Opredelitev in razmejitev pojmov upravno pravo (nastanek, razvoj, klasifikacija), uprava, državna uprava, javna uprava. Viri upravnega prava in njihov pomen za delo uprave. Sodno pravo kot podlaga za delo uprave. Upravnopravne norme in akti (vrste, medsebojna hierarhija ter odvisnost). Skladnost upravnopravnih norm in aktov. Posebna vprašanja zakonitosti pri izdajanju posamičnih upravnih aktov. Vloga uprave pri uresničevanju človekovih pravic in njeni ustavnopravni vidiki. V okviru predmeta se študentke in študente seznanijo s pojmom in razvojem upravnega prava ter njegovimi temeljnimi inštituti. Predmet obravnava predvsem vprašanja, povezana z viri upravnega prava, nastankom in uporabo upravnopravnih norm, s katerimi se na abstraktni in konkretni ravni urejajo upravnopravna razmerja, poleg tega pa tudi vsa tista vprašanja, ki so pomembna za pravno pravilno in zakonito delo uprave pri izvrševanju njenih funkcij na lokalni in državni ravni. Posebna pozornost je namenjena obravnavi skladnosti upravnopravnih norm z višjimi normami ter obravnavi posebnih problemov zakonitosti (diskrecija, nedoločeni pravni pojmi, pravne praznine) pri izdaji upravnopravnih norm. Obravnavana bodo tudi vprašanja, povezana z vlogo uprave pri uresničevanju človekovih pravic in oblike sodnega nadzora nad pravnimi akti uprave. Definition and demarcation of concepts of administrative Law (formation, development, classification), administration, state administration, public administration. Sources of administrative law and their relevance to the work of the administration. Case law as a basis for the work of the administration. Administrative law norms and instruments (types, the hierarchy and dependence). Consistency of administrative norms and regulations. Specific questions of the legality of the adoption of individual administrative acts. The role of the public administration in the protection of human rights and its constitutional aspects. This course aims to acquaint students the concept and development of administrative law and its core institutes. The course deals primarily with issues relating to sources of administrative law, the formation and use of administrative norms governing not only abstract and concrete administrative relations, but also all those issues which are important for proper legal and legitimate function of the public administration in the execution of its functions at the local and state level. Special attention is paid to addressing the compliance of administrative norms with higher norms and addressing the specific problems of legality (discretion, undefined legal concepts, legal lacunae) in the issuance of administrative norms. It will address the issues related to the role of the administration in the implementation of human rights and forms of judicial review of acts of the administration. Diplomirala je na Pravni fakulteti Univerze v Mariboru. Magistrirala je na Fakulteti za politične znanosti, pravo in javno administracijo Univerze v Atenah (2001) in na Pravni fakulteti Univerze v Mariboru (2002). V letih 2001 in 2002 je sodelovala z Inštitutom za etnične, regionalne in sociološke študije-ecers v Mariboru ter ISCOMET organizacijo, kjer se je ukvarjala z manjšinsko problematiko v Sloveniji in širom po Evropi. Njena raziskovalna področja so bila etnična in verska vprašanja, čezmejno sodelovanje, politični, jezikovni, kulturni in etničnimi vidiki evropske integracije ter dileme učinkovitega delovanja institucij EU. Leta 2002 se je za nekaj let zaposlila v Državnem zboru RS, kjer je bila sekretarka Komisije za odnosi s Slovenci v zamejstvu in po svetu. Osrednji poudarek obeh magistrskih študijev je bil na varstvu manjšin in evropskih integracijah. Tako je npr. Magistrski študij na Pravni fakulteti v Mariboru sklenila z magistrsko nalogo na temo Political, Ethnic, Cultural and Linguistic Aspects of the EU Integration: A View from Candidate States from South Eastern Europe. Doktorirala je na Pravni fakulteti Univerze v Ljubljani iz ekonomske analize prava na temo Kohezijska politika EU in problemi njene implementacije s posebnim poudarkom za Republiko
Slovenijo ter države Jugovzhodne Evrope. Od novembra 2007 se je kot vodja sektorja za pravne zadeve in vodenje javnih naročil na Ministrstvu za okolje in prostor tudi v praksi ukvarjala s področjem evropske kohezijske politike. Od 2009-2011 je bila zaposlena v kabinetu ministra, pristojnega za Slovence v zamejstvu in po svetu dr. Boštjana Žekša, kjer se je ukvarjala s strateškimi projekti, s poudarkom na kroženju možganov. Od 18. februarja 2013 vodi Sektor za investicije in ekonomsko upravljanje na Ministrstvu za okolje in prostor. Pristojnosti Sektorja za investicije v okolje so vezane na pravna, finančna in ekonomska vprašanja ter kontrole na področjih izvajanja večjih okoljskih investicijskih projektov, sofinanciranih s sredstvi EU; javnih služb varstva okolja (pitna voda, odpadki, dimnikarske storitve in podobno) in naravnih nesreč. CURICULUM VITAE (MULEC BREDA, PH. D) Breda Mulec, PH.D was born on 29 May 1975 in Maribor. She graduated at the Faculty of Law at the University of Maribor. Master's degree she received at the Faculty of Political Science, Law and Public Administration at the University of Athens (2001) and the Faculty of Law at the University of Maribor (2002). In 2001 and 2002 she worked at the Institute for Ethnic, Regional and Sociological Studies ECERS - in Maribor and ISCOMET organization, where she was involved in minority issues and projects regarding interregional cooperation in Slovenia and throughout Europe. Her research areas have been ethnic and religious issues, cross-border cooperation, political, linguistic, cultural and ethnic aspects of European integration and the dilemmas of the effective functioning of the EU institutions. Afterwards, she was working a few years for the National Assembly. The main focus of the two Masters Degrees was the protection of minorities and European integration. Thus, for example. Postgraduate studies she concluded at the Faculty of Law in Maribor with a master's thesis on the Political, Ethnic, Cultural and Linguistic Aspects of the EU Integration: A View from Candidate States from South Eastern Europe. She received her PhD at the Faculty of Law at the University of Ljubljana regarding the economic analysis of law with emphasis on EU cohesion policy and its implementation problems, with particular emphasis on the Republic of Slovenia and the countries of South Eastern Europe. Since November 2007, as a Head of the department for Legal Affairs and the public procurement at the Ministry of Environment and Spatial Planning she was dealing in practice with the EU Cohesion Policy. From 2009-2011 she worked in the office of the Minister responsible for Slovenians Abroad dr. Sebastian Žekš, where she worked on strategic projects, with an emphasis on the circulation of the brain and economic cooperation. From 18 February 2013, she works at Ministry
of Environment and Spatial planning as a head of the Department of the environmental investments. She has been dealing with legal, financial and economic issues and control over the major environmental investment projects co-financed by EU funds, public environmental protection services (drinking water, waste, chimney sweeping services, etc. ) and natural disasters. Dr. Mulec has been involved in teaching and scientific research at the Faculty of State and European Studies in Kranj. She is author of several articles and the book on the topics of cohesion policy and the investments projects. Dr. Jernej Letnar Černič je docent za pravo človekovih pravic na Fakulteti za državne in evropske študije, kjer je tudi prodekan. Je nadomestni član Agencije za temeljne pravice. Na Pravni fakulteti Univerze v Ljubljani je diplomiral leta 2002. Za diplomsko delo je prejel študentsko Prešernovo nagrado. Magistriral je na inštitutu Raoul Wallenberg za pravo človekovih pravic na Univerzi v Lundu (Švedska). Doktoriral je v letu 2009 iz prava človekovih pravic in mednarodnega javnega prava na Univerzi v Aberdeenu, Škotska, Združeno kraljestvo. V zadnjih letih je delal na Evropskem univerzitetnem inštitutu, Univerzi New York v Firencah, Mednarodnem kazenskem sodišču, Univerzi v Aberdeenu ter pri Evropskem varuhu človekovih pravic. Jernej serves at the management board of the Fundamental Rights Agency of the European Union. He graduated from the University of Ljubljana with the France Prešeren award and obtained an LL.M in Human Rights Law at the Raoul Wallenberg Institute for Human Rights Law and Humanitarian Law, University of Lund, Sweden. He completed his Ph.D. in Law at the School of Law, University of Aberdeen, Scotland, UK. Jernej has worked at the European Ombudsman's Office, the Superior Court of the Republic of Slovenia, the Law Institute in Ljubljana, the International Criminal Court, and has taught at the University of Aberdeen, University of Lund, New York University and European University Institute. He is a member of the International Human Rights Committee and Feminism and International Law Committee of the International Law Association and of the Institut International des Droits de l Homme.
