Government of West Bengal Department of Panchayats and Rural Development 63, Netaji Subhas Road, Jessop Building Kolkata-700 001 No. 3595- PN/O/I/1A-1/2003 (Pt-III) Dated: 8 th October,2003 ORDER In exercise of the power conferred under section 212 of the West Bengal Panchayat Act,1973, the Governor is hereby pleased to direct that the Upa-samitis shall be constituted by the Gram Panchayat concerned in terms of section 4 of the West Bengal Panchayat (Amendment) Act,2003 immediately in the manner as stated below : 1. Constitution of Upa-Samiti: Every Gram Panchayat shall immediately, after the date of its first meeting not exceeding three months, constitute Upa-Samitis under sub-section (2) of section 32A of the Act. Each Upa-Samiti shall consist of the following members, namely, (a) Prodhan and Upa- Prodhan of the gram Panchayat, ex officio; (b) Not more than three members of the Gram Panchayat depending upon the number of members of the Gram Panchayat elected under sub-section (2A) of section 4 of the Act. Members for different Upa-Samitis shall be elected by the Gram Panchayat members from among themselves, referred to in sub-section (2A) of section 4, in a meeting convened by Block Development Officer: Provided that no such member shall be elected for Artha O Parikalpana Upa-Samiti: Provided further that Sanchalaks of all other Upa-Samitis shall be the members of Artha O Parikalpana Upa-Samiti: Provided also that not less than half of the members of Nari, Sishu Unnayan O Samaj Kalyan Upa-Samiti shall be women. (c ) The leader of the recognized political party in opposition having largest number of members in the Gram Panchayat, elected under sub-section (2) of section 4 of the Act, shall be an ex-officio member of Artha 0 Parikalpana Upa-Samiti: Provided that in case of equality in the number of members of two or more recognized political parties in opposition, the leader of a

2 National Party shall get priority over a State Party and the status of a political party shall be determined on the basis of notification issued by the Election Commission of India from time to time:. Provided further that in absence of any member of a recognized political party in opposition, an independent member in opposition, elected under sub-section (2) of section 4 of the Act, and senior in age to any other independent member in opposition, shall be an ex-officio member of Artha 0 Parikalpana Upa-Samiti. (d) Such number of persons being officials of the Gram Panchayat, State Government, Statutory Board or Corporation or such other officials receiving grant, financial assistance or remuneration from the State Government, as the State Government may by order appoint; (e) Any other person, residing within the area comprised in the Gram Panchayat, having specialized knowledge or experience in any subject relating to any of the Upa-Samitis,as the State Government may by order associate; 2. Sanchalak: Within one week from the date of constitution of Upa- Samiti, the members referred to in clause (a) and (b) of rule 1 shall elect in a meeting one member from among themselves as Sanchalak of such Upa-Samiti other than Artha O Parikalpana Upa-Samiti: Provided that the members referred to in rule 1 (d) and (e) shall neither be eligible for election as Sanchalak of an Upa-Samiti nor participate in the process of election: Provided further that Prodhan shall not be Sanchalak of more than one Upa-Samiti other than Artha O Parikalpana Upa-Samiti: Provided also that Sanchalak for Nari, Sishu Unnayan O Samaj Kalyan Upa-Samiti shall be a woman. 3. Number of members in each Upa-Samiti: (1) The number of members in each Upa-Samiti of a Gram Panchayat under Rule 1(b) shall be as follows:- Number of members of a Gram Number of members in each Panchayat Under section 4 (2A) Upa-Samiti under rule 1 (b)

3 10 and below 1 11 to 20 2 21 and above 3 (2) No person, other than the Prodhan or the Upa-Prodhan of a Gram Panchayat, shall be a member of more than two Upa-Samitis at a time. 4. Resignation of Sanchalak or any member: The Sanchalak or any member of an Upa-Samiti may resign his office by giving notice in writing to the Prodhan and on such resignation being accepted by the Gram Panchayat in a meeting, the Sanchalak or such member shall be deemed to have vacated his office. 5. Casual vacancy: When a vacancy occurs in the office of a Sanchalak or a member of an Upa-Samiti by resignation, death or otherwise, the members of the Upa-Samiti shall elect another Sanchalak or the members of the Gram Panchayat shall elect another member, as the case may be, in the manner as prescribed in rule 1 and 2. The Sanchalak, so elected, shall hold office for the unexpired portion of the term of office of the person in whose place he becomes a member. 6. Subjects to be dealt with by Upa-Samitis: Upa-Samiti of a Gram Panchayat shall deliberate upon and deal with the subjects specified in column (3) of the Table below against the corresponding entry of Upa- Samiti specified in column (2) of the Table. Agriculture, Horticulture, Irrigation, Animal Resources Development, Fisheries, Water shed Development, Cooperation, Provident Fund for Landless Agricultural Labourer. 3. Siksha O Jana Sasthya Literacy campaign, Sishu Siksha Karmasuchi, Madhyamik Siksha Karmasuchi, Primary Education, Mass Education, Rural Library, Public Health, sanitation, Rural Water Supply, Rural Dispensaries & Health Clinics, Family Welfare Programs. 4. Nari O Sishu Unnayan Self-Help Groups, Swarna Jayanti Gram Swarojgar Yojana, Integrated Child Development Scheme, National Social Assistance Program, All other programs relating to woman & child development. 5. Shilpa O Parikathama Cottage & Small scale Industries, Rural Artisans, Infrastructure Development, Indira Awas Yojana, Rural Roads & Housing construction. 7. Powers of Upa-Samiti: (1) Every Upa-Samiti shall prepare schemes and perform the functions of the Gram Panchayat in relation to the subjects allotted to it within the budgetary provisions. It shall also be responsible for implementation of the works and schemes of the Gram Panchayat and those assigned to it by different Departments of the State Government relating to the subjects specified in column (3) of the Table in Rule 1. Provided that (a) (b) (c) the financial limits up to which an Upa-Samiti shall be competent to execute works and schemes, undertaken by the Gram Panchayat, shall be such as may, from time to time, be fixed by the Gram Panchayat or by the State Government, each Upa-Samiti shall prepare proposal for every item of expenditure exceeding maximum limits of its authority and place it with its recommendation to the Gram Panchayat and it shall be its duty to carry out the decision of the Gram Panchayat on such items and execute the schemes according to such decisions, before execution of scheme, each Upa-Samiti shall obtain the financial sanction of Artha O Parikalpana Upa Samiti,

5 (d) an Upa-Samiti shall not be competent to alter budgetary allocation of funds already made by the Gram Panchayat within the subjects allotted to it. 8. Functions and duties of Upa-Samiti: When any scheme is assigned by any department of the State Government or by the Panchayat Samiti or Zilla Parishad or executed from its own resources, the Gram Panchayat shall forward the contents of the assigned schemes to the appropriate Upa-Samiti for drawing up detailed plan for its execution. While forwarding the scheme, the Gram Panchayat may issue direction to the Upa-Samiti about the manner in which the plan for its execution shall be drawn up. The Upa-Samiti shall cause preparation of plan and estimate of the work by taking assistance of any official of the Panchayat, State Government, Statutory Board, Corporation or any other official receiving grant, financial assistance, remuneration from the State Government and proceed to execute the scheme. 9. Meeting of Upa-Samiti: Every Upa-Samiti shall hold a meeting in the office of the Gram Panchayat at least once in two months on such a fixed date and at such time as may be determined by the Gram Panchayat subject to such direction as may be issued by the State Government from time to time. Provided that if the Sanchalak fails to convene the meeting in time, the Prodhan shall convene the meeting of the concerned Upa-Samiti on such date and at such time as may be fixed by him. Provided further that the Prodhan shall not convene more than three consecutive meetings of an Upa-Samiti. 10. Secretary of Upa-Samiti: One official of the Gram Panchayat or of the State Government working at Gram Panchayat level shall act as Secretary to an Upa-Samiti. The Gram Panchayat shall select Secretary for each of the Upa- Samitis in its meeting. Provided that the Secretary of the Gram Panchayat shall act as the Secretary to Artha O Parikalpana Upa-Samiti and during the vacancy, casual or otherwise in the post of Secretary to an Upa-Samiti, the secretary of the Gram Panchayat shall act as secretary to such Upa-Samiti. 11. Preparation of list of business: A list of business to be transacted at every meeting of the Upa-Samiti, except at an adjourned meeting, shall be prepared by the Secretary of the Upa-Samiti under the guidance of the

6 Sanchalak and entered in the agenda book of meetings to be maintained for the purpose and counter signed by the Sanchalak. 12. Notice for meeting: (1)At least clear seven days notice for a meeting shall be given to all members in Form 1. An emergent meeting may be called after giving three days' notice to the members in Form 1A. (2) Notice for a meeting shall be signed by the Secretary of the Upa-Samiti and sent to each member of the Upa-Samiti by a messenger. The manner of service of notice for a meeting of Gram Panchayat shall be followed mutatis mutandis. 13. Attendance of official in the meeting: An Upa-Samiti may require in its meeting attendance of any official of the Gram Panchayat other than the official members of such Upa-Samiti appointed under clause of sub-section (3) of section 32A of the Act. 14. Quorum: Two members of an Upa- Samiti other than the members referred to in Clause of sub-section (3) of section 32A of the Act shall form a quorum for a meeting. An attendance register in Form 2 shall be maintained by the Secretary of each Upa-Samiti. 15. Minute Book: Proceedings of all the meetings of an Upa-Samiti shall be entered in a minute book to be kept for the purpose and shall be read out before the meeting is concluded. The Sanchalak or in his absence a member presiding over the meeting shall sign it. The proceedings of the meeting shall be recorded by the Secretary or in his absence by the Secretary of the Gram Panchayat. 16. Mode of arriving at decision in the meeting: All matters in Upa- Samiti shall be decided by consensus. In case there is any difference of opinion amongst the members referred to in Clause (a) and (b) of subsection (3) of section 32A of the Act, the matter shall be decided by the majority decision. Election of members of Upa-Samitis of Gram Panchayat 17. (1) Within three months from the date of election of the Pradhan of the Gram Panchayat, the Block Development Officer shall call a meeting of the members of Gram Panchayat for election under clause (b) of sub-section (3) of section 32A of members of the Upa-Samitis by fixing a date, time and place and by causing a written notice thereof in Form I to be served on each member of

7 the Gram Panchayat at least seven days before the date fixed for the purpose. (2) Such meeting shall be presided over by such officer not below the rank of an Extension Officer as may be authorized by the Block Development Officer and such officer shall not be entitled to vote at the election. (3) If on the date of the meeting there is no quorum as provided for in sub-section (3) of section 16, the presiding officer shall adjourn the meeting which shall be held on a date to be fixed by the Block Development Officer and the provisions regarding notice to members of Gram Panchayat referred to in sub-rule (1) shall apply: Provided that no quorum shall be necessary for an adjourned meeting. (4) There shall be as many receptacles as there are Upa- Samitis to be constituted, each receptacle bearing a label mentioning the name of Upa- Samiti for which it is meant. The Presiding Officer shall, as soon as may be, after the commencement of the meeting, satisfy all the members present that the receptacles are empty and shall then place them in the view of himself and the attending members. (5) The election of Upa- Samitis shall be conducted one after another in the same order as mentioned in sub-section (2) of section 32A. (6) The Presiding Officer shall call upon the members present to propose and second the names of candidates in conformity with the provisions of sub-section (3) of section 32A and rule 3 for election as members of an Upa-Samiti. If the number of candidates proposed and seconded for an Upa-Samiti is equal to or less than the number of seats prescribed under rule 3, the Presiding Officer shall declare them in Form 4 to be duly elected members of the Upa-Samitis. (7) When the number of candidates declared to be elected is less than the number of seats prescribed, the Block Development Officer shall call a meeting of the members of the Gram Panchayat for a fresh election to complete the number and the provisions regarding notice to members referred to in sub-rule (1) shall apply. (8) If more than the prescribed number of seats are proposed and seconded for an Upa-Samiti, the Presiding Officer shall cause to be prepared as many ballot papers in Form 5 as there are members present, each ballot paper bearing the name of the Upa-Samiti and containing the names of the candidates in the alphabetical order of their surnames for election to the Upa- Samiti.

8 (9) The Presiding Officer shall put his signature with date on the back of each ballot paper and shall hand over a ballot paper to each member present after writing the name of that member and obtaining his dated initial on the back of the allot paper. He shall then ask each member to record his vote by placing the mark X in the place provided for the purpose in the ballot paper opposite to the name of the candidate or candidates for whom the member intends to vote and then place it in the receptacle bearing the label of the Upa-Samiti concerned. (10) Immediately after voting is over, the Presiding Officer shall, in the presence of the attending members, take out the ballot papers from the receptacle, count them and record the number there of in Form 6. On being requested by any member present, the Presiding Officer may, at the time of counting, show both sides of any ballot paper to the member or members; but he shall not allow any member to touch the ballot paper. (11) The Presiding Officer may reject any ballot paper, which, in his opinion, raises a reasonable doubt as to for whom the voter cast the vote, after recording a note to this effect on the ballot paper so rejected. He shall in Form 7 declare the prescribed number of candidates who have secured the larger number of votes in order of merit to be duly elected as members of the Upa-Samiti concerned. (12) In case of an equal number of votes recorded in favour of two or more candidates, selection shall be made of such candidates by lot in such manner as the Presiding Officer shall deem fit and thereupon the candidates thus selected shall be declared to be duly elected as member of the Upa-Samiti. (13) As soon as election of members to all Upa-Samitis is completed, the Presiding Officer shall forthwith forward the names of elected members of all Upa-Samitis to the Pradhan of the Gram Panchayat and to the Block Development Officer for publication in their offices. The Block Development Officer shall forward the names of elected members to the Sub-Divisional Officer, District Panchayat election Officer, the Director of Panchayats and Rural Development, the Commission and the State Government for information. The Director of Panchayats and Rural Development shall publish the names of the members of the Upa-Samitis in the Official Gazette. (14) The papers relating to the election of members to Upa-Samitis of Gram Panchayat shall be preserved by the Block Development Officer in safe custody for three months after which they may be destroyed.

9 Election of Sanchalak of an Upa-Samiti of Gram Panchayat 18. (1) Within one week from the date of completion of elections of all the members of an Upa-Samiti under clause (b) of sub-section (3) of section 32A or within such further time as may be allowed by the District Panchayat Election Officer for reasons to be recorded by him in this behalf, the Block Development Officer shall call a meeting of the members of each Upa-Samiti other than members appointed under clause (c) of sub-section (3) of that section by fixing a date, place and time and by causing a notice thereof in Form 1 to be served on each member to the Upa-Samiti at least seven days before the date fixed for the election of a Sanchalak. (2) The election meeting shall be presided over by an Extension officer as may be authorized by the Block Development Officer in Form 2. Such officer shall not be entitled to vote at the election. (3) The Presiding officer shall call upon the members present to propose and second the name of candidate in conformity with the provisions of sub-section (4) of section 32A of the Act. If only one candidate is proposed and seconded, the presiding officer shall, in Form 4, declare him to be duly elected to be the Sanchalak of the Upa-Samiti. If more than one candidate have been proposed and seconded,, the presiding officer shall hold election in the manner as laid down under sub-rule 8 to 12 of rule 19: Provided that quorum shall be necessary for an election meeting and presence of two members of an Upa-Samiti other than the members referred to in clause (c) of sub-section (3) of section 32A of the Act shall form a quorum for a meeting. (4) As soon as election of Sanchalak is completed, the Presiding Officer shall forthwith forward the name of Sanchalak of Upa- Samiti to the Pradhan of the Gram Panchayat and to the Block Development Officer for publication in their offices. The Block Development Officer shall forward the names of all Sanchalaks to the Sub-Divisional Officer, District Panchayat election Officer, the Director of Panchayats and Rural Development, the Commission and the State Government for information. The Director of Panchayats and Rural Development shall publish the names of the Sanchalaks of the Upa-Samitis in the Official Gazette. (5) The papers relating to the election of members to Upa-Samitis of Gram Panchayat shall be preserved by the Block Development Officer in safe custody for three months after which they may be destroyed.

10 Removal of a member or Sanchalak of an Upa-Samiti of Gram Panchayat 19. (1) The Block Development Officer may, after giving an opportunity to show cause, by order, remove a member, other than members referred to in clause (a) and (c) of sub-section (3) of section 32A from office if he is absent from three consecutive meetings of an Upa-Samiti without the leave of the Upa-Samiti or remove a Sanchalak of an Upa-Samiti, other than the Sanchalak of Artha O Parikalpana Upa-Samiti, from office if he fails to convene three consecutive meetings of an Upa-Samiti. (2) Member or Sanchalak of an Upa-Samiti who is removed under sub-rule (1) may, within thirty days from the date of the order, appeal to the Sub-divisional Officer against the order of such removal. (3) The Sub-divisional Officer may stay the operation of the order made under sub-rule (1) till the disposal of the appeal and may, after giving notice of appeal to the Block Development Officer and after giving the appellant an opportunity of being heard, modify, set aside or confirm the order. The order passed by the Subdivisional Officer on such appeal shall be final. (4) A member or Sanchalak of an Upa-Samiti, other than the Sanchalak of Artha O Parikalpana Upa-Samiti, may, at any time after one year from the constitution of Upa-Samiti, be removed from office by a resolution of the Gram Panchayat, carried by the majority of the existing members of the Gram Panchayat, at a meeting, specially convened for the purpose. Notice for such meeting shall be given to the Block Development Officer who shall depute an observer to the meeting. After the meeting is over, the observer shall submit a report to the Block Development Officer on the proceedings of the meeting. By order of the Governor Sd/- (M. N.
