overcome the problem encountered at a later stage. 41. In the event of any dispute arising in respect of the clauses of the agreement the same shall be resolved through negotiation. Alternatively the dispute shall be referred to the higher authority Chief Engineer, OWSSB for his decision and the same shall be binding on all parties. 42. All disputes shall be under the jurisdiction of the court at Puri. 43. The successful bidder will enter into an agreement with OWSSB for supply of suitable and qualified manpower as per requirement of OWSSB on the above terms and conditions.

17 AGREEMENT This Agreement is made on this day of Between the Orissa Water supply and Sewerage Board represented by, here-in-after referred to as the Authority which expression shall, where the context so requires or admits, also include its successors or assignees of the one part; And M/s represented by Sri, here-in after called the Manpower Service Provider Agency/Organisation which expression shall, where the context so requires or admits, also include its successors or assignees of the other part. Whereas, the Authority desires that the services of are required in OWSSB; And whereas the Manpower Service Provider Agency/Organisation has offered its willingness to the same in conformity with the Provisions of the agreement; And whereas the Authority has finalized the rate as per the terms and conditions of the agreement to the Manpower Service Provider Agency/Organisation.

18 Now this agreement witnesses as below:- 1. That the Annexure containing the Terms and Conditions shall be deemed to form and to be read and construed as part of this agreement. 2. That in consideration of the payment to be made by the Authority to the Manpower Service Provider Agency/Organisation, the Manpower Service Provider Agency/Organisation hereby agrees with the Authority to provide personnel to be engaged as in the (name of the OWSSB) in conformity with the provisions of the Terms and Conditions. 3. That the Authority hereby further agrees to pay the Manpower Service Provider Agency/Organisation the contract price at the time and in the manner prescribed in the said Terms and Conditions. 4. That in the event of any dispute that may arise it shall be settled as per the Terms and conditions of the contract. 5. That this agreement is valid upto. IN WITNESS WHEREOF the parties have caused their respective common seals to be here unto affixed or have here unto set their respective hands and seals on the day and year first written above.
