Chitwan National Park Rules, 2030 (1974) [ Date of Publication in Nepal Gazette 2030.11.21 (4 March 1974) Amendment : Chitwan National Park (First Amendment) Rules, 2046 2046.2.16 (29 May 1989) In exercise of the powers conferred by Section 33 of the National Parks and Wildlife Conservation Act, 2029 (1973), the Government of Nepal has framed the following Rules. 1. Short Title & Commencement : (1) These Rules may be called "Chitwan National Park Rules, 2030 (1974)". (2) These Rules shall come into force immediately. 2. Definition : Unless the subject or context otherwise requires in these Rules, (A) (B) (C) "Act" means the National Parks and Wildlife Conservation Act, 2029 (1973). "Park" or "National Park" means Chitwan National Park. "Warden" means the chief officer of the National Park appointed by the Government of Nepal. 3. Boundary of National Park : The boundary of the National Park shall be as declared by the Government of Nepal by publishing a notice in the Nepal Gazette, pursuant to Section 3 of the Act. 4. Entry into the Park : (1) The person desiring to enter into the Park shall pay (submit) the fee as prescribed in Schedule -1 and the warden or any employee assigned by the Government of Nepal for the job shall 1

issue the admission card as pursuant to Schedule -2 to the person who has paid such fees. (2) Not withstanding anything contained in Sub-rule (1), persons using the facility of the pathway pursuant to Rule 19 shall not need to pay the fee, if walked in the park by obtaining permission from the concerned entry post. 1 (3) The warden may provide the free admission card as pursuant to Schedule 2A to any person, educational institution or a team of any other institution, desiring for a study visit into the Park. 5. The entry into the Park to be one s own liability : If any type of harm, damage or injury or even the death has occurred to the person who has entered into the Park whether obtaining an admission card or not, the Government of Nepal shall not be liable for the compensation of such harm, damage, injury or death. 6. Prohibited activities within the Park : No person without obtaining a written permission of the Warden or the employee authorized by the Government of Nepal for the job shall be allowed to perform the following activities within the Park ; (A) (B) (C) (D) To build or possess any type of house, hut, hermitage or structure, To occupy (capture), deforest or cultivate any land, To graze (pasture) domestic animals or birds or to feed water to them, To cut, fell, remove, obstruct, trim the trees, plants, bushes or any other forest products or to perform any activity to be drying up the forest products, to set fire or to harm in any form, 1 Amendment by First Amendment. 2

(E) (F) (G) To put a camp or spend the night in the place other than set aside for camping, To set fire on other place than the place set-aside for camping or prescribed by the warden, To carry or cause to walk any domestic animal from other pathway or places than the prescribed pathway as pursuant to Rule 19. 7. Prohibited goods to be possessed (kept) or carried : No person without a written permission of a warden, shall be allowed to carry or to keep the following goods with him/her while entering or staying within the Park or passing through the pathway prescribed pursuant to Rule 19: (A) (B) (C) (D) Weapons or arms and ammunitions, Explosive substance or its derivatives (instruments), Trophy or dry or fresh meat (flesh) of any wildlife, A bow, a cage (Khor), a trap (Dharap), a snare (Paso), trapping net (Jaal) or poison. 8. To be liable : If someone has damaged the plants, weed or other any things, substances within the Park by setting a fire inside or outside the boundary of the Park then such person who sets or initiates the fire shall be liable for such damage. 9. Prohibition of hunting and moving or destroying the nest of birds: Except obtaining a permit pursuant to the Act for doing the appropriate action for the benefit of the Park or collecting the specimen for the scientific research, in other situations no person shall be allowed to hunt, kill, catch, chase, frighten or injure any wildlife or birds or to remove, destroy or disturb the eggs or nest of any birds within the Park without obtaining a written permission of the warden. 3

10. Permission to be taken for fishing : (1) The fishing in the river (spring) or pond situated within the park shall be allowed only if the fees pursuant to Schedule - 1 has been paid and in condition of following the terms prescribed by the warden or any employee assigned by the Government of Nepal for that job. 2 (2) In the rivers Rapti, Narayani and Riu which has been situated on the boundary of the park only the persons residing around the river shall be allowed for the fishing by paying the fees prescribed in Schedule -1. 11. Prior Approval of the Government of Nepal to be obtained : (1) No person shall be allowed, without obtaining (taking) the approval of the Government of Nepal, to explore excavate or remove the earth, stones, sand or any minerals within the park. (2) If any person desires to perform any research activities within the park, he/she may perform by taking prior approval of the Government of Nepal and in that case he/she shall submit one copy of his/her research to the Government of Nepal. 12. Prohibition on posting or keeping an advertisement : Except in the areas of hotel, lodge or any other commercial transaction established within the park as pursuant to the Act, No person shall be allowed to post or keep any type (form) of sign board, notice,di advertisement or other similar poster within the park. 13. Prohibition to play musical instruments : Except in the hotel, lodge and other similar places no radio, tape recorder or other similar musical instruments shall be allowed to play in other places within the park. 14. Prohibition on throwing waste : No person shall be allowed to produce or throw waste within the park. 2 Amendment by First Amendment. 4

15. Prohibition on throwing Toxic substance : No person shall be allowed to throw any kinds of pesticide or chemical substance or narcotic or poisonous substance inside the Park or making it to reach inside the Park from outside the Park or to put or spray in the river, rivulet that flow through the Park or to put in any other source of the water or to put in any other manner making it to reach inside the Park. 16. Terms to be followed for driving in the park : The person driving a vehicle in the Park shall drive the vehicle under the following terms and conditions : (A) (B) (C) (D) No vehicle more than five tons of weight shall be allowed for driving, No vehicle shall be driven or parked by obstructing the traffic of vehicles, pedestrians or other goods, No vehicle shall be allowed to drive with more speed than the prescribed or to play the horn, If any pathway has been closed pursuant to Sub-rule (3) of the Rule 19, no vehicle shall be driven on such road. 17. Sign, mark to be followed: All drivers of the vehicle shall follow the signal or indication made by the employee of the Park or shall drive as pursuant to any signboard posted to denote such signal or indication, within the territory of the Park. 18. Prohibition on Traffic (Travel) : Except in the hotel, lodge or prescribed place for the camp, no person shall be allowed to enter or walk within the Park, 3 since the sunset (evening) to the sunrise (dawn) without the written permission of the warden. 3 Amended by First Amendment. 5

19. Privilege for Pathway : (1) There shall be a privilege for trekking or driving a vehicle within the Park through the pathway as prescribed in Schedule - 5. (2) The pathway pursuant to Sub-rule (1) shall only be used from the place of the demarcation prescribed by the warden and, no person in any situation shall be allowed to use other pathway leaving the such pathway without the written permission of the warden. (3) Notwithstanding anything contained in Sub-rule (1) and (2) if the warden deemed appropriate to close any such road during the adverse weather (climate), he/she may close it till the weather has not been favorable. 20. Fee to be submitted : (1) The fees as prescribed in Schedule -1 shall be submitted for performing the following activities within the park : (A) (B) (C) (D) (E) For driving a vehicle, For camping, For obtaining the service of park guide, For carrying a domestic animal along with his/her self. For cutting the straw grass (Khar Khadai) (2) A receipt pursuant to Schedule -4 shall be given to the person paying the fees, pursuant to Sub-rule (1). 4 (3) Notwithstanding anything contained in Sub-rule (1), for driving any person, educational institution or any other institution who has obtained free admission card as pursuant to Sub-rule (3) of Rule 4, shall not be charged the fee as prescribed in Schedule -1. 21. Vehicle or domestic animal to be captured : If any vehicle has been driven or domestic animal has been caused to be walked through 4 Inserted by First Amendment. 6

the other roads, except through the provided convenient road within the Park as pursuant to these Rules has been found, the employees of the prescribed post of the Park by the warden may capture it and shall present before the concerned officer for the action. 22. May Be Arrested : (1) The assistant warden, wildlife guard or any other employees of the Park may arrest any person, after obtaining a warrant from the warden, on the charge of violation of the Act or may search the goods or vehicles of such person. (2) Notwithstanding anything contained in Sub-rule (1), if any accuse has a situation to escape, the accused may be arrested or his goods or vehicles may be searched even without a warrant. 23. Immunity to enter into the Park for the Government function: Anything mentioned in these Rules shall not be considered that it has obstructed to any employee of the National Park or any other Government office to enter into the Park at any time for the implementation of any governmental functions by the order of his/her own office or any other government office. 5 23A. Power to be delegated : The Warden may delegate the power conferred to him/her as pursuant to Sub-rule (3) of the Rule (4) and Rule 18 to the assistant warden or ranger. 24. The amendment may be made on Schedule : The Government of Nepal if deemed necessary may make alteration or change in the Schedule by publishing a notice in the Nepal Gazette. 25. Adjudicating officer : (1) The power to adjudicate the cases of offenses under the Act and these Rules shall be on the Warden. 5 Inserted by First Amendment. 7

(2) Without doing any adverse effect on the generality of the Subrule (1), the power to adjudicate the cases of the following offenses shall be on the assistant warden and in his/her absence on the Ranger : (A) If the forest product up to five hundred rupees in value (price) has been removed, cut or picked irregularly, (B) If entered into the park without obtaining admission card or permit, (C) (D) (E) If the domestic animals or birds has been grazed or feed water within the park, If staying at night, set up a camp or set fire except in the place separated for camp, place or place prescribed by the Warden, If domestic animals have been to cause to make walking from another place than the prescribed pathway, (F) If fishing has been made against Rule 10, (G) (H) If any signboard, notice board, advertisement or posters have been put or posted against Rule 12, If any musical instrument has been played against Rule 13, (I) If any garbage has been produced against Rule 14, (J) (K) If a vehicle has been driven against Rules 16 and 17, If entered or walked within the park since sunset to the sunrise without permission, (L) If walked in any pathway or place against Rule 19. 8

For taking (passing) domestic animals through the available convenient pathway shall not be charged any fees. The valid date for Khar Khadai permit shall be for three days. 10

(D) (E) Park entry fee shall not be charged to the guide paying the guide fee. The vehicle to be used for professional jungle drive shall not be allowed to carry more than the following number of tourists : (a) (b) (c) Car Four persons Jeep Ten persons Van Fifteen persons (F) (G) Any person entering within the park without obtaining admission card or permit or performing any such activities shall be provided the entry permit by taking a cent percent additional fees in the prescribed fee. The entrance period (duration of entry) for a private elephant shall be for one hour. 11
