Immigration (Fees) (Jersey) Order 2010 Article 1 IMMIGRATION (FEES) (JERSEY) ORDER 2010 THE MINISTER FOR HOME AFFAIRS, in pursuance of sections 5 and 166(3) of the Immigration and Asylum Act 1999 as extended to Jersey, with modifications and exceptions, by the Immigration and Asylum Act 1999 (Jersey) Order 2003 1, orders as follows Commencement [see endnotes] 1 Interpretation In this Order child means a person who has not attained the age of 18 years; civil partner in relation to a person includes the same-sex partner of the person; dependant, in relation to a person, means the spouse or civil partner of the person or a child of the person or of the spouse or civil partner; spouse, in relation to a person, includes an unmarried partner of the person. 2 2 Fees limited leave to remain (1) This Article applies to an application for leave to remain in Jersey for a limited period; or for the variation of leave to remain in Jersey for a limited period. (2) The fee that must accompany the application is where the application is made in in relation to a person who is a work permit holder, 664; where the application is made in relation to a person who is a dependant of a work permit holder (i) where the application is made other than at the time when an application is made in respect of the work permit holder, and Revised Edition 1 January 2017 Page - 5
Article 3 Immigration (Fees) (Jersey) Order 2010 (c) (d) (ii) 664; where sub-paragraph (d) does not apply in respect of the application, where the application is made in relation to a person who is not a work permit holder and sub-paragraph (d) does not apply in respect of the person, 811; where the application is made in relation to a dependant of a person mentioned in sub-paragraph, or (c) at the same time as the application is made in respect of that person, 811. 3 3 Fees indefinite leave to remain (1) The fee that must accompany an application for leave to remain in Jersey for an indefinite period is 1,875. 4 (2) However, if an application under paragraph (1) is accompanied by an application in relation to a dependant of the applicant, the fee to accompany the application of the dependant is 1,875. 5 4 6 5 Exemptions (1) Despite Articles 2 and 3, no fee need accompany an application to which this Article applies. (2) This Article applies to an application for limited or indefinite leave to remain in Jersey made in relation to a person who, on the rejection of the person s claim for asylum, the Lieutenant-Governor has directed be given leave to remain in Jersey for a limited or indefinite period; or a dependant of such a person. (3) This Article also applies to an application for limited or indefinite leave to remain in Jersey made in relation to a person who has not attained the age of 18 years; and who is being provided with any assistance by the States. (4) This Article also applies where the application is for indefinite leave to remain in Jersey as a victim of domestic violence under the Direction of, the Lieutenant- Governor; and the applicant appears to the Minister to be destitute. (5) This Article also applies to an application that is made by a person seeking variation of leave to enter or remain in Jersey for a period of up to 6 months; and that is made to an immigration officer on arrival by the person at a port of entry. Immigration (Fees) (Jersey) Order 2010 Article 6 6 More than one application If 2 applications are made at the same time in relation to the same person, only the highest of the fees that are otherwise required to accompany the applications need accompany them. 7 Citation This Order shall be cited as the Immigration (Fees) (Jersey) Order 2010.
